This comment seeks to apply contemporary pre-emption jurisprudence to the area of federal purchasing specifications. The piece first lays the foundation of pre-emption, and more specifically discusses its inception and maturation, and then provides an analysis of how courts should apply these principles today. Next, the piece introduces federal purchasing specifications, specifically the specification governing the government's acquisition of ambulances. Malnutrition In Children With Congenital Heart Defects, Poothirikovil Venugopalan, Felix O. Akinbami, Khalid M. Al-Hinai, Ajit K. Agarwal

OBJECTIVE: To assess the frequency of malnutrition in children with congenital heart defects in a hospital outpatient setting. METHODS: One hundred and fifty-two children with congenital heart defects (patients), and an equal number of children with innocent cardiac murmurs (controls) attending the Pediatric Cardiology Outpatient Clinic at Sultan Qaboos University Hospital, Muscat, Oman from 1997 to 1998 were prospectively studied. Weight, height and head circumference were used for evaluation of nutritional status. Patients and controls were categorized into acute malnutrition (weight <3rd percentile for age, and height >3rd centile), and chronic malnutrition (weight and height <3rd centile), based on the National Centre for Health Statistics standards. Children with symptomatic congenital heart defects (Group I, number = 73) were also compared with those without symptoms (Group II, number = 79). RESULTS: The study patients showed a higher frequency of both acute (27%) and chronic (24%) malnutrition (p<0.01). Children in Group I had a significant reduction in weight (p<0.01), height (p=0.02) and head circumference (p<0.01) compared to controls, however for those in Group II the differences were not significant. Acute malnutrition was higher in both groups, 31% (p<0.01) and 16% (p=0.04), whilst chronic malnutrition was significantly higher only in Group I, 31% (p<0.01). Infants in Group I were more frequently affected (33/45) compared to older children (13/28; p=0.02). CONCLUSION: Malnutrition remains a problem among children with congenital heart defects, especially in those with either heart failure or cyanosis, and symptomatic infants are the worst affected. Greater attention is required in the dietary management, early diagnosis and intervention to restore normal growth.

Ktp-Laser And Fibrin Glue For Treatment Of Fistulae In Ano, Aws S. Salim, Talal M. Ahmed

Fistulae-in-ano remains a significant surgical problem due to the limitations pertinent to accurate assessment and the magnitude, shortcomings and side effects of the various procedures currently employed for their management. Six consecutive fistulae-in-ano patients (males, age range 30 to 58 years) were successfully treated by KTP laser (20-watt continuous aim for 20 to 30 seconds delivering a total energy of 400 to 600 joules) with rapid solidification fibrin glue then followed up for 3 months without recurrence. This approach offers a simple, expeditious and effective treatment for fistulae-in-ano thereby overcoming many of the restrictions associated with other methods.

This piece argues that judicial interpretation of 720 ILCS 5/12-4(b)(8) (1997) of the Illinois Criminal Code, the statute which enhances simple battery to aggravated battery, has opened the door for the abuse of prosecutorial discretion in applying the statute and has led the courts away from its true legislative intent. Specifically, the application of the statute has been overbroad and courts' interpretations of the legislative intent have been far-reaching. Adjustment Personality Trait And The Process Of Grieving Among Parents Who Have Had Children Die Of Sids, Agnes Melissa Ibanez

The research examines emotional adjustment personality trait as related to intensity of grief experienced by parents who have had a child die of SIDS (Sudden Infant Death Syndrome). The NEO-Five Factor Inventory (NEO-FFI) neuroticism scale measured emotional adjustment trait, and Perinatal Grief Scale (PGS) measured grief intensity. Thirty-three participants from 18 states were recruited via SIDS Alliance and SIDS Network websites. Results supported the hypothesis that there is a direct significant correlation between emotional adjustment and grief experiences. Other results showed that grief intensity was inversely correlated with years since child’s death, conscientiousness, and extraversion. Conscientiousness was found to directly …

Activation of p38 kinase by osmotic stress has been documented in many cells; however, no report has distinguished the effects of cell volume on p38 activity from the effects of the altered osmotic condition per se. Here we report asymmetrical activation of astrocyte p38 mitogen-activated protein (MAP) kinase in response to volume increases and volume decreases. We separate effects of cell volume changes from the effects of osmotic exposure on p38 activation. Exposure to 400, 500, or 600 mOsm phosphate-buffered saline (PBS) caused cell shrinkage and an osmolality-dependent increase in p38 activity to 175%, 409%, or 518%, respectively, compared with …

Probability Neglect: Emotions, Worst Cases, And Law, Cass R. Sunstein

When strong emotions are triggered by a risk, people show a remarkable tendency to neglect a small probability that the risk will actually come to fruition. Experimental evidence, involving electric shocks and arsenic, supports this claim, as does real-world evidence, involving responses to abandoned hazardous waste dumps, the pesticide Alar, and anthrax. The resulting “probability neglect” has many implications for law and policy. It suggests the need for institutional constraints on policies based on ungrounded fears; it also shows how government might effectively draw attention to risks that warrant special concern.
