Shooting For The Stars: American Gun Advertising And Technology During The Cold War, Angela R. Frye Jan 2001

Shooting For The Stars: American Gun Advertising And Technology During The Cold War, Angela R. Frye

Theses, Dissertations and Capstones

Advertising has existed in various forms for centuries. Although it has become almost a science today, marketing to consumers through the use of advertisements has ancient origins. Initially, advertising appeared in vocal form, with town criers and barkers, to a few printed signs, which were dated as far back as the Roman Empire’s advertisements for gladiator events. Historians believe that the first English language advertisement was a handbill created by William Claxton in 1478, for one of the books he printed. These handbills became increasingly sophisticated over time and essentially formed the basis of modem print advertising. Their value in …

Negotiating A Labyrinth: Uncovering Meaning Through Biography, Floretta Thornton-Reid Jan 2001

Negotiating A Labyrinth: Uncovering Meaning Through Biography, Floretta Thornton-Reid

Perspectives In Learning

Biographical method is one of “several intellectual disciplines that make use of life writing” (Smith, 1994, p. 286). However, biographies are probably better described as an interdisciplinary methodology that incorporates several approaches to qualitative research including but not limited to life history, narrative analysis, case study, historical social science, grounded theory and ethnography (Marshall & Rossman, 1999; Riessman, 1993; Atkinson, 1998). In laymen’s terms, a biography can be understood as the written history of a person’s life. Thus the life history or narrative story of a person is a key biographical concept. Controversy has long surrounded life history. Runyan (1982a) …

The Specter Of Salem In American Culture, Gretchen A. Adams Jan 2001

The Specter Of Salem In American Culture, Gretchen A. Adams

Doctoral Dissertations

The specter of Salem witchcraft haunts the American imagination. No other historical event has provided such a wide range of scholars, dramatists, fiction writers, poets, and amateur sleuths with a subject that so stubbornly resists a final resolution. Although barely nine months passed from the first accusations of witchcraft to the last, those nine months of accusations, confessions, denials, trials, and executions have spawned a vast literature which for 300 years has sought to fix blame or find reason for the ordeal of the witch trials of 1692. The Specter of Salem in American Culture examines this persistent interest by …

The Neglected History Of The Prior Restraint Doctrine: Rediscovering The Link Between The First Amendment And The Separation Of Powers, Michael I. Meyerson Jan 2001

The Neglected History Of The Prior Restraint Doctrine: Rediscovering The Link Between The First Amendment And The Separation Of Powers, Michael I. Meyerson

All Faculty Scholarship

The prior restraint doctrine, once so fundamental to Constitutional Jurisprudence, has lost much of its effectiveness over the years. Nevertheless, prior restraint doctrine is crucial to preserving the line between protected and unprotected speech. One of the fundamental problems that contribute to the current ineffectiveness of prior restraint doctrine is that there exists no comprehensive definition of "prior restraint". This article chronicles the historical roots of prior restraint in order to arrive at a generally accepted legal definition. Through the course of this historical journey, the article yields a heretofore unexplored aspect of prior restraint doctrine, namely that prior restraint …

Nurturing In The Service Of White Culture: Racial Subordination, Gestational Surrogacy, And The Ideology Of Motherhood, April L. Cherry

Law Faculty Articles and Essays

I approach the question of race, motherhood, and gestational surrogacy, by looking at courts' opinions in the case of Johnson v. Calvert and the racialized institution of motherhood. In the next section, I discuss motherhood as a social institution. I contrast some of the radical feminist critiques of motherhood, which recognize motherhood as institutionalized and compulsory, with Black feminist criticism, which understands motherhood as a site of power for African-American women. In Section III, I discuss the current popular understanding of the cultural and legal dictates of institutionalized motherhood from a historical perspective, focusing on the late eighteenth and early …

Introduction, Utah Law Review

Utah Law Review

On behalf of the Utah Law Review, I would like to welcome you to this year's Law Review Symposium and to offer a few comments that I hope will set the stage for today's presentations. This should be a wonderfully engaging and entertaining event and we are proud to support the growth of an area of legal scholarship that we anticipate will be incredibly influential and fruitful in the coming years. These papers collectively take an historical approach to classic legal cases. As such, they confront us with the question: why undertake an historical approach to legal studies?

Sources Of Empowerment For Native American Women: Pomo Women's Critical Reflections, Heidi F. Morgan Jan 2001

Sources Of Empowerment For Native American Women: Pomo Women's Critical Reflections, Heidi F. Morgan

Doctoral Dissertations

The main purpose of this study was to explore from the perspective of Pomo women, the sources of empowerment that enabled them to overcome oppressive experiences in their lives. Through the process of participatory research, the participants were asked to identify strategies or factors that enabled them to overcome those oppressive barriers in an empowering instead of selfdestructive manner. Participants were also asked to name existing problems young Native American women face today, utilizing Paulo Freire's (1994a) approach of problem posing and action.

