Predictive Genetic Testing For Alzheimer's Disease In Long-Term Care Insurance, Mark A. Rothstein
Predictive Genetic Testing For Alzheimer's Disease In Long-Term Care Insurance, Mark A. Rothstein
Georgia Law Review
The promise of new genetic research is the ability to prevent, treat, and cure a wide range of physical and mental disorders-both monogenic and complex disorders. While astonishing progress has been made in gene discovery and the development of genetic tests, progress has been much slower in developing medicalinterventions. Consequently, there is likely to be a gap of varying and indetermi- nate time-lasting years or decades-between the ability to identify and predict genetic risk and the ability to prevent, treat, or cure the condition. The gap between the ability to predict genetic risk and the ability to ameliorate the risk …
Public Policy Implications Of Liability Regimes For Injuries Caused By Persons With Alzheimer's Disease, Edward P. Richards
Public Policy Implications Of Liability Regimes For Injuries Caused By Persons With Alzheimer's Disease, Edward P. Richards
Georgia Law Review
People in the United States and the developed world are living longer than ever before. While gains in the average life expectancy have been modest, these gains greatly underestimate the growth of the elderly population. Most of this elderly population is healthier and more active in everyday life than people of comparable age in decades past. The amelioration of many of the diseases of age has accentuated the problems of the chronic diseases for which there are no effective treatments. Perhaps the most devastating of these is Alzheimer's disease, a progressive dementia leading to incapacity and death. As discussed in …
An Analysis Of Quality Of Life, Income Distribution And Rural Development In West Virginia., James Obadiah Bukenya
An Analysis Of Quality Of Life, Income Distribution And Rural Development In West Virginia., James Obadiah Bukenya
Graduate Theses, Dissertations, and Problem Reports (ETD)
The term quality of life has been described as a vague entity (Grayson and Young, 1994) and conceptualizing it, has proved to be difficult. Nevertheless, understanding how individuals form their needs to create life satisfaction is important because these subjective evaluations determine life adjustment and mobility behavior and is the basis of demand for public actions. Additionally, more effective social programs can be designed based on the knowledge of how individuals form their needs to create life satisfaction and avoid problems that may result because the perceptions of the planners and policy makers do not always coincide with those of …
A Religious Conflict In Education: The King's College Controversy As A Historical Precedent To Separation Of Church And State, 1752-1756., Thomas Edward Carney
A Religious Conflict In Education: The King's College Controversy As A Historical Precedent To Separation Of Church And State, 1752-1756., Thomas Edward Carney
Graduate Theses, Dissertations, and Problem Reports (ETD)
The King's College controversy (1752-1756) was a battle for control of the first college in colonial New York. The historical experience of the province, from its founding by the Dutch until the 1750s, had generated an expectancy of religious freedom among the religious and ethnically diverse population. These people envisioned a non-sectarian college, but members of the Anglican church under the leadership of the Reverend Samuel Johnson (who would be the first president of the college) moved to exert control over the college. The opponents of the Anglicans, led by William Livingston, carried on an extensive attack on the Anglican …

Rocky Mountain National Park: History And Meanings As Constraints To African-American Park Visitation., Elizabeth B. Erickson
Graduate Theses, Dissertations, and Problem Reports (ETD)
The purpose of this study is to examine history and park meanings as constraints to visitation to Rocky Mountain National Park (RMNP) by the African-American community. Thirty-six one-hour interviews were conducted in Denver, Colorado with African-American participants who resided in the city. In addition eleven, fifteen-minute interviews were conducted with African-Americans while visiting Rocky Mountain National Park. Over the course of the interviews, participants discussed their current and past relationship with Rocky Mountain National Park, the meanings they ascribed to the park, and their perceived constraints to park visitation. Snowball sampling was used, the data was transcribed verbatim, and content …
An Expanded Model Of Adolescent Caregiving: Its Efficacy And Relation To Adolescent Problem Behavior., Lesley Anne Epperly Cottrell
An Expanded Model Of Adolescent Caregiving: Its Efficacy And Relation To Adolescent Problem Behavior., Lesley Anne Epperly Cottrell
Graduate Theses, Dissertations, and Problem Reports (ETD)
