The Legitimacy Of Labor Unions, Peter Levine Jan 2001

The Legitimacy Of Labor Unions, Peter Levine

Hofstra Labor & Employment Law Journal

Labor unions do not have a well-understood rationale, as do capitalist enterprises, strictly voluntary associations, and democratic states. They are nonprofit associations, but also coercive economic agents; working-class communities, but also powerful special interests; embodiments of rights, but also incompatible with certain individual freedoms. These tensions result in an ambivalent legal status. For instance, unions may collect fees from (and negotiate contracts for) certain employees without obtaining their individual consent, yet no one can be required to belong to a union. Unions are exempt from antitrust laws and may restrain competition, but only in particular ways. We cannot assess these …

Diguise, Containment And The Porgy And Bess Revival Of 1952–1956, David Monod Jan 2001

Diguise, Containment And The Porgy And Bess Revival Of 1952–1956, David Monod

History Faculty Publications

Life in the cultural shallows tested the character of American art. Where the Depression had encouraged artists to engage in social and political criticism, the early cold war years constricted and confounded them. By conflating dissent and disloyalty, the triumphant conservatism of the cold war not only shifted the frame of cultural reference dramatically to the right, it narrowed it as well. This had a profound impact on America’s cultural establishment. With conservatives now in possession of the moral absolutes, the more politically progressive artists felt pressed into the position of endorsing ambivalence and moderation. The result, for many, was …

The Effects Of Funding For Development Of Early Care And Education Services On Employee Satisfaction, Sara A. Schoonover

Theses, Dissertations and Capstones

The purpose of this study was to investigate the effects of funding for the development of early care and education services on employee satisfaction. Overall, the employee job satisfaction among the three groups was not significant. However, there were six items that were found to have a significant difference among the three groups. The programs selected for funding were higher on some items of employee satisfaction and lower on other items than the other two groups. The funded groups were higher on fair treatment and recognition by supervisor. The funded group was lower on salary adequacy and benefit adequacy. The …

Quality Control, Enterprise Liability, And Distintermediation In Managed Care, Nicole Huberfeld, John V. Jacobi Jan 2001

Quality Control, Enterprise Liability, And Distintermediation In Managed Care, Nicole Huberfeld, John V. Jacobi

Law Faculty Scholarly Articles

In this article, the authors examine the potential of enterprise liability in light of current health-care finance realities. The article begins by addressing background issues of medical malpractice theory and the development of proposals for a form of plan-based enterprise medical liability centered on managed care organizations (MCOs). The authors then describe recent trends in the evolution of more loosely structured MCOs, including the emergence of "disintermediated," or patient-directed, plans. The authors examine the extent to which these developments weaken the rationales for plan-based enterprise liability. The article concludes nevertheless that plan-based enterprise liability best serves the goal of reducing …

Youth Livelihood Opportunities In Egypt, Safaa El-Kogali, Nagah Hassan Al Bassusi Jan 2001

Youth Livelihood Opportunities In Egypt, Safaa El-Kogali, Nagah Hassan Al Bassusi

Poverty, Gender, and Youth

This report presents results from a quantitative and qualitative study on youth livelihood opportunities in Egypt. The study was motivated by growing evidence of increasing unemployment among the young at a time when new entrants into the labor force are also increasing at unprecedented rates. Egypt has a youth population of over 13 million aged 15–24—over a fifth of the total population. They constitute the largest segment of the economically active population. Whether this bulge of young workers entering the labor force is a “demographic gift” or a “demographic burden” depends in large measure on the policies that are in …

An Analysis Of The Irs’S Voluntary Disclosure Policy, Allen Madison Jan 2001

An Analysis Of The Irs’S Voluntary Disclosure Policy, Allen Madison

Faculty Publications

When a taxpayer files a fraudulent return but amends it before the IRS begins a criminal investigation, the IRS has a long-standing policy that it will not refer that taxpayer to the Department of Justice for prosecution. This policy is known as the Voluntary Disclosure Policy. Such a policy allows taxpayers who have fallen off the tax rolls to get right with the government, which in turn helps the government by increasing revenues without the expense of investigation and enforcement. Over the Policy's history, the IRS has tinkered with it, at times keeping it in written form and at other …

