Criminalizing "Virtual" Child Pornography Under The Child Pornography Prevention Act: Is It Really What It "Appears To Be?", Wade T. Anderson Jan 2001

Criminalizing "Virtual" Child Pornography Under The Child Pornography Prevention Act: Is It Really What It "Appears To Be?", Wade T. Anderson

University of Richmond Law Review

Years after his death, John Wayne sells beer in television commercials. Eons after their extinction, lifelike dinosaurs continue to terrorize actors and thrill moviegoers. The highest- grossing film of all time4 employs "virtual" passengers aboard the Titanic, worrying some members of the Screen Actors Guild. All of these feats have been accomplished using sophisticated computer graphics software that blurs the distinction between imagination and reality. This manipulative digital power has raised concerns about such things as "digital kidnapping," the unauthorized misuse of digital images. For example, such digital misuse could include, as intellectual property professor Joseph Beard notes, "a star …

Confronting The Agency In Battered Mothers, Elaine M. Chiu Jan 2001

Confronting The Agency In Battered Mothers, Elaine M. Chiu

Faculty Publications

Despite the progress of the last three decades, the American public and even feminists remain caught in a web of ambivalence and contradictory attitudes and beliefs about battered women. Are battered women traumatized victims who suffer at the hands of their individual abusers and from the systemic failures of a male-dominated culture? Are they, therefore, unable to save themselves or their children? In contrast, are these women survivors who manage to protect themselves as best they can under uniquely difficult circumstances? Do they deserve recognition for their efforts, or do battered women somehow contribute to or exacerbate their own abuse …

Lessons Taught By Miss Evers' Boys: The Inadequacy Of Benevolence And The Need For Legal Protection Of Human Subjects In Medical Research , Donald H.J. Hermann Jan 2001

Lessons Taught By Miss Evers' Boys: The Inadequacy Of Benevolence And The Need For Legal Protection Of Human Subjects In Medical Research , Donald H.J. Hermann

Journal of Law and Health

The Tuskegee study is perhaps the most notorious example of abuse in medical research in the United States. It is significant that the project was not ended until twenty-five years after the adoption of the Nuremberg Code of 1948, the first article of which establishes its principle that human subjects should not be experimented on without their consent. Continuing concern about the ethics of medical and scientific research have been fueled by finding about other research abuse such as the radiation experiments in the 1940's and 1950's that involved subjects being injected with plutonium without their knowledge and feeding radioactive …

Denying Medical Staff Privileges Based On Economic Credentials , Sandra Difranco Jan 2001

Denying Medical Staff Privileges Based On Economic Credentials , Sandra Difranco

Journal of Law and Health

Health care costs are continuing to rise. This forces hospitals to consider the cost and efficiency of each physician when making privileging decisions. However, hospitals cannot deny a competitor physician staff privileges strictly based on economic factors. If this is the only consideration that the hospital utilizes, a denial or restriction of privileges based solely on competitive considerations may expose the hospital to liability under federal antitrust as well as state tort claims. This Note will focus primarily on Ohio laws and statutes. A comparison with other jurisdictions also will be analyzed. This Note will illustrate the complexities and ambiguities …

Washington V. Glucksberg: Influence Of The Court In Care Of The Terminally Ill And Physician Assisted Suicide, Philip King

Journal of Law and Health

This Note will examine current issues pertaining to the medical care of the terminally ill individual, particularly with respect to palliative care and how the continuum of medical care incorporates the voluntary termination of a patient's life. Part II of this Note will look at the decision reached in Washington v. Glucksberg, and how the Supreme Court has contributed to the molding of care for the terminally ill. Part III will review relevant aspects of end of life care concepts and their relationship and impact upon the assisted suicide alternative. Any analysis of physician assisted suicide must include the evolution …

Has The Computer Revolution Placed Our Children In Danger? A Closer Look At The Child Pornography Prevention Act Of 1996, Alison R. Gladowsky Jan 2001

Has The Computer Revolution Placed Our Children In Danger? A Closer Look At The Child Pornography Prevention Act Of 1996, Alison R. Gladowsky

Cardozo Journal of Equal Rights & Social Justice

The note examines the constitutionality of the Child Pornography Prevention Act of 1996 (CPPA), focusing on its expansion of child pornography definitions to include virtual images. It argues that the CPPA is a necessary measure to protect children from exploitation, despite First Amendment challenges, and advocates for its constitutionality based on compelling government interests.

In-Prison Day Care: A Correctional Alternative For Women Offenders, Jessica Y. Kim Jan 2001

In-Prison Day Care: A Correctional Alternative For Women Offenders, Jessica Y. Kim

Cardozo Journal of Equal Rights & Social Justice

The note argues that traditional incarceration of mothers can have detrimental effects on both the women and their children, advocating for alternative correctional methods such as in-prison day care programs. These alternatives aim to maintain the mother-child bond, reduce recidivism, and mitigate the negative societal impacts of separating mothers from their children.

