Most of the popular and scholarly discussions of Microsoft have focused on whether the defendant violated the law and, if so, whether the remedial order was appropriate. Never far from the surface in all of these discussions, however, has been the prospect of private antitrust suits that would inevitably follow a government victory. Indeed, numerous consumer class actions were filed against Microsoft in the wake of the District Court's issuance of its findings of fact. Should the District Court's decisions on liability stand, Microsoft can expect to face other suits by a variety of actors, including competitors, original equipment manufacturers …

Agricultural Experiment Station Circulars (1920-1915)

This publication reports the performance of entries in the2001 South Dakota corn hybrid performance trials and includes both conventional (non-Roundup-Ready) and Roundup-Ready hybrids. Bushels per acre (bu/a) are given for both 2000-01 and 2001 grain yields; and test weight, moisture percentages of shelled corn at harvest, and stalk lodge percentages are presented for 2001. These performance trials are conducted by the South Dakota Crop Performance Testing (CPT) program at South Dakota State University.

For more than half a century, a desire for "diverse and antagonistic sources" has been a fundamental principle of communications policy in the United States. Many question, however, whether current FCC policies intended to foster diversity of news and views in the content of the mass media actually do so. Nowhere is this issue raised more starkly than with respect to the Commission's controversial 1975 rule that prohibited the common ownership of a daily newspaper and a broadcast station in the same market. Colorimetric Tolerances Of Various Digital Image Displays, Jason Gibson

Theses

Visual experiments on four displays (two LCD, one CRT and hardcopy) were conducted to determine colorimetric tolerances of images systematically altered via three different transfer curves. The curves used were: Sigmoidal compression in L*, linear reduction in C*, and additive rotations in hab. More than 30 observers judged the detectability of these alterations on three pictorial images for each display. Standard probit analysis was then used to determine the detection thresholds for the alterations. It was found that the detection thresholds on LCD's were similar or lower than for the CRT's in this type of experiment. Summarizing pixel-by-pixel image differences …

Designed to promote the prompt deployment of a seamless emergency services infrastructure to meet the nation's safety needs, the 911 Act not only instructs the FCC to assign the abbreviated dialing code 911 for use as the universal emergency telephone number, but also directs the Commission to establish appropriate transition periods for compliance in areas without 911 service. Furthermore, the 911 Act supports individual states' efforts to develop comprehensive emergency communications. Although improving the 911 system and saving lives by developing an end-to-end emergency communications network are commendable goals, this Note argues that the anemic 911 Act is an important …

On July 20, 2000, an interesting mix of federal legislators proposed legislation that would affect monitoring of employee communications and computer usage in the workplace. Had it passed, NEMA would have required employers to notify their employees if they wished to conduct surveillance of their employees' electronic mail ("e-mail") or other electronic communications. Employer groups succeeded in convincing the Judiciary Committee to pull the bill from further consideration, citing a potential increase in litigation and more work for human resources professionals. This study examined the implementation of the least restrictive environment (LRE) provision of the Individuals with Disabilities Education Act (IDEA) for secondary students with learning disabilities on Guam. The research questions for the study addressed the following areas: (a) perceptions of the definition of LRE, (b) factors influencing the implementation of LRE, and (c) determination of LRE in relation to the national trends and literature. This research utilized the qualitative method of collecting and analyzing data that included interviews and review of written documents. It's well known that graduate William B. Cook's generosity provided the Law School with its trademark Gothic Law Quadrangle. It is less universally known that Cook endowed the Law School with a trust to support faculty research, and had a strong interest in the nature of that research. He chose to call the library building "Legal Research" and to inscribe above the main entrance "Learned and cultured lawyers are safeguards of the republic." Facilitation And Competition On Gradients In Alpine Plant Communities, Philippe Choler, Richard Michalet, Ragan M. Callaway

We conducted a neighbor removal experiment in natural alpine plant communities of the southwestern Alps to test for the relative importance of competitive and facilitative interactions along elevational and topographical gradients. The experimental sites were chosen to encompass most of the floristic diversity observed along gradients of elevation and topography, which are the two main ecological gradients associated with alpine plant communities in the western Alps. The effects of neighbor removal on the survival, aboveground biomass, and reproduction of five target species were tested at each of six experimental sites.
