The application of the constitutional free expression guarantee to the activities of the organized bar is one of the most important unexplored areas of legal ethics. In this essay I will consider in particular the question of whether an applicant may be denied admission to the bar for involvement with hateful or discriminatory activities. This question reveals the tension between the first amendment principle, established after the agonizing struggles of the McCarthy era, that no one may be denied membership in the bar because of his or her beliefs alone, and the plenary authority of bar associations to make predictive …

BACKGROUND: An increased rate of pseudarthrosis has been documented following posterolateral lumbar spine grafting in patients who smoke. This same relationship has been assumed for anterior cervical interbody grafting, but to our knowledge it has never been proven. This study compared the long-term radiographic and clinical results of smokers and nonsmokers who had undergone arthrodesis with autogenous bone graft following multi-level anterior cervical decompression for the treatment of cervical radiculopathy or myelopathy, or both.

METHODS: One hundred and ninety patients were followed clinically and radiographically for at least two years (range, two to fifteen years). Fifty-nine of the patients had …

The determination of anions, cations and trace metals in drinking water is becoming increasingly important due to health problems associated with these inorganic and organic contaminants. In the Houston metropolitan area, our basic sources of drinking water are the municipal water and commercial bottled water. Most often, the decision to use either or both of these water sources stems from the fear that the "water in the Houston area is contaminated." Play Behavior In Infant Western Lowland Gorillas (Gorilla Gorilla Gorilla) At The Lincoln Park Zoo, Suma Mallavarapu

An ethological investigation was made on a group of western lowland gorillas (Gorilla gorilla gorilla) at the Lincoln Park Zoo, Chicago. Focal animal sampling and all-occurrences sampling were used to collect data during the months of June and July 2000. Qualitative observations were made of the general behavioral patterns of the group, which included feeding and drinking behavior, resting, sleeping, nest construction, grooming behavior, group behavior, dominance hierarchies, zoo-keeper and public oriented behavior, and behavior in novel stimuli situations. Except for female dominance hierarchies, all behavioral patterns were found to be similar to those reported for feral gorillas. …

Epigean (surface) and hypogean (cave) habitats differ significantly, thereby influencing organisms that inhabit these environments in varying ways. As organisms move from surface to cave environments, they. adapt to cave conditions: constant darkness, relatively constant temperatures year-round, low food availability, and high humidity. Fish adjusted to cave life often experience reductions in pigmentation, eye size, and metabolic rate. Metabolism is, in general, influenced by temperature, seasonal• • changes, photoperiod, and food availability. The objective of this research was to understand the alteration of metabolic rate in laboratory acclimated Cottus carolinae (banded sculpin) in response to photoperiod and food availability.

Child abuse is commonly regarded as a child welfare problem, and a considerable amount of information has been amassed from this perspective. When a child is assaulted, however, it is not only a child welfare problem, it is a crime, and yet there is a lack of law enforcement data available for researchers to analyze. Use of the National Incident-Based Reporting System (NIBRS), which collects detailed data about crime and its victims, should help fill this gap. Heliconia monteverdensis is a species of Heliconiaceae that is endemic to the Monteverde cloud forestof Costa Rica. A limited amount of research has been conducted concerning H. monteverdensis, therefore, little is known about its life history. In this study, simple observations are reported with regards to its distribution, physical characteristics and interactions with its community. The effect of location and elevation on the fitness, (the ability of the plant to survive and reproduce), of H. monteverdensis was also studied. Many plants that do not offer rewards for pollination are involved in a floral mimicry. Mimic flowers copy visual cues from unrelated model species that offer rewards and rely on the chance visitation by confused pollinators. Epidendrum radicans is a mimic plant that strongly resembles two plants that provide rewards: Asclepias curassavica (Asclepiadaceae) and Lantana camara (Verbenaceae). This study examines how spatial distributions affect the proportion of pollinia removed (PPR) for the non-rewarding mimic Epidendrum radicans. Medication compliance/noncompliance was examined in context of: severity of symptoms; medical side effects; medication education; perceived stigma; and effects on family/social support system. A null hypothesis was formulated for each correlate, stating that those patients who reported a high level of an independent variable (IV) would not be any more likely to discontinue their medication than patients who reported a low level of an IV. To obtain data, a medical usage questionnaire and a depression, assessment (OQ™-45.2) were used. Statistical significance was not obtained for any of the hypothesized relationships but trends were consistent with the established literature. The implication …

