Richardson V. Reno: What Is The Proper Application Of The Illegal Immigration Reform And Immigrant Responsibility Act To Criminal Aliens? Jan 2001

Richardson V. Reno: What Is The Proper Application Of The Illegal Immigration Reform And Immigrant Responsibility Act To Criminal Aliens?

San Diego Law Review

This Casenote questions the Richardson court's holding. Specifically, this Casenote argues that precluding all judicial review, including habeas corpus review, for criminal aliens held removable by the INS violates the Suspension Clause of the United States Constitution. Further, to interpret IIRIRA as eliminating the availability of habeas corpus relief in these circumstances calls into question the constitutionality of the statute due to constitutional limits on Congress's power to control the jurisdiction of Article III courts.

The Dynamics Of Cultural Production In Ireland: Economic Strategy, Digital Technology And Public Policy Making, Ellen Hazelkorn Jan 2001

The Dynamics Of Cultural Production In Ireland: Economic Strategy, Digital Technology And Public Policy Making, Ellen Hazelkorn

Books/Book chapters

The last ten years has seen Ireland, now dubbed the ‘Celtic tiger’ of Europe, achieve an economic about-turn. A key element of this growth has been new technology. Irish policy makers have focused increasingly on a growth strategy led by the information and communications technologies (ICTs) as a means to leapfrog historic and geographic limitations of the earlier industrial revolution and ‘jump-start’ Irish economic growth. Taking advantage of rapid social structural changes, relatively high public investment/endorsement of education and advanced skills, and a ‘natural’ reservoir of creativity, that strategy has sought to market Ireland as an ‘information gateway’, an English-speaking …

The Urban Response To The Rural Land Reform During The Chinese Civil War: 1945-1949, Elizabeth Grad '01 Jan 2001

The Urban Response To The Rural Land Reform During The Chinese Civil War: 1945-1949, Elizabeth Grad '01

Honors Projects, History

China's internal condition immediately following the end of Japanese occupation was complicated and precarious. The conflicting interests of the Kuomintang and the Communists were pushing the nation into civil war and pressure from the United States only hastened the collapse of an already weak: internal structure. The Japanese occupation of China during the war had significant implications and affected the political fortunes of the Kuomintang and the Communists in diverse ways.

Initially, the War of Resistance against Japan promoted nationalism and Chiang Kai-shek and the Chinese Communists united for the good of the nation. This unity, however, was short lived …

Listening For A Change: The Courts And Oral Tradition, John Borrows

Osgoode Hall Law Journal

Aboriginal oral history is a valuable source of information about a people's past. It can constitute important evidence as proof of prior events, and/or it can shed light on meanings groups give to their past. Despite its value, however, oral tradition presents particular challenges of admissibility and interpretation because of its unique source and transmission. This article outlines and discuses these challenges and suggests various approaches to better understand the insights contained within aboriginal history.

are extremely burdensome to grade. The purpose of this Article is to call attention to a variety of alternatives to this traditional format that are more accurate and less burdensome than traditional essay exams.2 Increasing accuracy makes it

Decreasing the burden of assessment of student learning allows for faster feedback, which is more effective.' Faster assessment also makes possible frequent assessment, and frequent assessment provides students with the information they need to improve, promoting …

The Dillow’S Ridge Site And The Production Of Mill Creek Chert Tools, Brian M. Butler, Charles R. Cobb Jan 2001

The Dillow’S Ridge Site And The Production Of Mill Creek Chert Tools, Brian M. Butler, Charles R. Cobb

Faculty Publications

The Dillow's Ridge site (11 U635) is a small Mississippian village situated on an unplowed hilltop near the largest known Mill Creek chert quarry in Union County, Illinois. The site was both a permanent residential settlement and a major workshop where Mill Creek chert tools were produced for nonlocal use. Radiocarbon dates document the occupation from the late 1200s A.D. to A.D. 1450 or 1500. The production debris and rejects indicate that the major “export" products were hoes and Ramey knives. Although the quantity of lithic debris on the site is very impressive, estimates of annual production of large biface …

Typographic Legibility For Retinitis Pigmentosa Readers, Carla Benedetti Jan 2001

Typographic Legibility For Retinitis Pigmentosa Readers, Carla Benedetti

Masters

Although numerous papers have been written on the subject of legibility, there appears to be a lack of research into the relationship between printed matter and visual impairment in this context. The research aim of this thesis is to conduct a comprehensive study on the reading performance of those suffering from a particular impairment, namely Retinitis Pigmentosa and to identify typographic considerations that would improve this performance. The work confirms the importance of specially designed material and the need for specific guidelines to ensure optimum legibility for particular eye deficiencies.

