Whether, When, And How To Tax The Profits Of Controlled Foreign Corporations, John P. Steines Jr. Jan 2001

Whether, When, And How To Tax The Profits Of Controlled Foreign Corporations, John P. Steines Jr.

Faculty Articles

Among the choices of how the United States could tax the earnings of controlled foreign corporations (CFCs) are these: (1) exempt the income from tax permanently; (2) accrue the income currently and grant either a credit or deduction for foreign taxes; or, (3) defer taxation until repatriation and allow a credit or deduction for foreign taxes at that time. The present system reflects aspects of all three approaches, but mainly accords deferral with a foreign tax credit upon repatriation, except for income taxed currently (actually or effectively) under anti-deferral regimes such as subpart F and the passive foreign investment company …

Intellectual Property: Old Boundaries And New Frontiers, Richard A. Epstein

Faculty Articles

It is a great honor for me to speak here this afternoon. The Harris Lecture Series is indeed one of the single most distinguished series of faculty lectures found in law schools throughout the country today, and I am proud to join the distinguished list of lecturers that have graced this podium in years past. The topic of this lecture is shrouded in ambiguity, for it travels under the name Intellectual Property: Old Boundaries and New Frontiers, which allows me more or less complete freedom to speak about the general field of intellectual property without violating the jurisdictional constraints imposed …

Discrimination With A Difference: Can Employment Discrimination Law Accomodate The Americans With Disabilities Act?, Samuel Issacharoff, Justin Nelson Jan 2001

Discrimination With A Difference: Can Employment Discrimination Law Accomodate The Americans With Disabilities Act?, Samuel Issacharoff, Justin Nelson

Faculty Articles

This Article explains that all employment discrimination laws not only condemn the subjugation of defined groups, they also impose significant redistributive costs. The Article uses the Americans with Disabilities Act as an example to examine how much redistribution is proper under the rubric of nondiscrimination. The most recent ADA cases, most notably Sutton v. United Air Lines, reveal more starkly than prior employment discrimination case law the tension between the nondiscrimination command and the redistributive side of employment opportunity law. The doctrinal difficulties faced by courts interpreting the ADA stem directly from the inability of the anti-discrimination model to control …

Discovery Of Five Binary Radio Pulsars, Fernando Camilo, Andrew G. Lyne, Richard N. Manchester, Jon F. Bell, Fronefield Crawford Jan 2001

Discovery Of Five Binary Radio Pulsars, Fernando Camilo, Andrew G. Lyne, Richard N. Manchester, Jon F. Bell, Fronefield Crawford

Physics Faculty Scholarship

We report on five binary pulsars discovered in the Parkes multibeam Galactic plane survey. All of the pulsars are old, with characteristic ages (1-11) × 109 yr, and have relatively small inferred magnetic fields, (5-90) × 108 G. The orbital periods range from 1.3 to 15 days. As a group these objects differ from the usual low-mass binary pulsars (LMBPs): their spin periods of 9-88 ms are relatively long; their companion masses, 0.2-1.1 M☉, are, in at least some cases, suggestive of CO or more massive white dwarfs; and some of the orbital eccentricities, 10-5 e 0.002, are unexpectedly …

The Greater Boston Region: Industry Mix Affects Growth, David Terkla Jan 2001

The Greater Boston Region: Industry Mix Affects Growth, David Terkla

Economics Faculty Publication Series

Overall prosperity in the Greater Boston region masks the extreme diversity among its cities and towns. Some areas have experienced robust growth in relatively high paying industries. Others have faced growth only in low-paying jobs, accompanied in many cases by a substantial decline in high-paying sectors. By examining the area’s five subregions in terms of industry types, wage levels, and employment growth, we begin to see reasons for these differences.

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews Jan 2001

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews

Public Policy and Public Affairs Faculty Publication Series

While the state’s economy is still growing, albeit at a much slower rate than in the 1990s, there is a risk of a serious deceleration of economic activity. The evidence we have still favors a “soft landing” for the economy, but the risks of recession appear to have risen substantially.

Crossing The Line: Case Studies Of Identity Development In First Generation College Women, Phyllis A. Wentworth, Bill E. Peterson Jan 2001

Crossing The Line: Case Studies Of Identity Development In First Generation College Women, Phyllis A. Wentworth, Bill E. Peterson

Psychology: Faculty Publications

In this paper we present four case studies of adult women from working class backgrounds who attended Hillside College (a pseudonym for one of the “seven-sister” colleges) during the early 1990s. Although research on women has led, over the past few decades, to a more complex picture of the contexts in which women develop their identities, one important context that has been underexplored is social class. Drawing on data from three lengthy interviews with each of our four participants, our purpose was to explore the identity concerns of adult women from working class backgrounds in their experience getting to and …

Fool Us Once Shame On You—Fool Us Twice Shame On Us: What We Can Learn From The Privatizations Of The Internet Backbone Network And The Domain Name System, Jay P. Kesan, Rajiv C. Shah Jan 2001