This study was broken into two sections, the first being a comprehensive meta-analysis describing a profile of the juvenile female who sexually offends. The second section was the collection of data of juvenile females who sexually offend in the State of Utah. After the data were collected, a profile was described and compared to that found in the Review of the Literature and a typology was presented.

Ecosystemic legacies were shown to be passed down from one generation to the next. The juveniles were found to come from highly chaotic homes, and subject to maltreatment. Diagnostically, they show symptoms of …

This thesis reports the results of a project which identified differences in characteristics of Grand Staircase-Escalante National Monument user groups as they related to their perceptions of how they experience the Monument as recreationists. It explored opinions of four groups: hikers vs. hunters and pre-designation users vs. post-designation users. Responses of these groups were compared for attribution of perceived resource damage, feelings of crowding, acceptability of management action, and importance of identified monument values to their visit. In this study I argue that a holistic approach is better than an individualistic approach for interpreting the United States Endangered Species Act (ESA). I propose that the use of a holistic ethical framework, based on fundamental environmental philosophy, is better in that it more effectively fulfills the ESA's goals of species and ecosystem conservation. Holistic ethics is based on concern for a community as a whole, while individualistic ethics is based on concern for the individual. A holistic approach, I argue, is more beneficial to nature than is an individualistic approach or other non-holistic approaches. I set up basic …

The purpose of this study was to observe and analyze the factors that lead to a child's increase in responding to a previously neutral stimulus after observing another child's behavior and consequences in the same setting. The effects of five video presentations on rate of button-pressing responses were observed across four students. Rates of button-pressing behavior on an FR3 schedule of reinforcement were collected for each student using a computer and a metal apparatus with two flat push buttons. Internalizing disorders cause serious psychological problems for many adolescents. The effects can be both debilitating and long lasting. However, assessment of internalizing disorders has been plagued by limited measurement strategies. Historically, individual measures were developed to assess the narrow-band symptoms that are subsumed under the broad construct of internalizing disorders (e.g., depression, anxiety, somatic complaints, and social withdrawal). Recently, the Internalizing Symptom Scale for Adolescents has been created. Chronic back pain is a serious problem in the U.S. for which about 10% of back pain sufferers will undergo elective surgery. Unfortunately, back surgery is not successful in alleviating back pain in a substantial number of surgery patients. Various psychological and psychosocial variables have a demonstrated relationship to back surgery outcome. The most widely used personality test used to predict back surgery outcome is the Minnesota Multiphasic Personality Inventory (MMPI). Gender differences in psychopathology have long been of interest in the fields of clinical, developmental, and personality psychology. Lewis proposed two models to explain the emergence of the development of gender differences in depression and paranoia. Lewis stated that gender differences in depression and paranoia can be traced to corresponding gender differences in cognitive style, guilt-proneness, shame-proneness, and the use of specific defense mechanisms. Although research evidence has validated certain components of these two models, neither model has ever been tested in its entirety. Languages and species both evolve by a process of repeated divergences, which can be described with the branching of a phylogenetic tree or phylogeny. Taking advantage of this fact, it is possible to study language change using computational tree building techniques developed for evolutionary biology. Mathematical approaches to the construction of phylogenies fall into two major categories: character based and distance based methods. Character based methods were used in prior work in the application of phylogenetic methods to the Indo-European family of languages by researchers at the University of Pennsylvania. The purpose of this study was to compare thirty students' profiles under the Psychological Processing Checklist, a tool that attempts to locate the observable, measurable behaviors evident in a student's classroom performance that might be indicative of an emergent processing deficiency. Two individual instructors rated the same students, all chosen from two fifth grade classrooms in a Southern New Jersey public school, and the results were compared using correlation data.
