No Ordinary Joe: Joseph R. Grodin And His Influence On California's Law Of The Workplace, Christopher David Ruiz Cameron Jan 2001

No Ordinary Joe: Joseph R. Grodin And His Influence On California's Law Of The Workplace, Christopher David Ruiz Cameron

UC Law Journal

When it comes to California law of the workplace, no one has proved more influential than Joseph R. Grodin. Much of that influence is due to Grodin's wide-ranging experience in that field and his opportunity to analyze and comment on employment and labor law from different perspectives. In a career spanning more than five decades, Joe Grodin has served as a union lawyer, law professor, arbitrator, founding member of the Agricultural Labor Relations Board, Justice of the California Court of Appeal, Justice of the California Supreme Court, and law professor once more.

This Essay outlines the manner in which Joe …

Carter, Reagan, And Khomeini: Presidential Transitions And International Law, Nancy Amoury Combs Jan 2001

Carter, Reagan, And Khomeini: Presidential Transitions And International Law, Nancy Amoury Combs

UC Law Journal

Although lame-duck Presidents frequently push through partisan domestic laws and policies during the waning hours of their administrations, they usually steer clear of significant or controversial international issues; or, at the least, they seek their successors' concurrence as to the course to pursue. This Article examines one of those very rare instances in which a lame-duck President was able and chose, during the final hours of his Administration, to bind the United States to significant international commitments without the concurrence of the President-elect. President Carter's final year in office was dominated by his efforts to secure the release of the …

Working Knowledge: Trade Secrets, Restrictive Covenants In Employment, And The Rise Of Corporate Intellectual Property, 1800-1920, Catherine L. Fisk Jan 2001

Working Knowledge: Trade Secrets, Restrictive Covenants In Employment, And The Rise Of Corporate Intellectual Property, 1800-1920, Catherine L. Fisk

UC Law Journal

The invention of trade secret doctrine in the mid-nineteenth century enabled employers to enjoin revelation of secret information by current or former employees. At the same time, courts expanded the permissible uses of post-employment covenants not to compete so as to prevent dissemination of knowledge. These doctrinal developments thus defined the bounds of permissible entrepreneurship. Equally as significant, these doctrines both generated and reflected a profoundly new perspective on the nature and control of workplace knowledge.

This Article examines the origins and development of the law of trade secrets and restrictive covenants through study of cases and treatises and through …

Extinguishing Inheritance Rights: California Breaks New Ground In The Fight Against Elder Abuse But Fails To Build An Effective Foundation, Kymberleigh N. Korpus Jan 2001

Extinguishing Inheritance Rights: California Breaks New Ground In The Fight Against Elder Abuse But Fails To Build An Effective Foundation, Kymberleigh N. Korpus

UC Law Journal

This Note examines the elder abuse problem in the United States by describing: state responses to its "discovery" in the late 1970s as well as the debilitating reliance upon reporting; the currently available remedies and the hurdles to using those remedies; the ethical challenges to the states' primary abuse prevention tools, and the dramatic explosion in elder abuse that is already underway. Then, this Note describes American descent doctrines, and philosophies underlying exceptions to the doctrinal testamentary freedom and value-neutrality of intestate succession statutes. It proposes the Chinese behavior-based model of inheritance as an alternative inheritance scheme that, with its …

The Private Attorney General In A Global Age: Public Interests In Private International Antitrust Litigation, Hannah Buxbaum Jan 2001

The Private Attorney General In A Global Age: Public Interests In Private International Antitrust Litigation, Hannah Buxbaum

Articles by Maurer Faculty

Even in a climate of increased cooperation among regulatory authorities, jurisdictional conflict remains a prominent aspect of cross-border antitrust regulation. Much of this conflict is generated by private litigation - that is, lawsuits initiated under U.S. antitrust law by private attorneys general rather than by the government. This article examines two strands of jurisprudence relevant to the role of the private attorney general in cases with international aspects. First, it analyzes the cases, involving actions based on statutory violations of the antitrust laws, in which the extraterritorial reach of U.S. antitrust law has been delimited. It then turns to decisions …

Patent Law In The Age Of The Invisible Supreme Court, Mark D. Janis Jan 2001

Patent Law In The Age Of The Invisible Supreme Court, Mark D. Janis

Articles by Maurer Faculty

This article examines the permanence of the U.S. Supreme Court's retreat to the peripheries of patent law after the creation of the Federal Circuit, and explores the roles that the Supreme Court might imagine for itself in contemporary patent law. For discussion purposes, the article describes two hypothetical models for Supreme Court decisionmaking in patent cases: an aggressive interventionist model and an extreme non-interventionist model. After considering the shortcomings of both models, the article proposes an intermediate, managerial model. The managerial model rejects the proposition that the Court should intervene in patent cases to correct perceived substantive errors in Federal …

A Textual Analysis Comparing The Content Of "Black Enterprise," "Forbes," And "Fortune" Magazines And The Message Each Presents To Its Readers, Karen M. Rowley Jan 2001

A Textual Analysis Comparing The Content Of "Black Enterprise," "Forbes," And "Fortune" Magazines And The Message Each Presents To Its Readers, Karen M. Rowley

LSU Master's Theses

A study of Forbes, Fortune, and Black Enterprise magazines finds that the two mainstream business publications—Forbes and Fortune—provide virtually no coverage of Blacks and the black business community, thereby helping to perpetuate the white-dominated view of society that places minorities in general—and Blacks in particular—outside the norm. Black Enterprise, on the other hand, continues in the long tradition of the black press, providing an alternative view of society through its focus on the black business community.

