Disability, Equal Protection, And The Supreme Court: Standing At The Crossroads Of Progressive And Retrogressive Logic In Constitutional Classification, Anita Silvers, Michael Ashley Stein

University of Michigan Journal of Law Reform

This Article compares current disability jurisprudence with the development of sex equality jurisprudence in the area of discrimination. It demonstrates that current disability law resembles the abandoned, sexist framework for determining sex equality and argues that disability equality cases should receive similar analysis as the more progressive, current sex equality standard. As such, the Article attempts to synthesize case law (14th Amendment Equal Protection jurisprudence) and statutory law (Title VII and the ADA) into a comprehensive overview of the state of current disability law viewed within the context of discrimination law in general.

Civil War Pension Attorneys And Disability Politics, Peter Blanck, Chen Song

University of Michigan Journal of Law Reform

Professor Blanck and Dr. Song provide a detailed examination of the pension disability program established after the Civil War for Union Army Veterans. They use many original sources and perform several statistical analyses as the basis for their summary. They draw parallels between this disability program and the ADA, and they point out that current ADA plaintiffs encounter many of the same social, political and even scientific issues that Union Army veterans dealt with when applying for their disability pensions. Comparing the law and policies of other countries concerning disability rights to ours can help us understand how we may strengthen those rights and heighten compliance with nondiscrimination laws. Since it took effect in 1992, the Americans with Disabilities Act (ADA) has been a leading example of such comprehensive legislation on behalf of people with disabilities. Along with the United Nations Standard Rules on Equalization of Opportunities for Persons with Disabilities, the ADA has inspired many countries to develop their own disability nondiscrimination laws and remedial agencies. This process must work in both directions, however, and laws and agencies from …

This study examines the transportation of hazardous materials through Washington County, Tennessee. This study incorporates federal, state, and local data in assessing current transportation trends. Data gathering activities included local chemical inventories, hazardous materials transportation flow surveys, hazardous materials rail transportation trends, and hazardous materials incident data.

All data were compiled and then analyzed to identify hazardous materials transportation trends in Washington County, Tennessee. This information is pertinent to emergency planners for the preparation of hazardous materials transportation incidents. A Meta-Analysis And Risk Assessment Of Heavy Metal Uptake In Common Garden Vegetables., Trent David Lecoultre

Peer reviewed literature was searched to identify research pertaining to the uptake of heavy metals (As, Cd, Pb and Zn) by vegetables (cabbage, carrot, lettuce, and radish). The objectives of this research were to 1) determine the relationship between heavy metal concentrations in the soil and heavy metal concentrations in vegetables, and 2) determine the level of risk associated with exposure to heavy metals through ingestion of contaminated vegetables. Highly variable estimates and biologically implausible regression equations resulted from this meta-analysis. Exposure to arsenic through the ingestion of lettuce grown on contaminated soil significantly increases cancer risk, especially in children. …

Examining The Effects Of Deer Antler Velvet Supplementation On Muscular Strength, Performance, And Markers Of Delayed Onset Muscle Soreness., Robyn Suzanne Percival

Purpose: To examine the effects of deer antler velvet on muscular strength, performance, and markers of delayed onset muscle soreness following a 10-week resistance training period.

Participants: 16 resistance-trained males (18-35) volunteered.

Measures: DEXA, 1-RM, a power test, and a 70% performance trial were measured. Creatine kinase and self-reported soreness levels were measured following an eccentric trial.

Results: No pre-experimental significant differences existed between the groups for any of the variables measured. There were no significant differences between the groups regarding body composition, strength, muscular performance, or improvements in creatine kinase and soreness levels from pre to post-intervention. Comparison Of Black And White Elderly Women On Muscle Mass Bone Mineral Density And Balance., Tyanez Jones

Few studies have compared balance between aging black (BW) and white women (WW) and examined its relationship to muscle mass and bone mineral density (BMD). Nineteen BW and 56 WW between 60-91 years participated. Upper and lower body strength, body composition, BMD, volitional and non-volitional control of dynamic balance, and physical activity ratings were assessed. There were no differences in strength between the groups. A trend was reported for total body BMD (p=0.07). WW exhibited better control of rapid volitional movements, in the limits of stability and rhythmic weight shift tests. The relationships of strength and muscle mass to BMD …

