Developing New Faculty: An Evolving Program, Gloria Pierce Jan 2001

Developing New Faculty: An Evolving Program, Gloria Pierce

To Improve the Academy: A Journal of Educational Development

This essay describes the evolution of a program for the development of new faculty at a public teaching university. The year-long process of orienting the newest professors to the campus and assisting them with their scholarship and teaching results in additional (albeit unplanned and unexpected) benefits, such as professional renewal of senior faculty who serve as advisors and enhanced functioning of the university itself. Vital to the program’s success is the productive involvement of key campus constituencies and responsiveness to feedback.

Strengthening Collegiality To Enhance Teaching, Research, And Scholarly Practice: An Untapped Resource For Faculty Development, Gerlese S. Åkerlind, Kathleen M. Quinlan Jan 2001

Strengthening Collegiality To Enhance Teaching, Research, And Scholarly Practice: An Untapped Resource For Faculty Development, Gerlese S. Åkerlind, Kathleen M. Quinlan

To Improve the Academy: A Journal of Educational Development

Collegiality lies at the intersection of various aspects of academic practice, including teaching as well as research. As such, assisting junior faculty in learning to build their collegial networks becomes a powerful point of intervention for faculty developers, even for those who focus on teaching development. Data from interviews with faculty engaged in both teaching and research, plus our experiences in conducting a series of career building initiatives are analyzed to identify junior faculty perceptions of the role of collegiality and barriers to establishing collegial ties. Two main barriers are identified: 1) knowing that collegiality and networking is important, and …

Faculty Quality Of Life, Sally S. Atkins, Kathleen T. Brinko, Jeffrey A. Butts, Charles S. Claxton, Glenda T. Hubbard Jan 2001

Faculty Quality Of Life, Sally S. Atkins, Kathleen T. Brinko, Jeffrey A. Butts, Charles S. Claxton, Glenda T. Hubbard

To Improve the Academy: A Journal of Educational Development

An interdisciplinary research team conducted a formal assessment of campus culture and faculty quality of life at Appalachian State University. Interviews with a stratified random sample of full-time, tenure-track faculty revealed five themes: 1) the importance of human relationships, 2) the deep commitment of faculty to student learning, 3)general satisfaction with academic life, 4) the personal sacrifice of faculty members for their work, and 5) perceptions of incongruence between institutional rhetoric and action. Recommendations are offered for readers to apply to their own universities to help faculty, staff, students, and administrators work together toward becoming an institution that is a …

Consensual Modifications Of The Rules Of Evidence: The Limits Of Party Autonomy In An Adversary System, John W. Strong Jan 2001

Consensual Modifications Of The Rules Of Evidence: The Limits Of Party Autonomy In An Adversary System, John W. Strong

Nebraska Law Review

In the Anglo-American legal tradition, we have a distinctive adversary system. The distinctiveness lies in its allocation to the adversaries in a dispute the basic responsibility for discovering, marshalling, and presenting the facts of the case to the decision maker, either judge or jury, rather than assigning these tasks to a nonpartisan official. Parties to litigation are, for the most part, given great latitude in the manner in which they choose to assert their rights in court. The rules of evidence, which are themselves part and parcel of the adversary system, generally also operate upon the principle of party responsibility. …

"Merchants Of Discontent": An Exploration Of The Psychology Of Advertising, Addiction, And The Implications For Commercial Speech, Tamara R. Piety Jan 2001

"Merchants Of Discontent": An Exploration Of The Psychology Of Advertising, Addiction, And The Implications For Commercial Speech, Tamara R. Piety

Seattle University Law Review

In this paper, I attempt to draw parallels between the psychology of commercial advertising and marketing and the psychology of addiction. Both appear to be characterized by denial, escapism, narcissism, isolation, insatiability, impatience, and diminished sensitivity. Advertising appeals to these impulses and addiction is marked by them. In what follows, I explore these parallels in general and then explore the potential consequences or side effects in three specific contexts: the advertising of addictive products, advertising and children, and advertising and women. In these three areas, there is some evidence that advertising may be contributing to negative social phenomena in a …

Affirmative Action, The Bell Curve, And Law School Admissions, Ryan Fortson Jan 2001