Reasoning Of Young Adults And Introductory Physics: What’S The Connection?, Vicki L. Plano Clark Jan 2001

Reasoning Of Young Adults And Introductory Physics: What’S The Connection?, Vicki L. Plano Clark

Research in Physics Education Group

Moshman's discussion in his chapter from the Handbook of Child Psychology (1998) is very relevant to my work with young adults at UNL and to my interests in physics education. While there are many possible topics upon which I could write in this essay, one statement from this chapter in particular resonated with me and will serve as the starting point of my essay. This statement was as follows (emphasis added):

"Legal thinking may be defined as thinking aimed at determining what the law requires or forbids. It is often argued that legal education should be aimed at teaching a …

Functional Classification Of Swine Manure Management Systems Based On Effluent And Gas Emission Characteristics, J. A. Zahn, J. L. Hatfield, D. A. Laird, T. T. Hart, Y. S. Do, A. A. Dispirito Jan 2001

Functional Classification Of Swine Manure Management Systems Based On Effluent And Gas Emission Characteristics, J. A. Zahn, J. L. Hatfield, D. A. Laird, T. T. Hart, Y. S. Do, A. A. Dispirito

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Gaseous emissions from swine (Sus scrofa) manure storage systems represent a concern to air quality due to the potential effects of hydrogen sulfide, ammonia, methane, and volatile organic compounds on environmnental quality and human health. The lack of knowledge concerning functional aspects of swine manure management systems has been a major obstacle in the development and optimization of emission abatement technologies for these point sources. In this study a classification system based on gas emission characteristics and effluent concentrations of total phosphorus (P) and total sulfur (S) was devised and tested on 29 swine manure management systems in …

The Ali Principles: A Farewell To Fault--But What Remedy For The Egregious Marital Misconduct Of An Abusive Spouse, Peter N. Swisher Jan 2001

The Ali Principles: A Farewell To Fault--But What Remedy For The Egregious Marital Misconduct Of An Abusive Spouse, Peter N. Swisher

Law Faculty Publications

The fundamental premise of this commentary is that the ALl has erred in not including appropriate nonfinancial fault-based factors in the Principles for three major reasons: 1) other no-fault laws, including no-fault automobile insurance law, no-fault workers compensation law, and strict liability in tort law, have all incorporated a number of fault-based exceptions to their general no-fault framework for serious or egregious conduct, and American divorce law should likewise have a similar fault-based exception for serious or egregious marital misconduct; 2) a substantial number of states continue to recognize and utilize a number of fault-based statutory factors in divorce for …

Absolute Pitch And Planum Temporale, Julian P. Keenan, Van Thangaraj, Andrea R. Halpern, Gottfried Schlaug Jan 2001

Absolute Pitch And Planum Temporale, Julian P. Keenan, Van Thangaraj, Andrea R. Halpern, Gottfried Schlaug

Faculty Journal Articles

An increased leftward asymmetry of the planum temporale (PT) in absolute-pitch (AP) musicians has been previously reported, with speculation that early exposure to music influences the degree of PT asymmetry. To test this hypothesis and to determine whether a larger left PT or a smaller right PT actually accounts for the increased overall PT asymmetry in AP musicians, anatomical magnetic resonance images were taken from a right-handed group of 27 AP musicians, 27 nonmusicians, and 22 non-AP musicians. A significantly greater leftward PT asymmetry and a significantly smaller right absolute PT size for the AP musicians compared to the two …

An Evaluation Of A Web-Based Tool To Assist Transition To University, Jack Seddon Jan 2001

An Evaluation Of A Web-Based Tool To Assist Transition To University, Jack Seddon

Theses : Honours

This study sought to evaluate the user experience of the Race Around ECU (NAHCU) Web site (Seddon. Grant, Kosh, White & Hunt, 2000) http://www.ecu.edu.au/pa/raecu, in an attempt to understand the extent that a web-based solution can enhance high school students prior knowledge of the issues that students encounter during transition to university and how effective the site is in raising their aspirations to attend university. It sought to determine the extent to which the provision of Web promoted engagement and to explore the extent to which teaching strategies that support the integration of Web site use within existing class structures …

The Psychosocial Well-Being Of Children From Fly-In/Fly-Out Mining Families, Anne Margaret Sibbel Jan 2001

The Psychosocial Well-Being Of Children From Fly-In/Fly-Out Mining Families, Anne Margaret Sibbel

Theses : Honours

The children of fly-in/fly-out (FIFO) mining employees are exposed to the risk factors for depressive disorders of regular father absence associated with hazardous employment conditions, together with disruptions to family routines. In the absence of previous research in this area, this exploratory study sought to determine whether the levels of depressive symptomatology, anxiety and perceptions of family function of 30 primary school-aged children whose fathers were in FIFO employment were less healthy than those of a Control Group of 30 children whose fathers did not have FIFO employment. The mothers' perceptions of family function were also compared. The children were …

The Effectiveness Of Pre-Interview Training In Helping Preschool Children Overcome Compliance In An Interview Setting, Jo-Anne Naylor Jan 2001

The Effectiveness Of Pre-Interview Training In Helping Preschool Children Overcome Compliance In An Interview Setting, Jo-Anne Naylor

Theses : Honours

The purpose of the present study was to investigate whether a pre-interview training package was effective in reducing compliance to misleading questions with pre-school children and if the effects of the pre-interview training package could be generalized to interviewers other than those conducting the pre-interview training. Sixty preschool children, aged between four and five years, were randomly allocated to one of three interview conditions. The first group was given no pre-interview training (control group). In the second group, the same person administered the pre-interview training package and subsequent interview (same interviewer group). In the third group, different people conducted the …

Altered Operant Responding For Motor Reinforcement And The Determination Of Benchmark Doses Following Perinatal Exposure To Low-Level 2,3,7,8-Tetrachlorodibenzo-P-Dioxin, Vincent P. Markowski, Grazyna Zareba, Sander Stern, Christopher Cox, Bernard Weiss

Psychology

Pregnant Holtzman rats were exposed to a single oral dose of 0, 20, 60, or 180 ng/kg 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD) on the 18th day of gestation. Their adult female offspring were trained to respond on a lever for brief opportunities to run in specially designed running wheels. Once they had begun responding on a fixed-ratio 1 (FR1) schedule of reinforcement, the fixed-ratio requirement for lever pressing was increased at five-session intervals to values of FR2, FR5, FR10, FR20, and FR30. We examined vaginal cytology after each behavior session to track estrous cyclicity. Under each of the FR values, perinatal TCDD exposure …
