Unequal Justice: Arabs In America And United States Antiterrorism Legislation, Michael J. Whidden Jan 2001

Unequal Justice: Arabs In America And United States Antiterrorism Legislation, Michael J. Whidden

Fordham Law Review

Racial discrimination in any form and in any degree has no justifiable part whatever in our democrati way of life. It is unattractive in any setting but it is utterly revolting among a free people who have embraced the principles set forth in the Constitution of the united States. All residents of this nation are primarily and necessarily a part of the new and distinct civilization of the United States. They must accordingly be treated at all times as the heirs of the American experiment and as entitled to all the rights and freedoms guaranteed by the Constitution.

Databases And Portals For Knowledge Management, Soraya Abad-Mota Jan 2001

Databases And Portals For Knowledge Management, Soraya Abad-Mota

University Libraries & Learning Sciences Faculty and Staff Publications

The current availability, quantity and variability of Information Technology (IT) is overwhelming. Internet and the powerful set of tools loosely called "the web" dramatically changed the way people use this technology. We can take advantage of these new ways to try to capture an organization\'s knowledge and manage it effectively. Two key elements of IT that serve this purpose are databases and portals. In this chapter we explore the database and portal technologies, their interaction, and their potential for knowledge management. We also discuss briefly how databases and portals provide a good development opportunity for Latin America.

An Evaluation Of Fás's Excellence Through People Award, Antoinette Hogan Jan 2001

An Evaluation Of Fás's Excellence Through People Award, Antoinette Hogan

Theses

In 1997 FAS introduced the Excellence Through People Award, a human resource based quality standard. The main objective was to increase the level, relevance and quality of training being conducted in Ireland. It had become apparent that it was no longer sufficient to offer customers low cost products to try to gain advantage over competitors. Customers were becoming more sophisticated, with more disposable income. Also, technological developments were constantly shortening product lifecycles. Thus, what companies required was for their employees to know in real time what their customers value and to know how to provide it for them. It has …

Runoff Modeling Of The Saugatucket River: An Application Of Hec-Hms Software, Quoc An Nguyen Jan 2001

Runoff Modeling Of The Saugatucket River: An Application Of Hec-Hms Software, Quoc An Nguyen

Open Access Master's Theses

The U.S. Army Corps of Engineers had revised its HEC-1 software. The new version is HEC-HMS (Hydrological Modeling System). This versatile software retains all computational and analysis capabilities of the old version with additional features, which includes CAD (Computer Aided Design) like modeling techniques (icon and dialogue box driven). The main objective of this project is to model flow response from a rainfall event in the Saugatucket River. Through model selection process, HEC-HMS was selected as the appropriate software for implementation.

The modeling technique used here is different from standard professional practice in the model calibration and validation. This project …

Free Speech For Judges: A Commentary On Lubet Et Al. V. Posner, Monroe H. Freedman Jan 2001

Free Speech For Judges: A Commentary On Lubet Et Al. V. Posner, Monroe H. Freedman

Hofstra Law Faculty Scholarship

Criticism of unethical judicial conduct has been leveled against Richard Posner, the widely respected former chief judge of the United States Court of Appeals for the Seventh Circuit. The critics are two widely respected legal scholars, Professors Steven Lubet and Ronald Dworkin. Judge Posner, in turn, has vigorously defended himself. Given the intellectual stature of the antagonists, it is not surprising that both sides are right. In my view, however, Judge Posner is more right.

