What We Know About Minnesota's First Endangered Fish Species: The Topeka Shiner, Jay T. Hatch

The Topeka shiner, Notropis topeka, is the first of Minnesota's native ichthyofauna to be classified as federally endangered. The species is in serious decline in Kansas, Missouri, Nebraska and Iowa but is far more common in Minnesota than once was thought. At present, it is known from 89 sites in 17 streams of the Missouri River Drainage. Topeka shiners are multiple-clutch spawning nest associates of sunfishes and reproduce over an eight- to ten-week period between late May and early August. Mean clutch size is 261 to 284. In general, women report more severe levels of pain, more frequent incidences of pain, and pain of longer duration than men, but are nonetheless treated for pain less aggressively. The authors investigate this paradox from two perspectives: Do men and women in fact experience pain differently - whether biologically, cognitively, and/or emotionally? And regardless of the answer, what accounts for the differences in the pain treatment they receive, and what can we do to correct this situation?

This Article explores how, in assessing the motivation of those who kill because they believe they were directed by God to do so, society distinguishes religious-based decisions from delusional decisions that result from mental disorder. Part II discusses how religion is defined in our society, and Part III considers the extent to which religious conduct, as opposed to religious belief, is protected from governmental intrusion.

This Comment argues that, in most cases, states are constitutionally bound to give full faith and credit to laws and judgments rendered in

sister states, including those that result in changes of the sex designated on birth certificates. The sex designated on the birth certificate controls gender identity for all legal purposes of the individual named therein. Therefore, unless a forum state demonstrates that allowing transsexuals and intersexuals to marry in their legal gender is contrary to an important state interest, that state must recognize “opposite-sex” marriages involving transsexuals and intersexuals.

These computations could occur between mutually untrusted parties, or even between competitors. Background:

During routine follow-up of patients treated with a three-piece stainless-steel modular femoral nail, osteolysis and periosteal reaction around the modular junctions of some of the nails were noted on radiographs. The purpose of this study was to evaluate the prevalence, etiology, and clinical relevance of these radiographic findings.

Methods:

Forty-four femoral fractures or nonunions in forty-two patients were treated with a modular stainless-steel femoral intramedullary nail. Seventeen nails were excluded, leaving twenty-seven intramedullary nails in twenty-seven patients for this study. All patients had had a femoral diaphyseal fracture; nineteen had had an acute fracture and eight, a nonunion. These …

Water color has multiple effects on freshwater lakes, changing the vertical profiles of light, temperature, and oxygen. Therefore, increased water color should reduce planktivory by visually guided fish, but invertebrate predators such as Chaoborus should become more important. Since fish prefer larger prey but Chaoborus can only ingest smaller zooplankton, increased water color should cause a shift from small to large zooplankton species. To test this hypothesis, I analyzed two lake data sets to examine how water color affects the relative importance of fish and Chaoborus as planktivores. The beta-blockers comprise a group of drugs that are mostly used to treat cardiovascular disorders such as hypertension, cardiac arrhythmia, or ischemic heart disease. Each of these drugs possesses at least one chiral center, and an inherent high degree of enantioselectivity in binding to the b-adrenergic receptor. For beta-blockers with a single chiral center, the (-) enantiomer possesses much greater affinity for binding to the b-adrenergic receptors than antipode. The enantiomers of some of these drugs possess other effects, such as antagonism at alpha-adrenergic receptors or Class III antiarrhythmic activity. However, these effects generally display a lower level of stereoselectivity …

"Faces ofthe Holocaust" is a unique series of fifteen videotapes created expressly as a classroom resource and curriculum supplement. I began to record these one-of-a-kind stories in 1985 with Wright State University Television Center Initially, there were nine interviews over a three year period, which included painstaking editing. The second part of the series was filmed in 1995, the fiftieth year of liberation, with interviews of five more liberators and one more survivor. The series was directed by K. Roland Knight of Wright State University Television Center. Dr. Thomas Martin and Challon Roberts assisted me in the editing process.

Reflection on the prospect of varied, individualized possibilities for the meaning of marriage suggests, that in order to answer the question "why marriage?" we must first consider "what marriage?" or more succinctly, "what is marriage?" Questioning what marriage actually is calls attention to the institution's individualized and malleable nature. By contrast, a focus on "why marriage" highlights the societal function and rationale for the institution. I will discuss each question-the "what" as well as the "why" of marriage.

"Closet Case": Boy Scouts Of America V. Dale And The Reinforcement Of Gay, Lesbian, Bisexual, And Transgender Invisibility, Darren L. Hutchinson

This Article argues that the Supreme Courts decision in Boy Scouts of America v. Dale misapplies and ignores controlling First Amendment precedent and incorrectly dermes "sexual identity" as a clinical or biological imposition that exists apart from expression or speech. This Article provides a doctrinal alternative to Dale that would protect vital interests in both equality and liberty and that would not condition, as does Dale, sexual "equality" upon the silencing of gay, lesbian, bisexual, and transgender individuals.