Affirmative Action, The Bell Curve, And Law School Admissions, Ryan Fortson

Seattle University Law Review

This Article will view the relationship between affirmative action and law school admissions through the lens of The Bell Curve, a book suggesting that a genetic link probably exists between race and intelligence. In The Bell Curve, Charles Murray and Richard J. Herrnstein conduct a statistical analysis on a variety of aptitude tests and other measures of intelligence, concluding that blacks and whites do differ on standardized tests of cognitive ability, even when controlling for such factors as motivation and socioeconomic status. Indeed, much of the book is geared toward discounting environmental explanations of intelligence scores. The relevancy …

The Wide World Of Torts: Reviewing Franklin & Rabin's Tort Law And Alternatives, Bernard W. Bell Jan 2001

The Wide World Of Torts: Reviewing Franklin & Rabin's Tort Law And Alternatives, Bernard W. Bell

Seattle University Law Review

In several respects, Franklin and Rabin's casebook provides a wonderful and effective vehicle for teaching torts, particularly to first-year students. The book develops important overarching themes while effectively presenting a wide variety of specific tort doctrines. The book also offers professors opportunities to sharpen students' legal abilities. In Part I of this review, I will discuss the first case in Franklin and Rabin's book and explain its usefulness in introducing several themes that both are critical to understanding tort law and assume a prominent place throughout the casebook. In Part II, I will focus on Franklin and Rabin's treatment of …

Torts Teaching: From Basic Training To Legal-Process Theory: Dominick Vetri, Tort Law And Practice, Joseph A. Page

Seattle University Law Review

It was in the course of my meanderings through the torts-casebook landscape that I came upon Professor Dominick Vetri's entry in the field. The quality that first attracted me was the way it fashioned a user-friendly introduction to the study of law, to the uniqueness of the common law, and to the centrality of process. The book demonstrated an unusual sensitivity to the bewilderment of beginners and made a special effort to anticipate their needs and concerns. Yet what made Vetri's approach particularly intriguing was that it managed to play not only to nervous neophytes, but also to students in …

Alvin W. Gouldner And Industrial Sociology At Columbia University, James Chriss Jan 2001

Alvin W. Gouldner And Industrial Sociology At Columbia University, James Chriss

Sociology & Criminology Faculty Publications

Alvin W Gouldner (1920-1980) was a prolific sociologist of the post-World War II era

who spent the early part of his career (the 1950s) in the field of industrial sociology. A

case study of Gouldner's early life and career is useful insofar as it intertwines with the

development of industrial sociology as a distinct subfield within sociology. Through this

analysis we are also better able to understand how and in what ways a burgeoning

organizational studies program developed at Columbia University during the 1940s. This

analysis of the historical and cultural contexts within which Gouldner came to prominence

as an …

Cost-Benefit Analysis And Relative Position, Cass R. Sunstein, Robert H. Frank Jan 2001

Cost-Benefit Analysis And Relative Position, Cass R. Sunstein, Robert H. Frank

Articles

Current estimates of regulatory benefits are too low and possibly far too low. This is because the standard economic approach to measuring costs and benefits, which attempts to estimate people's willingness to pay for various regulatory benefits, ignores a central point about valuation, thus producing numbers that systematically understate those benefits. Conventional estimates tell us the amount of income an individual, acting in isolation, would be willing to sacrifice in return for, say, an increase in safety on the job. But while these estimates are based on the implicit assumption that economic well-being depends only on absolute income, considerable evidence …

The Arithmetic Of Arsenic, Cass R. Sunstein Jan 2001

The Arithmetic Of Arsenic, Cass R. Sunstein

Articles

What does cost-benefit analysis mean, or do, in actual practice? When agencies engage in cost-benefit balancing, what are the interactions among law, science, and economics? This Article attempts to answer that question by exploring, in some detail, the controversy over the EPA's proposed regulation of arsenic in drinking water The largest finding is that often science can produce only "benefit ranges, " and wide ones at that. With reasonable assumptions based on the scientific data before the EPA at the time it made its initial decision, the proposed arsenic regulation can be projected to save as few as 0 lives …
