The Freedom To Link?: The Digital Millennium Copyright Act Implicates The First Amendment In Universal City Studios, Inc. V. Reimerdes, David A. Petteys Jan 2001

The Freedom To Link?: The Digital Millennium Copyright Act Implicates The First Amendment In Universal City Studios, Inc. V. Reimerdes, David A. Petteys

Seattle University Law Review

This Note focuses on the application of the Digital Millenium Copyright Act (DMCA) to prohibit the posting and linking of "circumvention technology" on the Internet, while also addressing the larger issue of the unintended consequences that regulating cyberspace can have on free expression. Because hypertext links play such a fundamental role in the utility of the Internet, this Note argues that the application of the DMCA's anti-trafficking provisions to enjoin linking places a significant and unwarranted burden on the Internet as a forum for free expression. Section II is intended to provide a brief background of the technological and legal …

Animal, Dairy, and Veterinary Science Faculty Publications

Despite intense efforts to increase vaccine coverage, measles virus (MV) still causes significant morbidity and mortality in the world, sometimes as the result of severe, chronic, lethal disease. In an effort to develop therapies to supplement immunization strategies, a number of 5′-nor carbocyclic adenosine analogues were evaluated for anti-MV activity in CV-1 monkey kidney cells. Of those compounds tested, those either unsubstituted at C4 or possessing a hydroxyl, azido or amino substituent at that position were the most active, with particularly significant inhibition of MV, strain Chicago-1. The EC50 values against this strain ranged from100 mg/ml in actively growing and …

Elihu Root And Crisis Prevention, Mary Ellen O'Connell Jan 2001

Elihu Root And Crisis Prevention, Mary Ellen O'Connell

Journal Articles

Elihu Root pursued two themes relevant to international law and crisis. He believed firmly in the value of arbitration and adjudication to prevent crisis. He also worked toward the codification and greater specificity of international law so that judges and arbitrators would have more law available to apply in aid of crisis prevention. When crisis had not been prevented, as in the case of World War I, Root did not in fact believe international law-either process or substance-had much to offer. In his view, the Kaiser started World War I because he was bent on hegemony. Arbitration would not stop …

Harm And Repair: Observing Restorative Justice In Vermont, David R. Karp Phd

School of Leadership and Education Sciences: Faculty Scholarship

This paper analyzes the decision-making process for negotiating reparative contracts with offenders in a restorative justice model. Based on a content analysis of videotaped Com-munity Reparative Board meetings with probationers in Vermont, this paper (a) defines restoration as a core concept in restorative justice; (b) examines how boards identify harm to victims and community; (c) how they identify strategies to repair identified harm; (d) how often repair becomes a line item in reparative contracts; and (e) offers in-terpretation for situations in which harm is not identified and/or not repaired.

David Versus Goliath: A Law School Debate About Bush V. Gore, H. Lee Sarokin Jan 2001

David Versus Goliath: A Law School Debate About Bush V. Gore, H. Lee Sarokin

San Diego Law Review

For the first time in America’s history, the Supreme Court has, in effect, selected the President of the United States. The case was analogous to a claim that a jury verdict was tainted. The Court, in this instance, knew who would win if the verdict was permitted to stand, and who was likely to win if the jury was permitted to continue its deliberations. It was this knowledge that made the decision so sensitive and challenged the integrity and the role of the Court so profoundly.

Gender Roles And Science Beliefs And Their Relationship To Science Interest, Judith Jean Paolucci Jan 2001

Gender Roles And Science Beliefs And Their Relationship To Science Interest, Judith Jean Paolucci

Open Access Dissertations

This study investigated adolescents' views about the nature of science (NOS) and conceptions of their gender identities, and revealed whether these conceptions and views are related to their science interest. Participants were 566 high school students enrolled in chemistry courses at three high schools in a New England state. A questionnaire was used to assess participants' science interest, gender role perceptions, and views about science, as well as to provide background and math and science achievement data. The study found that while student scores of NOS understanding did not differ by gender, some significant differences were noted on the student …

Leading The Assembly Is Pastoral, Virgil C. Funk Jan 2001

Leading The Assembly Is Pastoral, Virgil C. Funk

Institute of Liturgical Studies Occasional Papers

(Excerpt)

I should begin, I think, by explaining a bit about what I mean by "pastoral" when we speak about leading the assembly. We got a phone call once at the National Association of Pastoral Musicians from a scholar who was researching the folk music of Greek shepherds, and he thought that we might be of some help, since we are also interested in things "pastoral." That isn't the "pastoral" that I have in mind! Instead, my vision of pastoral leadership is rooted in the story at the end of John's gospel where Jesus asks Peter three times, "Simon, son …

The Grace Of Leading The Assembly, Gabe Huck Jan 2001

The Grace Of Leading The Assembly, Gabe Huck

Institute of Liturgical Studies Occasional Papers

(Excerpt)

It is good in nearly every Christian liturgy there comes a moment when all present pray to be forgiven just as they are themselves now offering forgiveness. Thus do assemblies and presiders provide a ground for meeting again next Sunday and giving it another go.

Cadmium Toxicity And Random Motility Studies Using Marine Dinoflagellates, Edwin Li Jan 2001

Cadmium Toxicity And Random Motility Studies Using Marine Dinoflagellates, Edwin Li

Open Access Dissertations

The marine biota is exposed to heavy metal residues of industrial and agricultural processes. The effects of these metals on phytoplankton are of particular interest because they represent the first link in the food chain and are able to transfer the metal to higher trophic levels. Members of the phytoplankton population include the diverse community of flagellated unicellular, mostly photosynthetic, microorganisms called dinoflagellates. The effects of cadmium (Cd) on the growth of two marine dinoflagellates Scrippsiella narragansettensis and Heterocapsa triquetra were measured under different medium composition. To investigate the role of metal speciation, experiments were carried out in media prepared …

Scholars and philosophers spend much of their time discussing what pornography means and whether it can be defined. This debate persists despite the fact that most men, regardless of their sexual orientation, seem to understand quite well what pornography is, and what it is for: they produce it commercially, buy it in magazines, rent it in videos, and search for it on the Internet. The pornography industry has the distinct advantage of selling a product that, in legal terms, is considered "expression," and therefore a product that has been declared worthy of constitutional protection under section 2(b) of the Canadian …
