Internet Pharmacies: Cyberspace Versus The Regulatory State , Ty Clevenger Jan 2001

Internet Pharmacies: Cyberspace Versus The Regulatory State , Ty Clevenger

Journal of Law and Health

The unique qualities of e-commerce make it difficult to regulate under any circumstances, but the growth of online pharmacies in particular is far outpacing the ability of government officials to investigate and enforce existing drug laws. In 1999, Americans spent an estimated $44 million purchasing prescription drugs from online pharmacies, a figure that is projected to reach $1 billion per year by 2003. In December of 1999, President Clinton proposed $10 million in new funding for the FDA to regulate Internet pharmacies and hire 100 new employees, but the FDA has yet to explain whether this would be enough to …

The Strict Ohio Supreme Court Decision In Biddle: Third Party Law Firm Held Liable For Inducing Disclosure Of Medical Information , Kimberly Rathbone Jan 2001

The Strict Ohio Supreme Court Decision In Biddle: Third Party Law Firm Held Liable For Inducing Disclosure Of Medical Information , Kimberly Rathbone

Journal of Law and Health

Victims of unauthorized disclosures of medical information have enjoyed strict protection by state and federal courts. This is because secrecy is considered a sacred requirement in order to foster honesty and cooperation between a physician and patient. Confidentiality is considered such a vital ingredient to the physician-patient relationship by the medical profession that it is addressed in the oath, which is a prerequisite to admittance into the field of medicine: "All that may come to my knowledge in the exercise of my profession or outside of my profession or in daily commerce with men, which ought not be spread abroad, …

Denying Medical Staff Privileges Based On Economic Credentials , Sandra Difranco Jan 2001

Denying Medical Staff Privileges Based On Economic Credentials , Sandra Difranco

Journal of Law and Health

Health care costs are continuing to rise. This forces hospitals to consider the cost and efficiency of each physician when making privileging decisions. However, hospitals cannot deny a competitor physician staff privileges strictly based on economic factors. If this is the only consideration that the hospital utilizes, a denial or restriction of privileges based solely on competitive considerations may expose the hospital to liability under federal antitrust as well as state tort claims. This Note will focus primarily on Ohio laws and statutes. A comparison with other jurisdictions also will be analyzed. This Note will illustrate the complexities and ambiguities …

Washington V. Glucksberg: Influence Of The Court In Care Of The Terminally Ill And Physician Assisted Suicide, Philip King

Journal of Law and Health

This Note will examine current issues pertaining to the medical care of the terminally ill individual, particularly with respect to palliative care and how the continuum of medical care incorporates the voluntary termination of a patient's life. Part II of this Note will look at the decision reached in Washington v. Glucksberg, and how the Supreme Court has contributed to the molding of care for the terminally ill. Part III will review relevant aspects of end of life care concepts and their relationship and impact upon the assisted suicide alternative. Any analysis of physician assisted suicide must include the evolution …

Constitutional Classifications And The Gay Gene, Susan Becker Jan 2001

Constitutional Classifications And The Gay Gene, Susan Becker

Journal of Law and Health

What I am going to talk about is the use of genetic information to classify individuals for purposes of the law, and more specifically, the impact of the so-called "gay gene" on legal classifications. What is really important here, and the reason I need to offer you a primer on constitutional law, is so that we all start on the same page by understanding how our laws, starting with the federal constitution, classify people for the purpose of bestowing or denying rights and benefits. This leads us to an understanding of why people object to various classifications, and an appreciation …

Legislation And Genetic Discrimination, Sharona Hoffman Jan 2001

Legislation And Genetic Discrimination, Sharona Hoffman

Journal of Law and Health

State legislation addresses genetic discrimination in both employment and health insurance. Thirty-one states have passed laws that address genetic discrimination in employment. Approximately thirteen states prohibit employers from requiring applicants to undergo genetic testing as a condition of employment. Some states have more limited restrictions. Florida prohibits only the screening of applicants for the sickle-cell trait. Wisconsin requires employers to obtain written and informed consent from applicants prior to administering genetic tests, but does not preclude their utilization altogether. Some states establish exceptions that permit genetic testing that is job-related or that is conducted, with the employee's written and informed …

Genetic Testing And Employment Litigation, Harry Zanville Jan 2001

Genetic Testing And Employment Litigation, Harry Zanville

Journal of Law and Health

I have only a couple of comments to make that relate to litigation hurdles and how to achieve this balance, and the first thing I want to talk about, following the wonderful presentation is, in fact, we probably don't in some ways even need a new cause of action.

