This Article evaluates the merit of liberalizing unemployment insurance eligibility as a means to achieve progressive wealth redistribution-an idea that has recently gained popularity among policymakers and legal scholars. Unemployment insurance (UI) provides temporary, partial wage replacement to workers who suffer unexpected job loss, but it tends to exclude workers who have very low wages or hours of work, or who quit for reasons considered "personal" (for example, to accommodate family demands). Professor Lester argues that while redistribution to workers who are poor or who have caregiving obligations is a desirable goal, expanding UI is a poor way to do …

It is the most grotesque of ironies that much of twentieth-century jurisprudence has been an effort to make law into a science. This effort amounts to a reversal of a far earlier appropriation. It was the observation of regularities in gravity and the movement of the planets that reformed science and gave credence to the locution, 'the laws of nature.' Nature was "lawful" because it appeared to follow undeviatingly a certain regimen, which is to say that any deviations observed were held to be clues as to the true content of the laws that were being followed. The structure of the mechanisms in the Kyoto Protocol with respect to "carbon sinks," may be integrated so as to place incentives on national governments that counter recent progress made towards the preservation of old-growth forests. A focus on the element carbon fails to recognize values other than sequestration that standing forests can provide. For example, an approach that strictly seeks to increase the rate of fixation of atmospheric carbon will favour replacing old-growth forests with monocultural plantations of trees. Electrochemistry And Spectroelectrochemistry Of Iron Porphyrins In The Presence Of Nitrite, Zhongcheng Wei, Michael D. Ryan

The reaction of nitrite with ferric and ferrous porphyrins was examined using visible, infrared and NMR spectroscopy. Solutions of either ferric or ferrous porphyrin were stable in the presence of nitrite, with only complexation reactions being observed. Under voltammetric conditions, though, a rapid reaction between nitrite and iron porphyrins was observed to form the nitrosyl complex, Fe(p)(NO), where P = porphyrin. The products of the reduction of ferric porphyrins in the presence of nitrite were confirmed by visible spectroelectrochemistry to be Fe(P)(NO) and [Fe(P)]2O. Visible, NMR and infrared spectroscopy were used to rule out the formation of Fe(P)(NO) by the …

In writing this article, I kept thinking of the various stories that I heard during the workshops in Beijing and again I was struck by the commonality of the underlying issues facing women from around the world. While there may be dramatic political, cultural, linguistic and economic differences, I posit that there were more similarities than there were differences.

'Bush v. Gore' was decided a year ago. As expected, it evoked a flood of journalistic and academic commentary. The present authors write to express dissatisfaction with the resulting literature. They find it in general to be dominated by the usual political discourse conducted from opposite ends of the usual political spectrum, with both ends sharing an assumption that the Supreme Court was animated in its decision by the usual political motives that it has become conventional to see in the actions of that institution. The efforts of managed care to balance resources, cost, and quality of services have created new issues among mental health professionals, affecting their careers and having the potential to affect their job satisfaction. Therefore, the purpose of the study was to investigate how managed care has impacted career satisfaction among professional psychologists.

The method. The present investigation examined 21 factors in the prediction of job satisfaction among licensed psychologists. Bush V. Gore, Federalism, And The Distrust Of Politics, Bradley W. Joondeph

The Supreme Court's per curiam decision in Bush v. Gore, sparked a considerable amount of criticism and discussion. During this debate, many scholars have argued that the Court's decision was fundamentally incompatible with its previous federalism decisions. This article contends that this criticism is misplaced. It argues that while the per curiam opinion in Bush v. Gore decision embraced a novel and rather expansive understanding of equal protection that seems largely out of character for the Rehnquist Court, the Court's decision to intervene and resolve the election dispute was not inconsistent with its general approach to constitutional federalism.

Ecological Observations Of Juvenile Head-Started Western Pond Turtles (Clemmys Marmorata Marmorata) In Their First Season In The Wild, Steven Lee Clark

This project studies 16 juvenile, western pond turtles that were head-started as part of a species recovery program. To my knowledge, no studies have focused solely on juvenile western pond turtles. This study focuses on the turtles’ ecology in their first season in the wild. Radio telemetry was used to study the turtles’ survival, habitat use, behavior and movement.