Despite annual fluctuations in the exact percentages of adolescents in the United States who are involved with problem behaviors such as alcohol consumption, unprotected sexual intercourse, and illicit drug use over the past decade, a large proportion of youth have been introduced to, and continue to engage in these behaviors. In response, researchers and clinicians have continued their search for variables that are correlated with adolescent risk involvement including variables within the family context. Previous research has linked parental monitoring (i.e., knowledge of an adolescent's whereabouts and activities) and parents' appropriate modeling of behaviors to reduced adolescent risk involvement. Problem …
Improving Medication Adherence For Children With Asthma: Objective Monitoring And Feedback As An Intervention For Inhaled Corticosteroid Use., Scott Allen Spaulding
Improving Medication Adherence For Children With Asthma: Objective Monitoring And Feedback As An Intervention For Inhaled Corticosteroid Use., Scott Allen Spaulding
Graduate Theses, Dissertations, and Problem Reports (ETD)
Nonadherence to asthma medication is a persistent problem. Contingency management has been used to improve pediatric compliance to inhaled corticosteroids. But token systems require time and attention to design and maintain, creating a challenge for busy outpatient clinics. The purpose of the present study was to evaluate the effectiveness of an intervention that might more easily be implemented by medical staff and parents: objective monitoring of medication use and feedback regarding errors in technique and compliance as an intervention to improve children's adherence to inhaled corticosteroids. Pediatric patients diagnosed with bronchial asthma for at least 6 months, receiving long-term corticosteroid …
An Application Of Complexity Theory To The Development Of Web-Based Education At A University In The United States., Daniel Nickles Huck
An Application Of Complexity Theory To The Development Of Web-Based Education At A University In The United States., Daniel Nickles Huck
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study examines the perceptions of higher education administrators concerning the activities related to the implementation of web-based education at a university in the United States during the 1990's. In pursuing an Orientational Qualitative Inquiry, I conducted ethnographic interviews during calendar year 2000 of academic affairs and information technology professionals, and I reviewed relevant documentation related to the university's web-based education efforts. I initially employed an a priori theoretical framework based on Loosely Coupled Systems Theory to guide my data collection, but my analysis of data led me to adopt Complexity Theory to adequately explain my findings. More specifically, I …

Graduate Theses, Dissertations, and Problem Reports (ETD)
The purpose of this study was to provide an accurate description of the status of middle schools in the state of West Virginia and to determine the relationship that exists between the degree of implementation of key middle level practices and school achievement level when controlling for school location, school size, student body socioeconomic status, and student body race/ethnicity. Seventy-eight West Virginia middle schools contributed data for the study. Each school principal completed the Survey of Middle School Implementation Levels, which was used to measure the degree of implementation of key middle level practices. School achievement data, aggregated to the …
Research Article Introductions In Thai: Genre Analysis Of Academic Writing., Chalermsri Jogthong
Research Article Introductions In Thai: Genre Analysis Of Academic Writing., Chalermsri Jogthong
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study presents an analysis of research article introductions (RAIs) written in Thai by Thai academic writers. The analysis is based on 40 Thai RAIs taken from Thai journals in educational and medical fields. The rhetorical characteristics and linguistic features of the RAIs are examined using the CARS model proposed by Swales (1990). The results show that the pattern of studied RAIs supports the general framework presented by Swales but the specific steps in the introductions are less consistent with the model. The Thai writers avoided criticizing and evaluating the works of others. They adopted different strategies in establishing a …
An Assessment Of The English-Language Needs Of Second-Year Thai Undergraduate Engineering Students In A Thai Public University In Thailand In Relation To The Second-Year Eap Program In Engineering., Patama Kittidhaworn
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study was to investigate the English-language needs of 182 second-year Thai undergraduate engineering students in a Thai public university in Thailand for their study in their second-year English program in engineering. A two-part self-assessment questionnaire was constructed based upon the previous research on the English-language needs of English as a Second Language (ESL)/English as a Foreign Language (EFL) students, particularly in Science and Technology in relation to English for Academic Purposes (EAP). The first part of the questionnaire asks for their demographic variables: gender, specialty, years of studying English in the school(s), and self-reported English proficiency in Listening, Speaking, …