Spatial And Temporal Analysis Of Radial Growth In An Appalachian Watershed, Desta Beyene Fekedulegn

This dendrochronological study used dated and measured tree-ring data to examine relationships between radial growth and climate for four hard wood species, yellow-poplar, northern red oak, chestnut oak and red maple, growing on contrasting topographic aspects of a watershed in north-central West Virginia.;The study showed that all species except northern red oak showed significant differences in growth between the mesic and xeric aspects. Where significant differences were found all except chestnut oak exhibited higher growth rates at the mesic aspect.;Yellow-poplar showed a sharp decline in growth from late 1950's to late 1960's, which was evidently caused by several years of …

The Efficacy Of Residential Care In The Management Of Serious Mental Illness, Lori A. Shaleen

The present study contributes to a growing database demonstrating the efficacy of residential treatment care for individuals diagnosed with serious mental illness. This study is distinguished by its longitudinal collection of data at two-month intervals over an eight-month study duration. Nine individuals residing at a supportive residential care facility (Harvest Homes) were compared with 18 others receiving team-based outpatient case management mental health services (Prairie Harvest Foundation) over an eight- month period. Eighty-nine percent Prairie Harvest Foundation group and seventy-eight percent of the Harvest Home group were diagnosed with psychotic conditions. In his paper, "Ezra Pound's Comparative Poetics," Naikan Tao concentrates on Pound's theories regarding comparison and examines the significance of his comparative studies to the formulation of his poetics, an aspect that has not been sufficiently investigated. On the basis of Pound's work, Tao observes that the conception of comparison Pound shaped through his comparative studies is the internal principle that governs the presentation of details and particulars, the method Pound advocated as a reader-oriented approach to truth and as an efficient, self-reliant means to avoid others' generalization and discursive presentation. Serving The Homeless: Evaluating The Effectiveness Of Homeless Shelter Services, Robert L. Fischer

The effects of homeless assistance services at the local level are tremendously difficult to ascertain. In this study, a four-month sample of homeless persons served by a local homeless shelter and case management program were contacted nine to eleven months after receiving services. The findings suggest that the program had some initial success in assisting the homeless clients to locate housing within the first year after leaving the shelter. However, the housing costs paid by these formerly homeless were quite high, with nearly three-quarters of them spending forty percent or more of their income on housing.

Fetal Alcohol Syndrome (FAS) labels children with physical, mental and behavioral deficits exposed to alcohol in utero. Current research indicates that timing of alcohol exposure of the embryo/fetus is a critical determinant of the behavioral deficits associated with FAS. This study represents a model for binge drinking, in which C57BL mouse embryos were exposed to alcohol during 2 separate critical periods of brain development, gestational day (GD) 7 or 8. As adults, the offspring were tested to determine if loco-motor activity and emotional reaction to a novel environment had been affected. Significant differences due to treatment and sex were …

Streets play a significant role in shaping the quality of built environment. The arrangement of street space and buildings is important in defining the visual character of a neighborhood and determining the behavior of traffic moving through a neighborhood. Some streets create a sense of place by visually tying the buildings and street space together whereas others appear to be just traffic thoroughfares and disconnected with the buildings fronting on them. In his paper, "Western Culture and the Ambiguous Legacies of the Pig," Benton Jay Komins provides a cultural lineage of the pig by the example and reading of Piggies by the Beatles. Komins observes that Piggies enacts the possibilities of the ubiquitous pig in Western culture by juxtaposing swinish antics with interpretations of limitation and heartbreak thereby forcing listeners to blur the distinctions between struggle, unrequited love, and boorishness. The relationship between acculturation level and patient satisfaction among adult Mexican American emergency department patients was explored. Acculturation level was determined by the Acculturation Rating Scale for Mexican Americans-II (ARSMA-II). Patient satisfaction was measured with the Patient Satisfaction Inventory (PSI). The study was conducted in an emergency department in the Lower Rio Grande Valley of South Texas, where 23 participants provided the data. The questionnaires were offered in English and Spanish. The independent variable of acculturation level did not demonstrate a significant relationship with the dependent variable of patient satisfaction.
