Occupational Health & Safety Innovations In The Hazardous Waste Remediation Industry, Brian Hansen

Theses

As the environmental technology aspects of hazardous waste remediation projects are becoming more innovative, the occupational health and safety aspects associated with these projects have not kept pace. This study was designed to examine a single, long-term remediation project's experiences with this dilemma. Although the project employed a number of traditional strategies to abate occupational health and safety hazards through most of its course, innovations concerning chemical protective clothing, air monitoring/sampling equipment, and the management of physical hazards at the last and perhaps most dangerous site lead to some interesting results. Language And Formalities In Commercial Contracts: A Defense Of Custom And Conduct, David V. Snyder

This article defends the decision to retain usage of trade, course of performance, and course of dealing in the revision of Article 1 of the Uniform Commercial Code. The article responds to recent neoformalist criticisms of the incorporation approach and offers a theoretical justification. Usage of trade and course of dealing should be understood as part of the parties' language, following Wittgenstein's understanding of language. Course of performance, which presents a weaker case in terms of language, should be understood as a legal formality, following Fuller's explanation of formalities. Thus understood, custom and conduct can be as important as written …

Assessing The Rate Of Change In The Enterprise Database System Market Over Time Using Dea, Timothy R. Anderson, Keith Hollingsworth, Lane Inman

Engineering and Technology Management Faculty Publications and Presentations

This paper builds upon previous work of using Data Envelopment Analysis (DEA) to measure incremental innovation in technology by applying it to the Online Transaction Processing Market. A variable returns to scale DEA model is utilized to determine an annual rate of change in benchmarks based on data provided by the Transaction Processing Performance Council. This rate of change may then be used to forecast possible future performance trendsetters of the TPC.