An Investigation Of Teachers' Temperament And Students' Perceptions Of Teachers: Communication Behavior And Students' Attitudes Toward Teachers., Kristin Marie Valencic
Graduate Theses, Dissertations, and Problem Reports (ETD)
This study examined relationships among the way teachers communicate in the classroom, teachers temperaments, and perceptions of teachers by students. Specifically, the first goal was to determine to what extent a teacher's levels of extraversion, neuroticism, and psychoticism can predict students perceptions of task attraction, immediacy, assertiveness, responsiveness, and credibility. The second goal was to determine the relationships between teacher temperament and teacher evaluations, affective learning, and cognitive learning. Self-report surveys of 52 teachers and 1242 students across seven disciplines at West Virginia University were collected. Instructors received measures of extraversion, neuroticism, and psychoticism. Teachers were asked to rate themselves …
The Influence Of Supervision Training On Supervisor Self-Efficacy Among Doctoral Interns At University Counseling Centers., Sarah Jane Haley
The Influence Of Supervision Training On Supervisor Self-Efficacy Among Doctoral Interns At University Counseling Centers., Sarah Jane Haley
Graduate Theses, Dissertations, and Problem Reports (ETD)
A group of 145 clinical and counseling psychology doctoral students interning at APA-accredited university counseling center sites completed the Supervision Self-efficacy Questionnaire (SSQ) to determine differences in supervisor self-efficacy among different supervision training groups (e.g. no doctoral supervision course, a didactic supervision course, or a didactic-practicum supervision course) during their doctoral training. The SSQ was developed for this study; it was adapted from The Supervisory Focus and Style Questionnaire (SFSQ) (Yager, Wilson, Brewer & Kinnetz, 1989), which is based on Bernard's (1997) discrimination model of supervision. A one-way, between-subjects ANOVA found no significant differences in overall supervisor self-efficacy among the …

Team Player Styles, Team Design Variables And Team Work Effectiveness In Egypt, Ghada Awed Hassan El-Kot
Plymouth Business School Theses
The literature has revealed few studies of management in Arab countries in general and particularly in Egypt. Many Egyptian organisations implemented the team concept a number of years ago, however, there do not appear to be any studies investicitaýt inc",D team work effectiveness in Egypt. The literature review and the findings of a pilot study emphasised the need for empirical research in team work in Egypt. Team effectiveness models are examined in order to identify the factors that may enhance team effectiveness in Egypt. Team behavioural models are also examined to identify the importance of balanced team membership and its …
Desired Absence: A Woman's Perspective, Heather Dominick
Desired Absence: A Woman's Perspective, Heather Dominick
Theses
Humans are born either male or female depending on their sexual organs. While there are specific biological functions connected to those organs, it is society that assigns distinct, opposite behavioral standards, mores, and roles for each gender. These are portrayed as outgrowths of biological differences and considered normal. However, gender roles are socially constructed not biologically determined. My thesis work Desired Absence: A Woman's Perspective explores the themes of gender and violence using photography and video. The body of work includes two components; a series of seven silver gelatin mural sized photographs of the human face, and a single channel …

Criminal Theory In The Twentieth Century, George P. Fletcher
Criminal Theory In The Twentieth Century, George P. Fletcher
Faculty Scholarship
The theoretical inquiry into the foundations of criminal law in the twentieth century, in both civil and common law traditions, is assayed by the consideration of seven main currents or trends. First, the structure of offenses is examined in light of the bipartite, tripartite, and quadripartite modes of analysis. Second, competing theories of culpability – normative and descriptive – are weighed in connection with their important ramifications for the presumption of proof and the allocation of the burden of persuasion on defenses. Third, the struggle with alternatives to punishment for the control and commitment of dangerous but non-criminal persons is …
Nonlinear Dynamics In Psychology, Stephen J. Guastello
Nonlinear Dynamics In Psychology, Stephen J. Guastello
Psychology Faculty Research and Publications
This article provides a survey of the applications of nonlinear dynamical systems theory to substantive problems encountered in the full scope of psychological science. Applications are organized into three topical areas – cognitive science, social and organizational psychology, and personality and clinical psychology. Both theoretical and empirical studies are considered with an emphasis on works that capture the broadest scope of issues that are of substantive interest to psychological theory. A budding literature on the implications of NDS principles in professional practice is reported also.