The women then discussed what guidance they would offer to young Native Women struggling with issues like …

"Encourager Le Commerce Et Répandre Les LumiʹEre" : The Press, The Provinces And The Origins Of The Revolution In France: 1750-1789, Stephen Auerbach

LSU Doctoral Dissertations

This dissertation examines the political, intellectual, and cultural significance of France's provincial newspaper press, called affiches, published between 1750-1789. Combining the histories of the press, provincial life, and the public sphere, this dissertation explores the ways in which the affiches became an indispensable part of local economic, cultural, and intellectual life while at the same time articulated a world view that was antithetical to the tenets of monarchical absolutism. The first part of the dissertation focuses on the origins, form and contents of the provincial press. Faced with the twin obstacles of laws governing censorship and privilege, provincial newspapers eschewed …

Listening For A Change: The Courts And Oral Tradition, John Borrows

Osgoode Hall Law Journal

Aboriginal oral history is a valuable source of information about a people's past. It can constitute important evidence as proof of prior events, and/or it can shed light on meanings groups give to their past. Despite its value, however, oral tradition presents particular challenges of admissibility and interpretation because of its unique source and transmission. This article outlines and discuses these challenges and suggests various approaches to better understand the insights contained within aboriginal history.

Aha? Is Creativity Possible In Legal Problem Solving And Teachable In Legal Education?, Carrie Menkel-Meadow Jan 2001

Aha? Is Creativity Possible In Legal Problem Solving And Teachable In Legal Education?, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

This article continues and expands on my earlier project of seeking to describe how legal negotiation should be understood conceptually and undertaken behaviorally to produce better solutions to legal problems. As structured problem solving requires interests, needs and objectives identification, so too must creative solution seeking have its structure and elements in order to be effectively taught. Because research and teaching about creativity and how we think has expanded greatly since modern legal negotiation theory has been developed, it is now especially appropriate to examine how we might harness this new learning to how we might examine and teach legal …

The Institutional Production Of Literary Value: Studies Of African-American Popular Music Lyrics And The Avant-Garde., Carl Silvio Jan 2001

The Institutional Production Of Literary Value: Studies Of African-American Popular Music Lyrics And The Avant-Garde., Carl Silvio

Graduate Theses, Dissertations, and Problem Reports (ETD)

Recent decades have witnessed series of debates over the nature of the texts studied by literary studies. Some argue that the literary text is first and foremost defined by its aesthetic value, while others claim that the discipline should regard its object as a social document which reveals information about the society that produced it and exerts an ideological effect upon its cultural context. These debates, between what are usually termed “traditional” and “cultural studies” approaches to literature reveal a central contradiction that has divided the discourse of aesthetic value since its formulation in the Eighteenth century. The question of …

Islam, Indigenous Traditions, And Adventism In Kenya: A Comparative Study To Determine Effective Approaches To Evangelize Kenyan Muslims, Joseph Kilonzo Jan 2001

Islam, Indigenous Traditions, And Adventism In Kenya: A Comparative Study To Determine Effective Approaches To Evangelize Kenyan Muslims, Joseph Kilonzo

Doctor of Ministry Projects

Problem

Islam is spreading speedily in Kenya from the coast and the north towards inland areas, converting great number of persons and communities. The Islamic influence is evident in almost all spheres of life in the country, including social, political, economical, and spiritual. Muslims are particularly hard to reach with the gospel. However, this does not mean the task of reaching them is unsurmountable. The task of this project, therefore, was to provide a biblical, theological, and missiological strategy for presenting the gospel to Muslims in Kenya with the view of winning them over to Christianity (Adventism).

Method

The research …

"Just As Good As They Are": Voices Of Contemporary Women Involved In Farming And Ranching In North Dakota, Heidi L. Dyrstad

Theses and Dissertations

The purpose of this study was to examine the current experiences of women involved in farming and ranching in North Dakota. Specifically, women from across the state of North Dakota were interviewed to further our understanding of their lives as they experienced and reacted to the changing nature of agriculture. Interviewing was employed as the primary method of investigation to allow the women's voices to be conveyed directly to others.

Through analysis based in grounded theory methodology, three descriptive assertions emerged from the interview data, and they are as follows: (1) The women involved in farming and ranching in this …

"Give It All Up And Follow Your Lord": Mormon Female Religiosity, 1831-1843, Janiece L. Johnson

Theses and Dissertations

Since the 1750s American women have flocked to churches. Women have consistently been the majority in church populations. Religion was the central motivation of the female life experience. Likewise, women comprised a significant portion of the membership of The Church of Jesus Christ of Latter-day Saints in its first decade. There exists little historical analysis of the contribution and experience of these women as a whole. As a result of this lack of research some historians have made erroneous assumptions of patriarchal oppression and a lack of commitment on the part of early Mormon women. This project closely examines the …
