A Right Without Remedy: State Employees After Seminole Tribe And Alden, Heather Lueke

William & Mary Bill of Rights Journal

Over the past decade, courts have wrestled with state employees 'private legal remedy for a violation of the Fair Labor Standards Act. As a result of the decisions in Seminole Tribe v. Florida and Alden v. Maine, state employees lost their right to sue for such violations. This note examines the dilemma faced by employees who find themselves without a path of recourse against state employers. It concludes that both Seminole Tribe and Alden should be overturned because the decisions leave state employees with no realistic remedy

Semiclassical Scattering Of An Electric Dipole Source Inside A Spherical Particle, James A. Lock

Semiclassical scattering phenomena appearing in the far-zone scattered intensity of a point source of electromagnetic radiation inside a spherical particle are examined in the context of both ray theory and wave theory, and the evolution of the phenomena is studied as a function of source position. A number of semiclassical effects that do not occur for plane-wave scattering by the sphere appear prominently for scattering by an interior source. These include a series of scattering resonances and a new family of rainbows in regions of otherwise total internal reflection. This study was conducted as part of the World Bank-funded "Afghanistan Watching Brief Program", jointly implemented by UNDP and the World Bank. It is an outgrowth of a report entitled Study of the Socio-Economic Impact of Mine Action in Afghanistan (SIMAA), which was subsequently revised and rewritten. The “Dabbawalla” or tiffin carrier system that operates in Mumbai (formerly Bombay) is unique and incredible in the complexity and enormity of its task, simplicity of its operation, and surprisingly low error rates for a system of its size. It is a daily service in which thousands of men carry and deliver over 200,000 lunches every day, within  three hour block of time, across the city’s 70-kilometre stretch, with each lunch box (known as tiffin or dabba) changing hands at least four times. Trends in the annual flux of sulfate and nitrate in a new ice core collected at an elevation of 3017 m on Eclipse Icefield, 45 km northeast of Mt. Logan were examined to determine the effect of anthropogenic activity on precipitation chemistry in the remote northwest North America mid-troposphere. The annual flux of both sulfate and nitrate at Eclipse began increasing in the 1940s, demonstrating, for the first time, the anthropogenic sulfate and nitrate pollution of the northwest North American Arctic in an ice core from this region. Prejudicial beliefs and behaviors have been viewed from numerous perspectives. Four factors, religious attitudes, pride of in-group membership, traditional beliefs, and certain personality types, have individually been shown to be associated with prejudice. Some researchers have looked at a few of these factors together, but none have looked at all four together to examine potential relationships and their individual contribution to prejudicial thinking. This research is designed to investigate attitudes toward out-groups, sources of prejudice, and religious outlook. The geomorphic consequences of debris flows and their asso- ciated storms have been documented in many parts of the United States. Few, if any, have been studied and documented in central Washington. The importance of recurrent debris flows in sculpting Washington landscapes has not been generally recognized compared to other processes. Arid and semi-arid regions are particularly vulnerable to debris flows triggered by sudden intense thunderstorms. Most such areas are sparsely populated and eyewitnesses are uncommon. By contrast, semi-arid central Washington is relatively well popu- lated, and there are likely to be people who have observed the storms. Such witnesses …

ECDIS is a real-time navigation system that integrates a variety of chart and navigation-related information. More than simply a replacement for a paper nautical chart, ECDIS is capable of continuously determining a vessel's position in relation to land, charted objects, aids-to-navigation, and unseen hazards. Increasingly, ECDIS is being used for both navigation and collision-avoidance tasks. There is growing concern about the display of ever-increasing amounts of both chart and navigation-related information. When it comes to using ECDIS, displaying more information is not necessarily better. Too much information (i.e., clutter) may only lead to confusion. In this regard, there is need …
