The Rise Of Dispersed Ownership: The Roles Of Law And The State In The Separation Of Ownership And Control, John C. Coffee Jr. Jan 2001

The Rise Of Dispersed Ownership: The Roles Of Law And The State In The Separation Of Ownership And Control, John C. Coffee Jr.

Faculty Scholarship

Recent scholarship on comparative corporate governance has produced a puzzle. While Berle and Means had assumed that all large public corporations would mature to an end-stage capital structure characterized by the separation of ownership and control, the contemporary empirical evidence is decidedly to the contrary. Instead of convergence toward a single capital structure, the twentieth century saw the polarization of corporate structure between two rival systems of corporate governance:

  1. A Dispersed Ownership System, characterized by strong securities markets, rigorous disclosure standards, and high market transparency, in which the market for corporate control constitutes the ultimate disciplinary mechanism; and
  2. A …

Fear And Loathing Of Politics In The Legal Academy, William H. Simon Jan 2001

Fear And Loathing Of Politics In The Legal Academy, William H. Simon

Faculty Scholarship

In a recent lament about Bush v. Gore, Bruce Ackerman feared that the patent groundlessness of the opinion would convince many of a proposition he attributed to critical legal studies: that law is simply a form of politics.

This remark reflects two tendencies prominent at the Yale Law School in recent years: first, a preoccupation with a now extinct and never very successful movement of left legal academics, and second, a tendency to conflate this movement with the legal conservatism of Jusice Scalia and his collaborators at the University of Chicago and the Rehnquist Court.

These tendencies ride high …

Case Study Of A Fourth Generation Mrm Program At A Corporate Aviation Operator, Manoj S. Patanker, James C. Taylor Jan 2001

Case Study Of A Fourth Generation Mrm Program At A Corporate Aviation Operator, Manoj S. Patanker, James C. Taylor

Journal of Aviation/Aerospace Education & Research

Research in aviation maintenance human factors maps the evolution of MRM training programs into four distinct generations bridging attitude awareness programs, behavior changes, and process and structure changes. This paper analyzes a fourth generation MRM program from the perspective of the multi-step process, developed by the authors, as a guide for airlines to develop their own human factors programs. This analysis demonstrates that the corporate maintenance human factors program under review is a forerunner; however, a few additional, definitive steps during the planning, implementation, and follow-up would make this program more robust.

Controlled Flight Into Terrain: How The Airlines And The Federal Aviation Administration Are Addressing The Problem, Roger C. Matteson Jan 2001

Controlled Flight Into Terrain: How The Airlines And The Federal Aviation Administration Are Addressing The Problem, Roger C. Matteson

Journal of Aviation/Aerospace Education & Research

Controlled Flight into Terrain (CFIT) is not a new problem. It has been around since the beginning of manned flight. A CFIT accident occurs when an airworthy aircraft, under the control of a pilot, is flown (unintentionally) into terrain, water, or obstacles with inadequate awareness on the part of the pilot (crew) of the impending collision (Wiener, 1977). It would seem that CFIT would be an easy problem to solve or reduce but unfortunately, that has not been the case. CFIT is still the leading cause of all fatal aircraft accidents in the world. Figure 1 illustrates the CFIT accident …

The Pcatd’S Role In The Cognitive Processes Of Flight Training, Amy Combs Jan 2001

The Pcatd’S Role In The Cognitive Processes Of Flight Training, Amy Combs

Journal of Aviation/Aerospace Education & Research

It has been proven that performance on one task, such as flight in an aircraft simulator, may aid or facilitate performance on a second task (flying the actual aircraft). This concept is known as positive transfer, or learning to make the same response to new but similar stimuli. Positive transfer is an important issue in the area of aviation simulation and has been the basis for a variety of research experiments conducted by the FAA, NASA, the US military, and academia.

