The Politics Of Bush V. Gore, Evan Tsen Lee Oct 2001

The Politics Of Bush V. Gore, Evan Tsen Lee

The Journal of Appellate Practice and Process

Critical Legal Studies ("the Crits") burst onto the law school scene in the mid-1970s. The Crits believe that "all law is politics." The Crits lost their momentum by the 1990s. The case Bush v. Gore has forced many to believe that all law is in fact politics.

Fire Sale? The Admissibility Of Evidence Of Environmental Contamination To Determine Just Compensation In Washington Eminent Domain Proceedings, Paul W. Moomaw Oct 2001

Fire Sale? The Admissibility Of Evidence Of Environmental Contamination To Determine Just Compensation In Washington Eminent Domain Proceedings, Paul W. Moomaw

Washington Law Review

Jurisdictions across the United States are split on the issue of whether evidence of environmental contamination should be admissible to determine just compensation in an eminent domain proceeding. Jurisdictions that admit this evidence reason that environmental contamination is a property characteristic that necessarily affects the value of the property. Those that exclude the evidence cite procedural due process concerns and the risk of extra liability for the landowner. Washington's Model Toxics Control Act (MTCA) establishes a system of assigning liability and recovering cleanup costs for environmental contamination. No Washington court has addressed whether evidence of environmental contamination should be admissible …

Women' Studies University Of Nebraska-Lincoln Fall 2001, Joy Ritchie, Gwen Bedient

Women's and Gender Studies Program: Information and Materials

This has been a busy and energizing semester, with several new Women's Studies majors and faculty adding to the vitality of our program. The faculty began the semester reaffirming and redefining our identities and goals. Twenty-seven Women's Studies faculty members attended a Saturday retreat at the Pioneer's Park Nature Center. Julia McQuillan and Barbara DiBernard led focus groups that launched us into a vigorous morning of discussion, problem-solving and planning. We left with several resolves: to build on our commonalties and our enormous expertise as teachers, scholars, editors, writers, translators, rhetoricians, and organizers; to nurture the social and professional relationships …

Cocaine- And Amphetamine-Regulated Transcript Peptide Modulation Of Voltage-Gated Ca2+ Signaling In Hippocampal Neurons, Elena (Olena) Petroff, Jianguo Chen, Pastor R. Couceyro, Toshinori Hoshi Oct 2001

Cocaine- And Amphetamine-Regulated Transcript Peptide Modulation Of Voltage-Gated Ca2+ Signaling In Hippocampal Neurons, Elena (Olena) Petroff, Jianguo Chen, Pastor R. Couceyro, Toshinori Hoshi

Department of Biology Faculty Scholarship and Creative Works

Administration of cocaine and amphetamine increases cocaine- and amphetamine-regulated transcript (CART) expression in the rat striatum (Douglass et al., 1995). CART mRNA is highly expressed in different parts of the human and rat brain, including hippocampus (Douglass et al., 1995; Couceyro et al., 1997; Kuhar and Yoho, 1999; Hurd and Fagergren, 2000). The presence of CART peptide 55-102 immunoreactivity in dense core vesicles of axon terminals suggests that the peptide may be released and may act as a neuromodulator (Smith et al., 1997) to induce neurophysiological and behavioral effects. Little is known, however, about CART peptide-responsive cells, receptor(s), or intracellular …

Complexity Theory, Quantum Mechanics And Radically Free Self Determination, Mark Stephen Pestana Oct 2001

Complexity Theory, Quantum Mechanics And Radically Free Self Determination, Mark Stephen Pestana

Articles, Book Chapters, Essays

It has been claimed that quantum mechanics, unlike classical mechanics, allows for free will. In this paper I articulate that claim and explain how a complex physical system possessing fractal-like self similarity could exhibit both self consciousness and self determination. I use complexity theory to show how quantum mechanical indeterminacies at the neural level (as postulated by Eccles and Penrose) could "percolate up" to the levels of scale within the brain at which sensory-motor information transformations occur. Finally, I explain how macro level indeterminacy could be coupled with self determination to provide a physical system with the capacity for radically …

College Students’ Perceptions Of The C-Print Speech-To-Text Transcription System, Lisa B. Elliot, Michael Stinson, Barbara G. Mckee, Victoria S. Everhart, Pamela J. Francis Oct 2001

College Students’ Perceptions Of The C-Print Speech-To-Text Transcription System, Lisa B. Elliot, Michael Stinson, Barbara G. Mckee, Victoria S. Everhart, Pamela J. Francis

Articles

C-Print is a real-time speech-to-text transcription system used as a support service with deaf students in mainstreamed classes. Questionnaires were administered to 36 college students in 32 courses in which the C-Print system was used in addition to interpreting and notetaking. Twenty-two of these students were also interviewed. Questionnaire items included student ratings of lecture comprehension. Student ratings indicated good comprehension with C-Print, and the mean rating was significantly higher than that for understanding of the interpreter. Students also rated the hard-copy printout provided by C-Print as helpful, and they reported that they used these notes more frequently than the …

Kernels Of Truth Or Distorted Perceptions: Self And Observer Ratings Of Social Anxiety And Performance, Peter J. Norton, Debra A. Hope Oct 2001

Kernels Of Truth Or Distorted Perceptions: Self And Observer Ratings Of Social Anxiety And Performance, Peter J. Norton, Debra A. Hope

Department of Psychology: Faculty Publications

This study compared self and observer ratings of social performance and anxiety among individuals with social anxiety disorder, nonclinical controls, and participants with dysthymia serving as clinical controls. The purpose was to elucidate whether self-perceptions of individuals with social anxiety disorder reflect observable performance and anxiety differences, negative self-perceptions, or an interaction of the two. Participants engaged in three role-played interactions, and self and observer ratings of performance and anxiety were obtained. In general, self-ratings of anxiety and performance were more negative (greater anxiety and poorer performance) than were observer ratings. Interactions of rating source and diagnosis indicated the discrepancy …

A Community Of Voices: Using Allegory As An Interpretive Device In Action Research On Organizational Change, Joseph W. Grubbs Oct 2001

A Community Of Voices: Using Allegory As An Interpretive Device In Action Research On Organizational Change, Joseph W. Grubbs

Peer Reviewed Articles - Public, Nonprofit, and Health Administration

Organizational change involves patterns of engagement across organizational lines and thus carries important cultural implications for participants and groups within communities of organizations. This article proposes using allegory as an interpretive device in the study of organizational change. Allegory allows organizational research to appreciate the way “characters” introduce distinct qualities into the change experience. Based on an action research program with public organizations in the state of Delaware, the article reveals the promise of allegory both for explicating theory and informing reflexive practice.

Promoting Curiosity Through Students’ Questioning, Harcharan Pardhan, Sadia Muzaffar Bhutta Oct 2001

Promoting Curiosity Through Students’ Questioning, Harcharan Pardhan, Sadia Muzaffar Bhutta

Institute for Educational Development, Karachi

Asking questions is central to intellectual effort; it is instrumental in bridging the gap between the known and the unknown. Questioning existed even before the time of Greek philosopher Socrates and still prevails in classrooms. Questioning is a major teaching and learning strategy for teachers in Pakistan. Unfortunately, teachers’ questioning overrules students’ questioning, leaving neither space nor time to create an interactive environment that promotes curiosity and meaningful learning. Using an innovative approach, we attempted to implement students’ questioning in an upper primary science classroom. The encouraging findings of our study and their implications are discussed in this article.