Application Of Administrative Law To Health Care Reform: The Real Politik Of Crossing The Quality Chasm , Thomas R. Mclean Jan 2001

Application Of Administrative Law To Health Care Reform: The Real Politik Of Crossing The Quality Chasm , Thomas R. Mclean

Journal of Law and Health

Real Politik, a term in vogue at the height of the Cold War, contemplates that in practice, governmental bodies attempt to expand their spheres of influence and control by the application of economic leverage. The federal government is clearly interested in expanding its influence into health care because of its cost. Americans spend over one trillion dollars - forty-four percent of which is paid for by the federal government - on health care each year. To control the cost of health care, governmental reformers proposed the Health Securities Act of 1993 as a frontal assault on the American health care …

Routine Patient Care In Clinical Trials: Whose Cost Is It Anyway?, Dina Berlyn Jan 2001

Routine Patient Care In Clinical Trials: Whose Cost Is It Anyway?, Dina Berlyn

Journal of Law and Health

This article examines the issue of coverage for routine medical expenses for clinical trial patients by third party payers from both a medical and political policy perspective. It is critical for patients, investigators, and sponsors to know who is responsible for paying these costs. This issue affects the willingness of patients to enter clinical trials and has the potential to affect which diseases will be the subjects of clinical trials. This presentation first summarizes the basics of clinical trials and then explores the definition of routine care in clinical trials. Medicare reimbursement, an issue that has been the subject of …

Direct Measures: An Alternative Form Of Affirmative Action, Daria Roithmayr Jan 2001

Direct Measures: An Alternative Form Of Affirmative Action, Daria Roithmayr

Publications

In this essay, I will propose an alternative form of law school affirmative action that does not rely on racial classifications, but nevertheless helps to remedy racial discrimination, to diversify the educational environment and to provide resources for underserved communities. In particular, I propose a "direct measures" program that would grant admissions preferences on the basis of the following criteria: (1) whether an applicant has suffered from the effects of racial discrimination; (2) whether, on issues of racial and social justice, the applicant can contribute a perspective or viewpoint not currently represented within the majority of the student population, and …

In-Prison Day Care: A Correctional Alternative For Women Offenders, Jessica Y. Kim

Cardozo Journal of Equal Rights & Social Justice

The note argues that traditional incarceration of mothers can have detrimental effects on both the women and their children, advocating for alternative correctional methods such as in-prison day care programs. These alternatives aim to maintain the mother-child bond, reduce recidivism, and mitigate the negative societal impacts of separating mothers from their children.

Malcolm Maclean, Jr.: Ahead Of His Time And Ahead Of Our Time, Will Norton Jan 2001

Malcolm Maclean, Jr.: Ahead Of His Time And Ahead Of Our Time, Will Norton

College of Journalism and Mass Communications: Faculty Publications

In a recent essay Stephen Reese (1999, 70), chair of the Department of Journalism at the University of Texas, assessed the media today and analyzed the condition of journalism education and concluded that foundations and media corporations are having more influence on journalism programs than at any time in the history of journalism education. As I read the essay by Reese, I noted many observations that Malcolm MacLean made three decades ago, but nowhere was MacLean cited. In fact, I do not believe Reese could have described the influence of media as a new problem if he had known about …

Prevalence Of Eimeria (Apicomplexa: Eimeriidae) In Reintroduced Gunnison's Prairie Dogs (Cynomys Gunnisoni), M. M. Ryan, K. H. Decker, Donald W. Duszynski

Harold W. Manter Laboratory of Parasitology: Faculty Publications

Fecal samples from 54 Gunnison’s prairie dogs (Cynomys gunnisoni) from Albuquerque, NM were analyzed for the presence of coccidia and all were positive. They were then relocated to an abandoned prairie dog town on the Sevilleta Long Term Ecological Research (LTER) site. Six Eimeria species, E. callospermophili, E. cynomysis, E. pseudospermophili (new host record), E. spermophili, E. ludoviciani and E. vilasi (new host record) were found in Albuquerque animals, but only two species, E. callospermophili and E. vilasi were present in relocated hosts. A significant (P < 0.05) reduction was seen in the prevalence of E. vilasi (72% vs. 13%) and in the prevalence of infections …

Federal Preemption And Vacatur: The Bookend Issues Under The Revised Uniform Arbitration Act, Stephen L. Hayford Jan 2001

Federal Preemption And Vacatur: The Bookend Issues Under The Revised Uniform Arbitration Act, Stephen L. Hayford

Journal of Dispute Resolution

As one of the two Academic Advisors to the Drafting Committee appointed by the National Conference of Commissioners on Uniform State Laws ("NCCUSL") to revise the Uniform Arbitration Act, I was assigned primary responsibility for the two most important issues pertinent to the Drafting Committee's framing of the Revised Uniform Arbitration Act ("RUAA"). The first-the issue of federal preemption-set the baseline for the scope and character of the RUAA by defining for the Drafting Committee the areas of the substantive law of arbitration in which the states are free to regulate, the Federal Arbitration Act ("FAA") notwithstanding. The second-the issue …

Class Action Vs. Arbitration: Does Tila Support Class Actions In Arbitration Where Statutory Rights Are Concerned - Johnson V. West Suburban Bank, Christina S. Lewis

Journal of Dispute Resolution

Johnson v. West Suburban Bank is an important case in American jurisprudence because it combines several United States Supreme Court cases to establish a test for whether arbitration provisions relating to statutory rights should be upheld when they essentially preclude class actions. This Casenote will examine the progression the courts have taken and Johnson's subsequent test. Finally, an evaluation of this test will follow.