All study animals survived. Turtles were found to choose aquatic habitat with 81 %-100% floating vegetative cover. Data suggest that refugia was the most important benefit of floating vegetation. All overwintered in upland sites after brief stays in the ponds. Home …

The campaign to curtail "fraud and abuse" in the Medicare and Medicaid programs represents an attempt by regulators to evade more fundamental and difficult questions regarding cost and quality control. Problem. Cooperative learning is attempted by placing students in group learning situations in which they receive assignments without a structured group or team-formation process. This study evaluated the effectiveness of the BcubeTM process with college students as a method of bringing together individuals of varied backgrounds to form cooperative- learning teams. Problem. Clergy sexual misconduct is a significant problem for the church. There are legal and financial problems, as well as damage to individuals and communities. The purpose of this study was to examine personality profiles and situational themes of ministers in treatment whose presenting problems included sexual misconduct.

Method. Inactive case files of ministers in treatment were analyzed. During the last decade, research has indicated that patient education is an essential component in the comprehensive management of heart failure. However, few data are available that evaluate how effective that education is and the relationship between knowledge and self-care adherence. Therefore, the purpose of this study was to examine the relationship between patients’ perceived knowledge of heart failure and their reported self-care adherence with diet, exercise, and medication in the management of their chronic disease. This study was a secondary analysis of data from a national survey of 135 high schools throughout the nation, including both rural and urban settings. A sample of 14,056 twelfth grade students participated in the survey. This study explored the relationships between religious attendance, perceived importance of religion, and smoking and consumption of alcohol in adolescents. Very little research was found on the relationship between religion and adolescent health, indicating a need for more investigations. Sexuality is intrinsic to the nature of human beings. If nurses are to practice holistically, issues concerning sexuality are relevant to nursing practice. The attitudes and behaviors that rehabilitation nurses express regarding the care of rehabilitation patients were explored in this descriptive study. One hundred and one members of the Association of Rehabilitation Nurses (ARN) responded to the Williams - Wilson Sexuality Survey (WWSS). This secondary analysis examined the relationship between perceived self-efficacy of disease management and hospital admissions for heart failure patients based on Bandura’s social learning theory. A convenience sample of 76 patients who were receiving home care services were visited over the course of several weeks. Data were collected at baseline, 3, and 6 months using the Self-Management Tool adapted from the work of Lorig et al. (1996).

Data indicated a weak negative statistically significant relationship between perceived self-efficacy of disease management and hospital utilization at 3 months (r = -.33, p = .01). In addition, hospital utilization decreased over time, …

The purpose of the study was to examine the perceived problem areas for adults living with diabetes. A descriptive design using the Problem Areas in Diabetes Scale (PAID) among a convenience sample of 24 African Americans provided the data in this study. King’s (1971) conceptual framework for nursing provided the theoretical foundation.

Data indicated that 83% of the sample did not perceive living with diabetes as a serious problem. However, the majority of them identified food deprivation and coping with diabetes, in addition to worrying about the future and possible serious complications from the disease as problematic. This secondary analysis evaluated the effect of a mutual goal setting nursing approach on the level of self-efficacy to manage disease in general in patients with congestive heart failure (CHF). This was a secondary analysis of data from 86 home care patients from a primary study by Kline (1999) of home care outcomes for persons with heart failure. Surveys were used to collect data on quality of life, energy/fatigue levels and functional abilities. In the secondary analysis, the relationships between functional abilities and energy/fatigue levels with quality of life in heart failure patients were examined using a Pearson’s r correlation. The purpose of this descriptive, correlational study was to determine if a relationship exists between critical thinking skills and self-efficacy in Associate Degree nursing students. A convenience sample of 30 nursing students in their second year of an Associate Degree RN program was used. The framework for this study utilized Bandura's social cognitive theory and Benner's nursing theory of skill acquisition and development.
