Antitrust Intent, Ronald A. Cass, Keith N. Hylton Jan 2001

Antitrust Intent, Ronald A. Cass, Keith N. Hylton

Faculty Scholarship

Many legal rules turn on a party's state of mind or intent with respect to some action or consequence. Legal scholars have long debated the contours of such requirements and the sorts of proof required for them. Intent has been an especially controversial issue in antitrust law. This paper provides a theory of legal standards that explains the role of intent analysis in antitrust and in other areas of the law. We argue that intent requirements, and many other legal rules, can be understood by focusing on the goal of minimizing the expected costs from legal errors. After developing a …

Party As A "Political Safeguard Of Federalism": Martin Van Buren And The Constitutional Theory Of Party Politics, Gerald F. Leonard Jan 2001

Party As A "Political Safeguard Of Federalism": Martin Van Buren And The Constitutional Theory Of Party Politics, Gerald F. Leonard

Faculty Scholarship

In the last decade or so, the Supreme Court has revitalized judicial enforcement of federalism. This development has spurred the partisans of Herbert Wechsler's "political safeguards of federalism" to begin a serious investigation of the ways in which extra-judicial politics can and does substitute for and complement the judicial role in enforcing federalism and the Constitution. Similarly, constitutional scholars have turned in increasing numbers to the question of how even judicially promulgated doctrines of constitutional law turn out to be more derivative of popular politics than vice versa. Necessarily, much of the investigation on both fronts has turned historical and …

Tying Law And Policy: A Decision-Theoretic Approach, Keith N. Hylton, Michael Salinger Jan 2001

Tying Law And Policy: A Decision-Theoretic Approach, Keith N. Hylton, Michael Salinger

Faculty Scholarship

This paper offers a decision theoretic framework for analyzing tying law, and presents a critical assessment of post-Chicago tying theory. The decision theoretic framework takes into account the likelihood of judicial error in the application of rules and the costs of such error. We use the decision theoretic framework to assess the proper legal rules regarding tying and technological integration. Three general themes run throughout much of our analysis. First, the per se rule against tying simply has no economic foundation. Second, while the post-Chicago literature established the theoretical possibility of anticompetitive tying, one must know the frequency of anticompetitive …

Is Virtual Trespass An Apt Analogy?, Maureen A. O'Rourke Jan 2001

Is Virtual Trespass An Apt Analogy?, Maureen A. O'Rourke

Faculty Scholarship

Legal doctrine often evolves both more slowly than the conduct and the technology it is intended to regulate and by analogy. When parties argue that previously unheard-of behavior should generate some legal response, the relevant institution often seeks guidance from past experience. Earlier decisions addressing a specific actual context give some confidence that applying the legal rules from these prior situations to the new fact pattern will produce a sensible result. But principles developed to deal with one set of facts can only imperfectly fit another. This imperfect fit often becomes more evident over time, sometimes raising the question of …

Bankruptcy Law V. Privacy Rights: Which Holds The Trump Card?, Walter W. Miller Jr., Maureen A. O'Rourke Jan 2001

Bankruptcy Law V. Privacy Rights: Which Holds The Trump Card?, Walter W. Miller Jr., Maureen A. O'Rourke

Faculty Scholarship

The Internet's emergence as a retail marketplace has both posed new issues and cast old problems in a new light. As technology, particularly software, has advanced over time, traditional bricks and mortar firms have acquired the capability of tracking and analyzing all sorts of information about their customers, including purchasing patterns and demographic information. For years, firms have been licensing and selling such customer data both in and out of bankruptcy without much fear of legal limitations. In particular, the law has generally not adopted privacy rules that would present a barrier to commerce in personal information.

Property Rights And Competition On The Internet: In Search Of An Appropriate Analogy, Maureen A. O'Rourke Jan 2001

Property Rights And Competition On The Internet: In Search Of An Appropriate Analogy, Maureen A. O'Rourke

Faculty Scholarship

Reasoning by analogy is a time-honored method of legal development. However, recent litigation exposes the weakness of applying legal principles developed in the "bricks and mortar" world by analogy to cyberspace. Using recent court decisions that discuss who may access a website and by what means, this Article illustrates how results can change depending on the analogy the court adopts. The Article argues that rather than searching for analogies, courts and legislators could more profitably devote their energies to understanding how the Internet differs from physical space, evaluating whether those differences call for new legal rules, and considering the conflicting …

Electroproduction Of The Λ(1520) Hyperon, M. Bektasoglu, G. E. Dodge, T. A. Forest, C. E. Hyde-Wright, S. E. Kuhn, R. A. Niyazov, L. B. Weinstein, Et Al., The Clas Collaboration Jan 2001

