Legal Skills For A Transforming Profession, Gary A. Munneke Jan 2001

Legal Skills For A Transforming Profession, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

The legal profession is undergoing dramatic changes that will drive a reformation in legal education. Legal educators must anticipate these changes to effectively prepare students for the practice of law in the twenty-first century. In order to be proficient practitioners, these students will require an expanded set of professional skills. Although the current legal skills paradigm was articulated by the American Bar Association MacCrate Task Force in 1991, it is time to reexamine legal skills with an eye toward preparing students to practice law in the new millennium. In Section II, this article examines trends in modern society and the …

Tracking In An Era Of Standards: Low-Expectation Classes Meet High-Expectation Laws, Kevin G. Welner Jan 2001

Tracking In An Era Of Standards: Low-Expectation Classes Meet High-Expectation Laws, Kevin G. Welner

UC Law Constitutional Quarterly

This article explores racial resegregation of students through the practice of tracking - the grouping of students into separate classrooms pursuant to perceived academic ability. It places tracking within its larger historical context, as a means for white parents to feel secure about their children's education, and presents a review of scholarly literature concerning the characteristics and application tracking. The main body of the article then sets forth recent analyses of data from two school districts, investigating the harmful and segregative effects of tracking. The article ends by examining aspects of tracking that leave it susceptible to legal challenge, considering …

Revisiting Social Theory In Art Education: Where Have We Been? Where Are We Today? Where Are We Going? Where Could We Go?, Jan Jagodzinski Jan 2001

Revisiting Social Theory In Art Education: Where Have We Been? Where Are We Today? Where Are We Going? Where Could We Go?, Jan Jagodzinski

Journal of Social Theory in Art Education

The title's spin-off from Gauguin's self-reflective statement: D'où vernons-nouse? Que sommes-raus? Où allons-nous? painted towards the closing of the 19th century when colonialist expansion and Imperialism were at their heights, seems to be an appropriate allusion as this year's 21st Social Caucus journal inaugurates the beginning of a new millennium. The irony of the title should be apparent, as should the fortuitousness of the volume's number. The epic proportions of the questions (and the painting) compressed into the bit size of an editorial seems laughable. Yet the questions are worth deliberating in the context of the essays that have been …

On Oysters And Other Life Lessons: Art Teacher’S Perceptions Of Social Class And Schooling, Kimberly Cosier

Journal of Social Theory in Art Education

I had to be taught that the world was not my oyster. As a child I was quite sure that I was destined for a wondrous life of adventure and distinction. I was the first born in my family, the first child, the first grandchild, the first niece; everyone was crazy about me. My mother swears that on the day I was born my father floated across the room, so filled with joy and pride that his feet literally glided above the floor as he held me in his arms for the first time. I realize now that this is …

Taking Globalization Seriously: Towards General Jurisprudence (Book Review Of Globalization And Legal Theory By William Twining), Doron M. Kalir Jan 2001

Taking Globalization Seriously: Towards General Jurisprudence (Book Review Of Globalization And Legal Theory By William Twining), Doron M. Kalir

Law Faculty Articles and Essays

Part II provides an account of the jurisprudence of Globalization and Legal Theory. Due to the novelty of many of the issues discussed in the book, as well as their importance to the understanding of Twining's recommendations, I have provided a longer than usual account of several chapters. Part II touches upon one of the central jurisprudential dichotomies introduced by Twining—the distinction between general and particular jurisprudence. Twining compares different accounts of the distinction using pairs of canonical jurists. In particular, he compares H.L.A Hart's Postscript with Dworkin's Law's Empire. In this part, I juxtapose Twining's record of this …

Russia's Other "Mormons": Their Origins And Relationship To The Church Of Jesus Christ Of Latter-Day Saints, Eric A. Eliason, Gary Browning Jan 2001

Russia's Other "Mormons": Their Origins And Relationship To The Church Of Jesus Christ Of Latter-Day Saints, Eric A. Eliason, Gary Browning