Studying The Relationship Between Parental Involvement And Sternberg's Triarchic Theory Of Intelligence, Liliana Munoz Bailey

HIM 1990-2015

Extensive research has been conducted in the area of intelligence. Most of the research in this area has been focused on cognitive abilities. However, little research has been explored other type of intelligence and the environmental factors. The intent of this study was to investigate Sternberg’s Theory of Intelligence and parental involvement. According to this theory an individual’s intelligence is composed of three main domains: cognitive, creative and practical. Every individual possesses these abilities to a greater or lesser degree. Yet, little is known of what factors could lead to the difference in these types of abilities in individuals. Parental …

Administrative Strategies For Successful Adoption Of Computer Technology, Aitken E. Joan, Leonard J. Shedletsky Jan 2001

Administrative Strategies For Successful Adoption Of Computer Technology, Aitken E. Joan, Leonard J. Shedletsky

Journal of the Association for Communication Administration

The article offers strategies that university administrators may use for successful adoption of computer technology. A 1998 survey showed that two thirds of colleges failed to strategically plan their technological implementation. Administrators will want to seriously participate in strategic planning so that technology fits with other goals and expectations in the college or university. Technology use can be overwhelming, so both students and faculty need strong support for using technology. When equipment or connections fail in the middle of a class session, faculty need backup systems and support staff who can solve the technical problems. For success, administrators will want …

The participants in this study provide a breadth of information about the daily life of communication across the curriculum programs nationwide. Results of this study indicate the pulse of the movement is strong, yet there are still areas for growth. Increasingly, higher education scholars, faculty in other disciplines, and members of the public are calling for communication instruction and presenting new challenges for directors and scholars to address. The Renewal Of Insight: Exhibition Of Painting And Calligraphy, Chu Chen-Nan Jan 2001

The Renewal Of Insight: Exhibition Of Painting And Calligraphy, Chu Chen-Nan

Theses

The thesis, The Renewal of Insight: Exhibition of Painting and Calligraphy by Chu Chen-Nan, explores the intimate relationship between Chinese painting and calligraphy, emphasizing their shared origins and intertwined development. Chu Chen-Nan reflects on how Chinese calligraphy, with its expressive use of brush and ink, plays a crucial role in both artistic creation and the appreciation of visual arts. Drawing inspiration from traditional Chinese masters, Chu aligns his work with the idea that both painting and calligraphy emphasize qualities like structure, speed, and dignity, rather than solely focusing on representational accuracy.

Throughout the thesis, Chu explores the contrast and …

The Correlation Between Family Adaptability Scores And Adolescent Incarceration, Katherine P. Richard Jan 2001

The Correlation Between Family Adaptability Scores And Adolescent Incarceration, Katherine P. Richard

Theses

Adolescent crimes continue to climb in number and level of violence despite efforts to curtail them. Little research has been done on the impact of family interaction styles on adolescent crime. This study attempts to confirm or disconfirm the hypothesis that adolescents who are incarcerated are more likely to score their families as having a rigid family interaction style based on the FACES III adaptability scale than adolescents who are not incarcerated. The family adaptability scores of approximately 50 adolescents in a midwestern lock down facility were compared to those of approximately 50 students selected from a midwestern church and …

Fitness And The Elderly, David B. Mingo Jan 2001

Fitness And The Elderly, David B. Mingo

Theses

Statistics show the American population is aging at an explosive rate. The correlation between fitness and the aging process is once again becoming a ripe area for study. This category is comprised of seniors that range in age from 55- 65. This study focuses on the relationship between routine exercise and quality of life issues for the young-old. Subjects for this study were 15 retired military soldiers. Subjects were asked to complete a …

An Activity Book To Teach Primary Skills To Individuals And Families Through Fun Interventions, Toni D. Cole

Theses

This thesis will focus on a new intervention approach that teaches individuals and families the skills needed to cope with life in appropriate ways.

Throughout history there have been many therapeutic theories and approaches that have clinically addressed the issues facing today's individuals and families. Play therapy and the family preservation model are the two theoretical approaches this thesis explores as key components in the design of a new intervention approach that meets the needs of individuals and families in their own environment.

This thesis proposes play therapy techniques that can be utilized by paraprofessionals, taking the teaching approach to …
