Preliminary Reflections On The Professional Development Of Solo And Small Law Firm Practitioners, Leslie Levin Jan 2001

Preliminary Reflections On The Professional Development Of Solo And Small Law Firm Practitioners, Leslie Levin

Faculty Articles and Papers

Solo and small law firm practitioners have long been regarded as marginal, unmentored, unethical and inadequately trained members of the legal profession. Yet technological advances and demographic changes in this segment of the bar suggest reasons for re-examining this view. In an effort to gain a clearer understanding of the current state of the professional development of these lawyers, 41 solo and small firm practitioners in the New York City metropolitan area were interviewed about their work lives and professional development. The questions posed were designed to explore how, if at all, office settings, mentors and other colleagues contribute to …

The Academic Support Student In The Year 2010, Leslie Yalof Garfield Jan 2001

The Academic Support Student In The Year 2010, Leslie Yalof Garfield

Elisabeth Haub School of Law Faculty Publications

Academic support professionals have long recognized the benefits of imparting a greater knowledge of learning skills to law students as a way to enhance their ability to learn the law. Consequently, the science and pedagogy of academic support have become a staple of legal education. However, while the need for academic support remains a constant, the identification of those in need of academic support programs continues to be in flux. Growing social awareness of an expanded definition of diversity, recent decisions such as Hopwood v. Texas and the proliferation of academic support programs have expanded the definition of the academic …

Deja Vu All Over Again, Gary A. Munneke

Legal Skills For A Transforming Profession, Gary A. Munneke Jan 2001

Legal Skills For A Transforming Profession, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

The legal profession is undergoing dramatic changes that will drive a reformation in legal education. Legal educators must anticipate these changes to effectively prepare students for the practice of law in the twenty-first century. In order to be proficient practitioners, these students will require an expanded set of professional skills. Although the current legal skills paradigm was articulated by the American Bar Association MacCrate Task Force in 1991, it is time to reexamine legal skills with an eye toward preparing students to practice law in the new millennium. In Section II, this article examines trends in modern society and the …

The Problem With Innocence, Margaret Raymond Jan 2001

The Problem With Innocence, Margaret Raymond

Cleveland State Law Review

Pursuing justice for the wrongfully convicted is a profoundly meaningful goal. Yet the innocence movement may have unintended consequences for the criminal justice system. This paper explores some of these, and argues that the focus on factual innocence may create certain distortions in the way that actors in the criminal justice system---the "ones left behind"--perceive their obligations and allegiances. It may convince the public, including policymakers, that the system works effectively to reveal and redress wrongful convictions. It may convince prospective jurors that it is-or should be-the defendant's burden to prove innocence. It may convince potential criminal defense clients that …

The Federal Income-Contingent Repayment Option For Law Student Loans, Philip G. Schrag Jan 2001

The Federal Income-Contingent Repayment Option For Law Student Loans, Philip G. Schrag

Georgetown Law Faculty Publications and Other Works

Many idealistic law school graduates feel precluded from taking legal aid and other low-paying public service jobs because they have incurred high educational debt, often exceeding $100,000. In 1993, however, Congress created an "income-contingent" debt repayment option that was intended to enable high-debt, low-income graduates, including lawyers, to afford accepting public service positions. This program caps loan repayments at a reasonable percentage of the graduates' incomes, and it forgives any remaining balance at the end of twenty-five years. To date, this program has failed to meet the needs of public interest lawyers. It is rarely used. Law students are largely …

Full Legal Representation For The Poor: The Clash Between Lawyer Values And Client Worthiness, Michelle S. Jacobs

UF Law Faculty Publications

This article seeks to expand the scope of our understanding of values and their connection to the work of poverty lawyers. The article explores the literature on poverty and moral worthiness. In order to bring clarity to the discussion, it examines social science research on defining "values" and detailing how they can affect behavior. Prof. Jacobs describes the reactions of clinical students to a classroom exercise, which asked them to describe the legal representation they would provide to hypothetical clients. This article describes how the link between students' values and broader societal beliefs affect the practices of the bar and …

Fordham Urban Law Journal

This Comment evaluates New York City’s framework for assigning counsel to Family Court litigants, known as the 18-B system. Recognizing the lack of government support for 18-B attorneys, the author examines existing proposals to alter the Family Court system, and suggests a plan of action for a legislative task force. The Comment outlines the evolution of the assigned counsel system in New York and the history of child welfare policy, and discusses the roles of the Family Court attorneys, judges, and the legislature in maintaining adequate representation for parents. Next, the author examines the aspects of the Family Court and …