Mandatory Arbitration Of An Employee's Statutory Rights: Still A Controversial Issue Or Are We Beating The Proverbial Dead Horse - Penn V. Ryan's Family Steakhouse, Inc., Andrea L. Myers Jan 2001

Mandatory Arbitration Of An Employee's Statutory Rights: Still A Controversial Issue Or Are We Beating The Proverbial Dead Horse - Penn V. Ryan's Family Steakhouse, Inc., Andrea L. Myers

Journal of Dispute Resolution

Since the early 1980s, the Supreme Court has espoused a strong preference for arbitration in the employment setting. Despite this general preference, the Supreme Court has never clearly stated that mandatory arbitration of statutory rights is always reasonable. This omission has led to much controversy about whether this preference permits the mandatory arbitration of all statutory rights or only those that are amenable to arbitration as defined by the Supreme Court.

Faculty Publications

We have performed variable-temperature multimode quantitative microwavemicroscopy of in situepitaxial Ba1−xSrxTiO3 thin-film composition spreads fabricated on (100) LaA1O3 substrates. Dielectric properties were mapped as a function of continuously varying composition from BaTiO3 to SrTiO3. We have demonstrated nondestructive temperature-dependent dielectric characterization of local thin-film regions. Measurements are simultaneously taken at multiple resonant frequencies of the microscope cavity. The multimode measurements allow frequency dispersion studies. We observe strong composition-dependent dielectric relaxation in Ba1−xSrxTiO3 at microwave frequencies.

Shoes And Steel : Dependency Deindustrialization And Its Relationship To Community Strain In Portsmouth, Ohio 1970-1999, Dan Shope

Theses, Dissertations and Capstones

Portsmouth, Ohio, is an Appalachian city with a long history as a member of the U.S. manufacturing production hierarchy with a large working class population. Its largest manufacturing employers were shoe and steel companies. Historically, Portsmouth depended on manufacturing jobs for its economic survival. During the late 3 I 970s and early 1980s, Portsmouth's manufacturing base was diminished due to the deindustrialization process. This structural transformation affected the total population involved in the manufacturing jobs and yielded a city that depended on outside forces for its economic livelihood. Portsmouth moved into a state of dependent deindustrialization and community strain. When …

Approximate Solutions For Galvanostatic Discharge Of Spherical Particles I. Constant Diffusion Coefficient, Venkat R. Subramanian, James A. Ritter, Ralph E. White Jan 2001

Approximate Solutions For Galvanostatic Discharge Of Spherical Particles I. Constant Diffusion Coefficient, Venkat R. Subramanian, James A. Ritter, Ralph E. White

Faculty Publications

Approximate models are developed, based on second, fourth, and sixth order polynomials, that describe the concentration profile of an electrochemically active species in a spherical electrode particle. Analytical expressions are obtained that describe the way the concentration profiles, surface concentrations, and electrode utilization change during the galvanostatic discharge of an electrode particle. Based on a comparison with an exact analytical model over a wide range of dimensionless current densities, all three approximate models performed extremely well in predicting these quantities. Quantitative criterion for the validity of these models is also developed and shows that the sixth order, four parameter approximate …

Synthesis And Characterization Of Hydrous Ruthenium Oxide-Carbon Supercapacitors, Manikandan Ramani, Bala S. Haran, Ralph E. White, Branko N. Popov

Faculty Publications

It is shown that composite Ru oxide-carbon based supercapacitors possess superior energy and power densities as compared to bare carbon. An electroless deposition process was used to synthesize the ruthenium oxide-carbon composites. Ru is dispersed on the carbon matrix as small particles. The effect of electrochemical oxidation and temperature treatment on the material performance has been studied extensively. Increasing the oxidation temperature reduces the proton transport rate and also increases the degree of crystallinity of the deposits. This adversely affects the performance of the composite. Loading a small amount of Ru oxide (9 wt %) on carbon increases the capacitance …

Clear-Sky Albedo Measured At Seven Rangland Sites In Southwest Idaho, Clayton L. Hanson Jan 2001

Clear-Sky Albedo Measured At Seven Rangland Sites In Southwest Idaho, Clayton L. Hanson

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

As a component of the energy budget, albedo is used in the calculation of evapotranspiration in many natural resource and hydrologic models. There are few measurements of albedo over sagebrush-dominated rangelands, so albedo was measured at seven sites on the Reynolds Creek Experimental Watershed in southwest Idaho during 1989–1993. For all sites, the average albedo measured during midday under clear skies was 0.14 during the growing season. Albedo varied from a low of 0.11 during June at the Mountain big sagebrush site to a high of 0.17 at the low-elevation Wyoming big sagebrush site. Albedo varied little between about 2 …