Fool Us Once Shame On You—Fool Us Twice Shame On Us: What We Can Learn From The Privatizations Of The Internet Backbone Network And The Domain Name System, Jay P. Kesan, Rajiv C. Shah

Washington University Law Review

One goal of this Article is to describe and document the privatization processes for the backbone network and the DNS. We initially assumed the privatization of the Internet consisted of a simple shift from a subsidized network to a competitive market for backbone services. However, we found the privatization process to be quite complex and problematic. Unfortunately, many of these same problems are reoccurring in the current privatization of the DNS. Our study found three categories of problems that occurred during the privatizations of the Internet’s backbone network and the DNS: procedural problems, problems with the management of competition, and …

Fpc Residential Monitoring Project: New Technology Development Radiant Barrier Pilot Project, Florida Solar Energy Center, Danny Parker Jan 2001

Fpc Residential Monitoring Project: New Technology Development Radiant Barrier Pilot Project, Florida Solar Energy Center, Danny Parker

FSEC Energy Research Center®

The FPC Monitoring project has evaluated radiant barrier systems (RBS) as a new potential DSM program. The objective was to examine how the retrofit of attic radiant barriers can be expected to alter FPC residential space conditioning loads. An RBS consists of a layer of aluminum foil fastened to roof decking or roof trusses to block radiant heat transfer between the hot roof surface and the attic below. The radiant barrier can significantly lower summer heat transfer to the attic insulation and to the cooling duct system. Both of these mechanisms have strong potential impacts on cooling energy use as …

Migration And Radicalization: Global Futures, Gabriel Rubin Jan 2001

Migration And Radicalization: Global Futures, Gabriel Rubin

Department of Justice Studies Faculty Scholarship and Creative Works

This book explores the connections between migration and terrorism and extrapolates, with the help of current research and case studies, what the future may hold for both issues. Migration and Radicalization: Global Futures looks at how migrants and terrorists have both been treated as Others outside the body politic, how growing migrant flows borne of a rickety state system cause both natives and migrants to turn violent, and how terrorist radicalization and tensions between natives and migrants can be reduced. As he contemplates potential global futures in the light of migration and radicalization, Gabriel Rubin charts a course between contemporary …

Reaction Mechanism And Kinetics Of Aqueous Solutions Of 2-Amino -2 Methyl-1,3- Propanediol And Carbonyl Sulphide, Erdoğan Alper Jan 2001

Reaction Mechanism And Kinetics Of Aqueous Solutions Of 2-Amino -2 Methyl-1,3- Propanediol And Carbonyl Sulphide, Erdoğan Alper

Turkish Journal of Chemistry

The mechanism and kinetics of the reaction between aqueous solutions of COS and a sterically hindered primary amine, 2-amino-2-methyl-1,3-propanediol (AMPD), were investigated at 288-303 K using a stopped-flow technique. It was found that the reaction order according to power law kinetics was between 1.12 and 1.16 for an amine concentration range of 0.5 to 1.5 kmol m^{-3} . This overall order indicated that the thiocarbamate formation was complex and possibly involved a zwitterion intermediate. However, the experimental results can also be explained in terms of a single-step termolecular reaction mechanism. The kinetic rate parameters for aqueous AMPD solutions were obtained …

Modification Of Poly(Maleic Anhydride-Co-Styrene) With Hydroxyl Containing Compounds, Oya Gali̇oğlu Atici, Ahmet Akar, Roshan Rahimian

Turkish Journal of Chemistry

Soluble and cross-linked poly(maleic anhydride-co-styrene) copolymers were reacted with hydroxyl containing compounds such as salicylic acid, 2-phenyl ethanol, eugenol and paracetamole in acetone or dioxane solution at 50-80°C. The hydrolytic and controlled release behavior of the copolymers containing these compounds in water was studied. The extent of hydrolysis was found to be affected by the type of polymer support as well as time, temperature and the type of supported compound.

Effect Of Acid Treatment On Volumetric Swelling Ratios Of Coals, Nejat Mesci̇, Aki̇f Şenelt, Taner Toğrul, Aral Olcay Jan 2001

Effect Of Acid Treatment On Volumetric Swelling Ratios Of Coals, Nejat Mesci̇, Aki̇f Şenelt, Taner Toğrul, Aral Olcay

Turkish Journal of Chemistry

To remove Ca^{2+} ions, six low rank coals and one coking coal were treated with 0.1 and l.0 N HC1 for 24 h. IR spectra and proximate analysis of the lignites indicated that only slight structural changes had occurred during acid treatment. The swelling ratios of parent and acid-treated coal samples showed that removal of Ca^{2+} resulted in an increase in the swelling ratios. Higher swelling ratios were obtained with acid-washed coal samples. While the highest swelling ratios of the parent lignites were obtained in ethylenediamine, those of acid-treated samples were obtained in pyridine and dimethylformamide.