BYU Studies

When Mormon missionaries entered Russia in 1990, they were astonished to hear about "Mormon" settlements already existing in the Samara region. Other evidence of Mormonism appeared: for example, locals used the term "Mormon crosses" to describe a unique style of crucifixes in cemeteries. In this article, the authors delve into the questions of whether or not sects with ties to mainstream Mormonism existed in pre-perestroika Russia or if unrelated groups earned the nickname "Mormon" for living in unusual family arrangements, similar to polygamy. Using data gathered from Latter-day Saint missionaries who served in Russia in the late 1990s as a …

“Haven’T We Come To Kill The Spaniards?” The Tule Upheaval In Eastern Panama, 1727-1728, Ignacio Gallup-Diaz

History Faculty Research and Scholarship

Investigates a Tule Indian uprising that took place in eastern Panama in 1727. The Indians' motivations for this uprising were varied and complicated and not simply the result of the instigations of mestizo pirate Luis García (as was alleged by the governor of Darién and historians, who have read his account of the events). The violence that spread across the isthmus was caused by the instability inherent in the Spanish colonial policy of tribalization. This policy relied on the Spanish authorities' co-opting men who claimed to be tribal leaders. These leaders, however, were unable to contain the Indians once they …

Legitimacy, Globally: The Incoherence Of Free Trade Practice, Global Economics And Their Governing Principles Of Political Economy, Michael Henry Davis, Dana Neacsu Jan 2001

Legitimacy, Globally: The Incoherence Of Free Trade Practice, Global Economics And Their Governing Principles Of Political Economy, Michael Henry Davis, Dana Neacsu

Law Faculty Articles and Essays

In this article, we observe the legalized character of the phenomenon popularly called “globalization.” We first examine what it means to be a legalized phenomenon and observe that an important part of legalization is legitimation. In domestic legal regimes, legitimation is accomplished through the Rule of Law, which makes certain claims about the nature of the society of which the legal regime is a part. Simply stated, the Rule of Law claims that a legal system is legitimate if its rules are definite and predictable and are applied in a general, impartial, and non-retroactive manner. In the international trading system …

Medicine And Health Care In Later Medieval Europe: Hospitals, Public Health,, And Minority Medical Practitioners In English And German Cities, 1250-1450, Anna Terry Jan 2001

Medicine And Health Care In Later Medieval Europe: Hospitals, Public Health,, And Minority Medical Practitioners In English And German Cities, 1250-1450, Anna Terry

Inquiry: The University of Arkansas Undergraduate Research Journal

Hospitals and individual caregivers helped meet the physical and psychological needs of medieval people, just as they do today. My overall objective is to explain social and individual responses to disease within the context of Christian theology and the urban community, focusing on England and Germany in the period between 1250 and 1450. First I investigate social responses to disease, including hospitals and public health ordinances. Christianity mandated the care of the afflicted, yet physical and mental illness was associated with sin and divine punishment. Urban authorities often attempted to deal with plague outbreaks by imposing quarantines and strict regulations …

The Bridging Role Of The Community Service Director On The Engaged Campus, Joann Campbell Jan 2001

The Bridging Role Of The Community Service Director On The Engaged Campus, Joann Campbell

Higher Education

Declines in civic participation, low voting rates among 18-25 year olds, dwindling federal support for social services, and deficit state budgets have created a climate in which higher education must make a case for the value it adds to society through applications of research and teaching. National and state organizations (such as Campus Compact and state Compacts) dedicated to supporting a culture of service in higher education articulate the university's role as a collective citizen, whose priorities include linking scholarship to community-based needs, using the resources of the college faculty for professional local service, and utilizing federal work study, America …

The Accidental Crit Ii: Culture And The Looking Glass Of Exile, Pedro A. Malavet

UF Law Faculty Publications

The current "Latin Music Craze" in United States mass media demands critical analysis from the LatCrit community. LatCrit scholars have engaged in the serious discussion of cultural production—of culture generally and popular culture in particular. LatCrit theory has analyzed cultural production mostly by "others," that is, cultural production internal to outsider communities. LatCritters also have studied how United States mass media portrays Latinas/os, African-Americans and Filipinas/os. This article will examine the competing narratives of Puerto Rican cultures in Puerto Rico and in the United States that are illuminated by the current Latin Music Craze. It will then explore how LatCritical …