Historical Architectural Survey Report For Proposed Improvements, Susie Van Kirk

Susie Van Kirk Papers

Nineteen properties (22 buildings) within the Area of Potential Effect (APE) were evaluated for significance to comply with the California Environmental Quality Act (CEQA) and Section 106 of the National Historic Preservation Act. surrounding whether the decision to permit or prohibit physician- assisted suicide should be made by Congress or by the states.

Punishing The Causer As The Principal: Mens Rea And The Interstate Transportation Element Of The National Stolen Property Act Jan 2001

Punishing The Causer As The Principal: Mens Rea And The Interstate Transportation Element Of The National Stolen Property Act

San Diego Law Review

Transporting goods worth over five thousand dollars, which are known to be stolen, in interstate commerce is a violation of the Federal National Stolen Property Act (NSPA).' The congressional intent behind the NSPA is to aid the states in punishing those who commit theft, fraud, or counterfeiting in violation of state law, but elude punishment by utilizing the channels of interstate commerce.2 Congress included an interstate transportation element in this statute, which is otherwise parallel to a typical state stolen property statute, merely to supply a constitutional basis for the exertion of federal power.' Thus, Congress enacted the NSPA as …

Smart Growth And Other Infirmities Of Land Use Controls, Bernard H. Siegan Jan 2001

Smart Growth And Other Infirmities Of Land Use Controls, Bernard H. Siegan

San Diego Law Review

The great lesson of our time is that the forces of production, conservation, and creativity exist principally in the marketplace and not in government. To be sure, private entrepreneurs act largely in their own self-interest, but probably no more so than government officials, and their endeavors in the economic area are much more beneficial to the public.

Multidisciplinary Practice And The Future Of The Legal Profession: Considering A Role For Independent Directors, John H. Matheson, Peter D. Favorite Jan 2001

Multidisciplinary Practice And The Future Of The Legal Profession: Considering A Role For Independent Directors, John H. Matheson, Peter D. Favorite

Articles

Edward Bartoli, a Chicago attorney, was recently suspended by the Illinois Supreme Court for aiding nonlawyers in the unauthorized practice of law. Bartoli's argument? He claimed that he was merely running a multidisciplinary practice ("MDP"). The regulations governing such activity would soon change, claimed Bartoli, and thus he was only, "ahead of his time." Because of the apparent inevitability of MDP-reform, attorneys like Bartoli are contemplating the creation of, and participation in, multidisciplinary practices throughout the United States. State regulatory bodies will be faced with the difficult determination of whether sanctions are necessary in some cases and whether sanctions are …

The Trusteeship Of Legal Rulemaking, Edward S. Adams, Richard A. Saliterman Jan 2001

The Trusteeship Of Legal Rulemaking, Edward S. Adams, Richard A. Saliterman

Articles

Professor Robert D. Putnam's work is, in many respects, the contemporary companion to Democracy in America.' It comprehensively surveys and tests common presumptions held about our democracy with apparently very reliable quantitative data. Until recently, a work of this depth and breadth has been unavailable. Putnam sets forth a well supported thesis suggesting that even though American financial capital may be at a high, its "social capital" has perhaps reached a record low, or at least a level similar to the social, economic, and legal bottleneck of a century ago.' His use of empirical and combined data, however, probes into …

How To Plot Love On An Indifference Curve, Brian H. Bix

Articles

This review of June Carbone's book, "From Partners to Parents: The Second Revolution in Family Law" (Columbia U. Pr., 2000), considers not only the title theme-- how societal norms regarding the family and legal regulation of the family have changed their focus from the way adult partners treat one another to parents' rights and duties regarding their children-- but also additional themes raised by the book's discussions. In particular, the Review emphasizes the way in which Family Law writers have resisted or adapted economic approaches to law, and the problem of legal reform in Family Law at a time of …