Electroproduction Of The Λ(1520) Hyperon, M. Bektasoglu, G. E. Dodge, T. A. Forest, C. E. Hyde-Wright, S. E. Kuhn, R. A. Niyazov, L. B. Weinstein, Et Al., The Clas Collaboration

Physics Faculty Publications

The reaction e→pe′K+Λ(1520) with Λ(1520)→p′K− was studied at electron beam energies of 4.05, 4.25, and 4.46 GeV, using the CLAS detector at the Thomas Jefferson National Accelerator Facility. The cos θK+, φK+, Q2, and W dependencies of Λ(1520) electroproduction are presented for the kinematic region 0.9 < Q2 < 2.4 GeV2 and 1.95 < W < 2.65 GeV. Also, the Q2 dependence of the Λ(1520) decay angular distribution is presented for the first time. The cosθK+ angular distributions suggest t-channel diagrams dominate the production process. Fits to the Λ(1520) t-channel helicity frame decay angular distributions indicate the m …

Physics Faculty Publications

New cross sections for the reaction ep → ep η are reported for total center of mass energy W = 1.5-1.86 GeV and invariant momentum transfer Q2 = 0.25-1.5 (GeV/c)2. This large kinematic range allows extraction of important new information about response functions, photocouplings, and etaN coupling strengths of baryon resonances. Newly observed structure at W ~ 1.65 GeV is shown to come from interference between S and P waves and can be interpreted with known resonances. Improved values are derived for the photon coupling amplitude for the S11(1535) resonance.

A Dynamic Programming-Based Approach To Microarray Image Comparison And Registration, Sunil Bosco Rodrigues Jan 2001

A Dynamic Programming-Based Approach To Microarray Image Comparison And Registration, Sunil Bosco Rodrigues

Masters Theses

"Microarray technology is increasingly used as a means of high throughput analysis of human, non-human and plant genomes. Manual methods of array production have inherent imperfections and variations of the quality of output data derived from these arrays. A dynamic programming-based approach is presented to validate the quality of such data prior to insertion into evolving databases in order to assign reliably, genetic aberrations to bio-medical functions. Dynamic programming is used for comparing normal and tumor microarray image pairs and a cost function is developed which gives a value representing the difference between the images. Quality of the image pairs …

Penn And West Philadelphia, Dale Mezzacappa Jan 2001

Penn And West Philadelphia, Dale Mezzacappa

Partnerships/Community

May 13, 1985, was one of the most tragic days in the history of Philadelphia. ln an effort to dislodge the troublesome back-to-nature group MOVE, the police department bombed its row house, inadvertently setting off a fire that engulfed two city blocks, displaced 53 families, and killed 11 people. It's hard to imagine that anything good could come out of an event like this, but it did. The MOVE fire served as the catalyst that propelled the fledgling West Philadelphia Improvement Corps into what is now one of the most far-reaching collaborations between an urban university and the schools in …

Olfactory Behavior In Apoe Knockout Mice, John P. Yost Jan 2001

Olfactory Behavior In Apoe Knockout Mice, John P. Yost

Masters Theses

Apolipoprotein E (apoE), a lipid transporting protein, has been shown to play a vital role in nerve repair and remodeling. Since the olfactory system is in a continuous state of remodeling, the present study tested the hypothesis that apoE is required for normal functioning of the olfactory system. Olfactory function of the wild type (WT) and apoE deficient (apoE KO) mice was assessed by using three standard olfactory tests: 1) the buried food pellet (BFP) test; 2) the odor choice (OC) test; and 3) the odor cued taste avoidance (OCTA) test. The visible food pellet test (VFP) was not used …

Effects Of Gender And Position Of Test Stimuli On Undergraduates ' Spatial Task Performance, James Brenton Curley

Masters Theses

This study predicted that sex differences in performance can occur where the sense of touch serves as vision, and that the position of the test array may significantly affect performance. Sixty-four college undergraduates (32 males and 32 females), with ages ranging from 18-27 (M = 20.06, SD = 1.82) were recruited from the psychology subject pool of Eastern Illinois University for participation. Apparatus consisted of templates with raised line drawings of tilted jars containing water drawn on them. The subjects were blindfolded and instructed to interpret four jar drawings at a time. The task consisted of identifying the jar with …

Effects Of Compression Processing Parameters And Antioxidants On Molecular Degradation Of Biodegradable Poly-L-Lactide (Plla), Thomas J. Hannan Jr.