Disclosure Norms, Eric L. Talley
Disclosure Norms, Eric L. Talley
Faculty Scholarship
The purpose of this Article is to interrogate the relationship between judicial error and extralegal norms more formally, focusing particularly on typical corporate disclosure contexts. In so doing, I shall argue that this relationship is far less clear-cut than much of the literature suggests. Using a formal, game-theoretic model of information disclosure, I demonstrate that in the presence of judicial error, a society that benefits from extralegal norms of honest disclosure might ironically favor more expansive legal regulation than would a similarly situated society in which norms are weak or nonexistent. Thus, in contrast to the common argument that norms …
The Methodological Commitments Of Contemporary Contract Theory, Jody S. Kraus
The Methodological Commitments Of Contemporary Contract Theory, Jody S. Kraus
Faculty Scholarship
Autonomy and economic theories of contract seem to provide incompatible accounts of contract law. In this Chapter, I argue that what appear to be first-order disagreements over particular contract doctrines are really implicit second-order disagreements reflecting the divergent methodological commitments of autonomy and economic theories. I argue that autonomy theories accord priority to the normative project of justifying existing contract doctrine, treat contract law as consisting in the plain meaning of doctrine, require contract theory to explain the distinctive character of contract law, and take the ex post perspective in adjudication. In contrast, economic theories accord priority to the positive …
Moral Pluck: Legal Ethics In Popular Culture, William H. Simon
Moral Pluck: Legal Ethics In Popular Culture, William H. Simon
Faculty Scholarship
Favorable portrayals of lawyers in popular culture tend to adopt a distinctive ethical perspective. This perspective departs radically from the premises of the "Conformist Moralism" exemplified by the official ethics of the American bar and the arguments of the proponents of President Clinton's impeachment. While Conformist Moralism is strongly authoritarian and categorical, popular culture exalts a quality that might be called "Moral Pluck " – a combination of resourcefulness and transgression in the service of basic but informal values. This Essay traces the theme of Moral Pluck through three of the most prominent fictional portrayals of lawyers in recent years …
Second Generation Employment Discrimination: A Structural Approach, Susan Sturm
Second Generation Employment Discrimination: A Structural Approach, Susan Sturm
Faculty Scholarship
The judiciary's traditional rule-based approach has been successful in reducing overt discrimination against women and people of color. It has been less effective in addressing more subtle and complex forms of workplace inequity. These second generation forms of bias result from patterns of interaction, informal norms, networking, mentoring, and evaluation. Drawing on the potential of recent Supreme Court decisions, Professor Sturm proposes a structural regulatory solution to this problem of second generation employment discrimination. Her approach links the efforts of courts, workplaces, employees, lawyers, and mediating organizations to construct a regime that encourages employers to engage in effective problem solving. …
The Rise Of Dispersed Ownership: The Roles Of Law And The State In The Separation Of Ownership And Control, John C. Coffee Jr.
The Rise Of Dispersed Ownership: The Roles Of Law And The State In The Separation Of Ownership And Control, John C. Coffee Jr.
Faculty Scholarship
Recent scholarship on comparative corporate governance has produced a puzzle. While Berle and Means had assumed that all large public corporations would mature to an end-stage capital structure characterized by the separation of ownership and control, the contemporary empirical evidence is decidedly to the contrary. Instead of convergence toward a single capital structure, the twentieth century saw the polarization of corporate structure between two rival systems of corporate governance:
- A Dispersed Ownership System, characterized by strong securities markets, rigorous disclosure standards, and high market transparency, in which the market for corporate control constitutes the ultimate disciplinary mechanism; and
- A …