The Effectiveness Of Sports Sponsorhips: A Study Of The New Orleans Zephyrs, Amy Marie Boyle Jan 2001

The Effectiveness Of Sports Sponsorhips: A Study Of The New Orleans Zephyrs, Amy Marie Boyle

LSU Master's Theses

Despite the pervasiveness of sports in American society and the ever-increasing role of sponsorship in the marketing mix, sponsorship marketing as a discipline currently lacks the rigorous academic study and theoretical foundations that exist in other marketing disciplines. The purpose of this study is to determine whether or not sponsorship of New Orleans Zephyrs baseball is an effective way of increasing awareness of a product or brand. Using intermediate measures of recognition testing, fans at three New Orleans Zephyrs games were surveyed to test sponsor recognition. The study examined various elements of sponsorship marketing including the effects that gender, age, …

Trans-Mississippi Southerners In The Union Army, 1862-1865, Christopher Rein Jan 2001

Trans-Mississippi Southerners In The Union Army, 1862-1865, Christopher Rein

LSU Master's Theses

Men from throughout the Trans-Mississippi South enlisted in the Union army during the Civil War both in existing northern regiments and in units raised specifically for the purpose of enlisting southerners. The men who joined and fought represented almost every social and ethnic division within the region and contributed substantially to the success of Union arms during the war. Examining a single regiment from each state or territory in the region (except Louisiana, where one white and one black unit were chosen due to segregation) reveals similarities of background, experience and purpose. Louisiana's contributions to the Union army were primarily …

The Evaluation Of Pcr-Based Techniques For The Detection Of Fecal Indicator Organisms In Environmental Samples, Quinesha Laticia Perry Jan 2001

The Evaluation Of Pcr-Based Techniques For The Detection Of Fecal Indicator Organisms In Environmental Samples, Quinesha Laticia Perry

LSU Master's Theses

Escherichia coli is the indicator organism of choice for the detection of fecal contamination. Standard methods for detecting fecal contamination often rely on detecting fecal coliforms. While this practice if highly efficient in most applications, when used with the sediment-laden waters of Louisiana, free-living soil bacteria, such as Klebsiella pneumoniae were shown to inflate the fecal coliform counts. An accurate assessment of the contamination problem requires methods that detect E. coli. To detect E. coli, several of species-specific genes were tested before the gadAB genes were selected. The polymerase chain reaction (PCR) was chosen to detect these genes using a …

A Descriptive Survey Of Social Skills Training Practices For Preschool Children With Special Needs In Indiana, Carol Anne Mclean

All-Inclusive List of Electronic Theses and Dissertations

A statewide mail survey of specialEducation preschool teachers (N = 370, return rate of 51%) in Indiana was conducted to gather descriptive information about social skills training practices. Reported practices were compared to recommended practices from the theoretical literature. Results indicated a lack of formal training of teachers, lack of curriculum selection guidelines, lack of systematic assessment and intervention programs, and a lack of individualization of social skill training goals. Practices consistent with the theoretical literature were revealed including working with teams to develop IEP social skill goals, prioritizing social skills training activities, and effective use of observation assessment methods, …

Achievement Goals And Exam Performance: An Exploration Of The Role Of Study Strategies And Anticipatory Test Anxiety, Chris Andrew Baldwin Jan 2001

Achievement Goals And Exam Performance: An Exploration Of The Role Of Study Strategies And Anticipatory Test Anxiety, Chris Andrew Baldwin

All-Inclusive List of Electronic Theses and Dissertations

The most influential approach to the study of achievement motivation in contemporary literature has been the achievement goal approach. Achievement motivation has been conceptualized by Elliot and colleagues (Elliot, 1997; 1999; Elliot & Church, 1997; Elliot & Harackiewicz, 1996; Elliot & McGregor, 1999; Elliot, McGregor, & Gable, 1999) as a hierarchical model in which achievement motives, need for achievement and, fear of failure, influence the adoption and pursuit of three distinct types of achievement goals (i.e., mastery, performance-approach, and performance-avoidance). Pursuit of these various achievement goals, in turn, directly predicts achievement-relevant outcomes. Only recently has research begun to emerge exploring …

Occupational Health & Safety Innovations In The Hazardous Waste Remediation Industry, Brian Hansen Jan 2001

Occupational Health & Safety Innovations In The Hazardous Waste Remediation Industry, Brian Hansen

Theses

As the environmental technology aspects of hazardous waste remediation projects are becoming more innovative, the occupational health and safety aspects associated with these projects have not kept pace. This study was designed to examine a single, long-term remediation project's experiences with this dilemma. Although the project employed a number of traditional strategies to abate occupational health and safety hazards through most of its course, innovations concerning chemical protective clothing, air monitoring/sampling equipment, and the management of physical hazards at the last and perhaps most dangerous site lead to some interesting results. These results suggest that innovative yet practical solutions exist …