Masters Theses

The purpose of this research was to find a combination of poly (L-lactic acid), also known as poly-L-lactide or (PLLA) and antioxidants that would, together, produce a product whose degradation rate would be advantageous for use in biodegradable medical implants. Intrinsic viscosity tests were conducted on compression molded samples of PLLA that were molded at various processing parameters in order to find optimal parameters. The optimal processing parameters were found to be time 10 minutes, temperature 220°C, and pressure 1000 psi.

The molecular weight of PLLA sample was taken while pressure, time, and temperature were varied. As pressure increased, no …

Accurate 3-D Morphological Measurement Using A Structured-Light Range Sensor, Robert L. Cromwell, Stuart G. Poss Jan 2001

Accurate 3-D Morphological Measurement Using A Structured-Light Range Sensor, Robert L. Cromwell, Stuart G. Poss

Gulf and Caribbean Research

A single-plane structured light range-sensor was tested to establish its usefulness in acquiring 3-D measurements of fish skulls. Twenty-one distances among 22 landmark points for each of 12 neurocrania of the scorpaenid fish Neomerinthe hemingway were taken with digital calipers, with a video-based 2-D imaging system widely used in systematic studies, and with a single-plane structured-light range sensor of inexpensive and simple design. Measures taken by 3-D sensor are highly correlated with those obtained from caliper measurement (r = 0.9995, P << 0.001 ), with a precision ranging from 0.08–0.43 mm. Like caliper-based measurements, they are less strongly correlated with measurements derived from projected video-imaging. Most skulls were scanned in just over 3 minutes each. Range maps, typically establishing the (x,y,z) coordinates of more than 75,000 points per scan, can be obtained in about 40–50 CPU seconds using software running on multiple platforms. Sensor data taken from different views can be merged to build a more complete 3-D reconstruction. System design, calibration, and use are discussed. By eliminating error due to perspective effects inherent in measuring from projected video images, such sensors hold considerable promise in quantifying biological shape in 3-D for comparative and functional studies.

Law Students' Undergraduate Major: Implications For Law School Academic Support Programs (Asps) Performance, Bryan Adamson, Mark Graham Jan 2001

Law Students' Undergraduate Major: Implications For Law School Academic Support Programs (Asps) Performance, Bryan Adamson, Mark Graham

Faculty Articles

This article addresses whether or not law students' comparative educational backgrounds affect their ability to solve general deductive reasoning problems. This question leads to two broader issues: (1) whether any comparative differences in general reasoning competency affect a student's ability to reason within a legal framework; and (2) whether a student's reasoning competency remains static over three years of law school. This article addresses the first issue. At present, a separate study is being conducted to explore how general reasoning differences may influence a student's ability to reason within a legal framework. This article contends that law school academic support …

Legalize It? -Osp And Peer-To-Peer Network Liability For Online Music Copyright Infringements In The United States And Germany, Christian Nils Jochen Engelhardt

LLM Theses and Essays

It may be useful to explain why a comparative approach was chosen. It is easy and comfortable to get caught up in one's own legal system and not look abroad. It is often difficult enough to understand and apply one’s own laws accurately and the study of a foreign legal system may seem an effort too great. Yet, this reluctance to look beyond the familiar is fatal to legal development and improvement since entirely new ideas are rare in the field of law and the main source of change and new approaches is borrowing from another legal system. If one …

Children's Interests And Information Disclosure: Who Provided The Egg And Sperm? Or Mommy, Where ( And Whom) Do I Come From?, Naomi R. Cahn Jan 2001

Children's Interests And Information Disclosure: Who Provided The Egg And Sperm? Or Mommy, Where ( And Whom) Do I Come From?, Naomi R. Cahn

GW Law Faculty Publications & Other Works

This essay focuses on the relationships between children, unknown donors, and biological parents. It argues that children deserve access to information about their biological pasts both when the donor's identity is known to the biological parent and when it is unknown. Once an adoption has been finalized or once known gamete donors have agreed not to assert parental rights, the donors should be unable to assert parental rights. But the finality of adoption or gamete provision (which includes eggs, sperm, or embryos) should not prevent the disclosure of information about the identity of biological parents and gamete providers to a …

An Explanation And Illustration Of The Importance Of Infinite Series In Mathematics, Allison Walker Jan 2001

An Explanation And Illustration Of The Importance Of Infinite Series In Mathematics, Allison Walker

Honors Theses

The purpose of this work is to first, explore exactly what an infinite series is, and second, to explain the importance of infinite series is, and second, to explain the importance of infinite sries in the everyday calculations of mathematicians, scientists, and engineers. In investigating this topic, I researched the development of infinite sries as well as how Taylor and Mclaurin series are derived. I then considered many different problems containing intractable functions. In the consideration of these problems I was able to explore the usefulness of infinite series in solving these intractable problems. The conclusion of this research was …