Accreditation Of Collegiate Aviation’S Distance Education Programs: Now And In The Future, Brent D. Bowen, Nanette Scarpellini, Mary Fink Jan 2001

Accreditation Of Collegiate Aviation’S Distance Education Programs: Now And In The Future, Brent D. Bowen, Nanette Scarpellini, Mary Fink

Journal of Aviation/Aerospace Education & Research

The purpose of this research endeavor is to benchmark and evaluate the accreditation status of aviation distance education programs in the United States. This study examines both the expanding role of distance education as a delivery method for aviation courses as well as the need for establishing standards. The research methods provide data collection through content analysis, literature review, and a survey tool mailed to aviation professionals nationwide. The findings reveal that, in general, most disciplines are either just beginning to approach the subject of distance education accreditation of programs or do not deal with the issue at all. The …

Testing The Design Of A Library Information Gateway, W. Bede Mitchell, Laura B. Davidson, Virginia C. Branch, Lynne Lysiak

University Libraries: Faculty Publications

In autumn of 1999, the library World Wide Websites at Appalachian State University and Georgia Southern University had been in place for more than a year, and many library users reported that certain aspects of the sites’ designs were confusing. In order to alleviate the confusion, librarians from the two universities decided to redesign the sites by determining the greatest sources of confusion. To do this, we studied how patrons used the web sites by way of user-centered usability testing.

An Analysis Of A Radio Frequency Sensor As A Means To Remotely Sense Selected Surface Topographies In An Agriculture Environment, Barry Michael Alexia Jan 2001

An Analysis Of A Radio Frequency Sensor As A Means To Remotely Sense Selected Surface Topographies In An Agriculture Environment, Barry Michael Alexia

Dissertations and Theses @ UNI

Remote sensing is the science and art of obtaining information about an object, area or phenomenon through the analysis of data acquired by a device that is not in contact with the object, area, or phenomenon under investigation. The remotely sensed data can be of many forms, including variations in force distribution, acoustic wave distribution, or electromagnetic energy distribution.Information thus acquired can be used for observing, monitoring, and studying planetary surfaces and environments.

Because there are many ways to acquire data about targets of interest, there are many types of remote sensors that can be used, including visible, infrared, and active …

The interviews were recorded, transcribed, and coded for recurring patterns and themes by the researcher along with the use of QSR NUD.IST 5 software.

The most common …

Women In Public Middle School Administration In Georgia: A Feminist Analysis Of The Perceptions Of Women In Power, Karen L. Doty Jan 2001

Women In Public Middle School Administration In Georgia: A Feminist Analysis Of The Perceptions Of Women In Power, Karen L. Doty

College of Graduate Studies: Theses & Dissertations (1964–2006)

The field of educational leadership is currently experiencing an era of educational change. Women who work in primarily male-dominated careers as principals of middle schools have experienced a variety of complex issues related to their leadership roles and their gender roles. There has been a notable increase in the number of female principals in Georgia, and in the nation, therefore the role of the principal was studied to determine how much this role has changed. Feminist standpoint theory was used to provide different insights and perspectives about the problem of marginalization of women in educational administration. Georgia middle school principals …

Probabilistic Principles In Unsupervised Learning Of Visual Structure: Human Data And A Model, Shimon Edelman, Benjamin P. Hiles, Hwajin Yang, Nathan Intrator Jan 2001

Probabilistic Principles In Unsupervised Learning Of Visual Structure: Human Data And A Model, Shimon Edelman, Benjamin P. Hiles, Hwajin Yang, Nathan Intrator

Research Collection School of Social Sciences

To find out how the representations of structured visual objects depend on the co-occurrence statistics of their constituents, we exposed subjects to a set of composite images with tight control exerted over (1) the conditional probabilities of the constituent fragments, and (2) the value of Barlow's criterion of "suspicious coincidence" (the ratio of joint probability to the product of marginals). We then compared the part verification response times for various probe/target combinations before and after the exposure. For composite probes, the speedup was much larger for targets that contained pairs of fragments perfectly predictive of each other, compared to those …