Making A Federal Case Out Of It: Section 1981 And At-Will Employment, Joanna L. Grossman Jan 2001

Making A Federal Case Out Of It: Section 1981 And At-Will Employment, Joanna L. Grossman

Hofstra Law Faculty Scholarship

This Article is divided into four parts. Part I describes the history and origins of § 1981, its bloodletting by the Supreme Court, and its ultimate restoration and reinvigoration by Congress. Part II first describes the federal appellate opinions addressing the applicability of § 1981 to at-will employment. It then examines the source of law question: whether state law, federal law, or some combination ought to dictate the definition of “contract” in § 1981. It concludes that federal common law, which may draw on well-established state law principles, should control. Part III examines the possible interpretations of “contract” as used …

Mediation And Adr: Insights From The Jewish Tradition, Robert A. Baruch Bush Jan 2001

Mediation And Adr: Insights From The Jewish Tradition, Robert A. Baruch Bush

Hofstra Law Faculty Scholarship

Two initial points will provide some context for these remarks. First, my primary professional involvement has been not in legal practice as such, but in alternative dispute resolution ("ADR") and mediation, which has been my field of concentration over the last twenty-five years, both before and after coming to Hofstra Law School. Therefore, my comments will focus on how my view of this field has been affected by my religious tradition.

Second, the perspective reflected in these comments grows out of my own particular experience in relation to the Jewish tradition. Specifically, my involvement in Jewish traditional life and thought …

Richardson V. Reno: What Is The Proper Application Of The Illegal Immigration Reform And Immigrant Responsibility Act To Criminal Aliens? Jan 2001

Richardson V. Reno: What Is The Proper Application Of The Illegal Immigration Reform And Immigrant Responsibility Act To Criminal Aliens?

San Diego Law Review

This Casenote questions the Richardson court's holding. Specifically, this Casenote argues that precluding all judicial review, including habeas corpus review, for criminal aliens held removable by the INS violates the Suspension Clause of the United States Constitution. Further, to interpret IIRIRA as eliminating the availability of habeas corpus relief in these circumstances calls into question the constitutionality of the statute due to constitutional limits on Congress's power to control the jurisdiction of Article III courts.

The Dynamics Of Cultural Production In Ireland: Economic Strategy, Digital Technology And Public Policy Making, Ellen Hazelkorn Jan 2001

The Dynamics Of Cultural Production In Ireland: Economic Strategy, Digital Technology And Public Policy Making, Ellen Hazelkorn

Books/Book chapters

The last ten years has seen Ireland, now dubbed the ‘Celtic tiger’ of Europe, achieve an economic about-turn. A key element of this growth has been new technology. Irish policy makers have focused increasingly on a growth strategy led by the information and communications technologies (ICTs) as a means to leapfrog historic and geographic limitations of the earlier industrial revolution and ‘jump-start’ Irish economic growth. Taking advantage of rapid social structural changes, relatively high public investment/endorsement of education and advanced skills, and a ‘natural’ reservoir of creativity, that strategy has sought to market Ireland as an ‘information gateway’, an English-speaking …

The Urban Response To The Rural Land Reform During The Chinese Civil War: 1945-1949, Elizabeth Grad '01 Jan 2001

The Urban Response To The Rural Land Reform During The Chinese Civil War: 1945-1949, Elizabeth Grad '01

Honors Projects, History

China's internal condition immediately following the end of Japanese occupation was complicated and precarious. The conflicting interests of the Kuomintang and the Communists were pushing the nation into civil war and pressure from the United States only hastened the collapse of an already weak: internal structure. The Japanese occupation of China during the war had significant implications and affected the political fortunes of the Kuomintang and the Communists in diverse ways.

Initially, the War of Resistance against Japan promoted nationalism and Chiang Kai-shek and the Chinese Communists united for the good of the nation. This unity, however, was short lived …

Listening For A Change: The Courts And Oral Tradition, John Borrows Jan 2001

Listening For A Change: The Courts And Oral Tradition, John Borrows

Osgoode Hall Law Journal

Aboriginal oral history is a valuable source of information about a people's past. It can constitute important evidence as proof of prior events, and/or it can shed light on meanings groups give to their past. Despite its value, however, oral tradition presents particular challenges of admissibility and interpretation because of its unique source and transmission. This article outlines and discuses these challenges and suggests various approaches to better understand the insights contained within aboriginal history.