Evaluating Hungary's Mixed-Member Electoral System, Kenneth Benoit Jan 2001

Evaluating Hungary's Mixed-Member Electoral System, Kenneth Benoit

Research Collection School of Social Sciences

The electoral system adopted by Hungary in 1989 represents a monument to the potential for institutional design through bargaining to produce complex yet stable institutions. The key compromise reached during this bargaining process was the decision to use a mixed-member system, electing a roughly even number of representatives from both majoritarian single-seat districts (SSDs) and from multi-seat, list proportional representation (PR) districts. This decision established Eastern Europe's first mixed-member electoral system, a format that was to become common in post-communist electoral systems. In its ten-year existence, Hungary's mixed-member system has operated in three elections and seen three different governments come …

Of Time, Space, And The History Of Sociology: Methodological Rules In Archives And Archival Research, Michael R. Hill Jan 2001

Of Time, Space, And The History Of Sociology: Methodological Rules In Archives And Archival Research, Michael R. Hill

Department of Sociology: Faculty Publications

The "archival turn" that characterizes much new and recent work in the disciplinary history of sociology is institutionally situated and replete with professional obligations and scholarly expectations, some less visible than others. Unlike our colleagues in academic departments of history, we are relative newcomers to archives and their riches. Pandora-like, enough sociologists have now opened the archival door to make this a propitious moment to reflect methodologically on what we are doing when we ask archival questions and report archival discoveries. This essay invites our corporate consideration of three vital features of archival research into the history of sociology: (1) …

Taking Harriet Martineau Seriously In The Classroom And Beyond, Michael R. Hill, Susan Hoecker-Drysdale Jan 2001

Taking Harriet Martineau Seriously In The Classroom And Beyond, Michael R. Hill, Susan Hoecker-Drysdale

Department of Sociology: Faculty Publications

The contributors to this book, sociologists all, take Harriet Martineau seriously as a major and consequential intellect within their chosen discipline and their classrooms. It has not always been so, at least in recent times, but Martineau has now been rediscovered by sociologists who are writing about Martineau in a growing series of books, essays, and scholarly editions. We do not all see Martineau through the same "author spectacles," as the following contributions make evident, but we do see her-she is no longer "invisible" to those of our students and colleagues who possess a modicum of bibliographic savvy. At several …

A Methodological Comparison Of Harriet Martineau’S Society In America (1837) And Alexis De Tocqueville’S Democracy In America (1835-1840), Michael R. Hill Jan 2001

A Methodological Comparison Of Harriet Martineau’S Society In America (1837) And Alexis De Tocqueville’S Democracy In America (1835-1840), Michael R. Hill

Department of Sociology: Faculty Publications

It is commonplace in american intellectual circles to cite Alexis De Tocqueville's (1835-40) Democracy in America as an insightful work by an astute foreign observer who carefully assayed the character of American politics and social institutions. Year after year, Tocqueville's Democracy in America receives, by far, many more citations in Social Sciences Citation Index than does Harriet Martineau's (1837) Society in America. Few essays on "democracy" appear in popular outlets such as The New York Times, U.S. News & World Report, and Newsweek without including an homage to Tocqueville and his presumably well-founded insights. At the same time, Harriet Martineau's …

The Impact Of Childhood Sexual Abuse On Later Sexual Victimization Among Runaway Youth, Kimberly A. Tyler, Dan R. Hoyt, Les B. Whitbeck, Ana Mari Cauce Jan 2001

The Impact Of Childhood Sexual Abuse On Later Sexual Victimization Among Runaway Youth, Kimberly A. Tyler, Dan R. Hoyt, Les B. Whitbeck, Ana Mari Cauce

Department of Sociology: Faculty Publications

Path analysis was used to investigate the impact of childhood sexual abuse on later sexual victimization among 372 homeless and runaway youth in Seattle. Young people were interviewed directly on the streets and in shelters by outreach workers in youth service agencies. High rates of both childhood sexual abuse and street sexual victimization were reported, with females experiencing much greater rates compared with their male counterparts. Early sexual abuse in the home increased the likelihood of later sexual victimization on the streets indirectly by increasing the amount of time at risk, deviant peer affiliations, participating in deviant subsistence strategies, and …

Twelve fifth grade students were trained in the fall of 1998 to mediate conflicts during the 1998–1999 school year and twelve fourth grade students were trained in the spring of 1999 to serve as conflict managers during the 1999–2000 school year. All conflict managers were trained using the San Francisco Community Boards Program. During the mediation session, conflict managers completed a report form which outlined the research questions and described the types of conflict brought to mediation, …

Memory Recall Among Individuals Reporting Child Sexual Abuse: The Role Of Suggestibility, Dissociation, And Closeness With The Perpetrator, Tammy M. Schultz Jan 2001

Memory Recall Among Individuals Reporting Child Sexual Abuse: The Role Of Suggestibility, Dissociation, And Closeness With The Perpetrator, Tammy M. Schultz

All-Inclusive List of Electronic Theses and Dissertations

Over the past decade, a contentious debate regarding delayed memories of child sexual abuse (CSA) has existed. Advocates on one side of the debate (Williams, 1994) maintain that common sequelae to traumatic events include memory disturbances. Dissociation and the dependent relationship between the victim and perpetrator are used to explain these memory disturbances. In contrast, proponents from the other end of the continuum (Loftus, 1993) argue abusive events are memorable, and suggestible clients adopt erroneous traumatic memories, as a result of leading questions used in therapy. The purpose of this study was to determine the epidemiology of CSA, and address …

This mixed-method research study focused on successful first-generation college students enrolled at a mid-sized public university. The study's purpose was to explore factors that help explain academic persistence and progress among first-generation college students at Indiana State University. Quantitative analyses tested the predictive power of student characteristics associated with academic success that are commonly found in research literature. The study's 17 predictor variables together accounted for 21% of the variance in first-generation college student success. The independent variables of (1) high school grade point average, (2) SAT total score, (3) hours spent on high school homework, (4) gaining a college …

The Psychological And Social Characteristics Among College Students Who Binge Drink, Mary Elizabeth Grigar Jan 2001

The Psychological And Social Characteristics Among College Students Who Binge Drink, Mary Elizabeth Grigar

All-Inclusive List of Electronic Theses and Dissertations

This study examined whether personality type and social variables predict: (a) binge drinking behavior, and (b) alcohol related consequences. Two hundred thirty-seven first year students from a private, Midwest, engineering college were administered the Myers Briggs Type Indicator, a Student Information Questionnaire, a Drinking Questionnaire, and the Young Adult Alcohol Problems Screening Test. Binge drinking was defined as the successive consumption of four or more drinks for women and five or more drinks for men in one sitting. Logistical and multiple regression analyses were performed. The judgment-perception personality type predicted binge drinking behavior. The social variables which predicted binge drinkers …

A Comparison Of Early Childhood Recollections Of Repetitive Self -Mutilators And Non-Self-Mutilators In A State Prison Population, Elena V. Merenova Jan 2001

A Comparison Of Early Childhood Recollections Of Repetitive Self -Mutilators And Non-Self-Mutilators In A State Prison Population, Elena V. Merenova

All-Inclusive List of Electronic Theses and Dissertations

The psychological disorder of repetitive self-mutilation represents a significant clinical problem. In spite of the growing interest in this problem, insufficiency of information does not allow listing self-mutilation as a separate disorder in DSM-IV. The present research was aimed to add to an understanding the phenomenon of self-mutilating behavior from the point of view of Adler's individualPsychology. The early childhood recollections (ERs) of 32 self-mutilators (SM) drawn from the population of the Wabash Valley Correctional Facility (WVCF) were compared to the ERs of 37 non self-mutilators (NSM) drawn from the same population. The participants completed the Demographic Questionnaire and the …
