An experiment was conducted to determine whether phytase additions to swine growing-finishing diets improved the availability of lysine, calcium, energy and phosphorus in corn and soybean meal-based diets. Diets investigated for growing-finishing barrows of high-lean-gain potential included: 1) University of Nebraska recommended diet formulations; 2) diets formulated to contain 85% of the lysine recommended; 3) lysine-deficient diets formulated with phytase; 4) phytase-formulated diets with phytase deleted; and 5) phytase-formulated diets with phytase deleted and with additional calcium and phosphorus. Pigs fed diets formulated to 85% of the recommended lysine level had slower growth, slower daily lean gain, poorer feed conversion, …

An experiment was conducted to examine the effects of compensatory growth and amino acid supply on organ weights and carcass characteristics in growing gilts. Gilts were fed either a corn-soybean meal diet or a corn-soybean meal diet supplemented with crystalline lysine. Pigs were randomly allotted to either a 21-day ad libitum eating period or a 42-day restricted-realimentated feeding period. The restricted-realimentated (RR) feeding period consisted of a 21-day restriction period and a 21- day ad libitum eating period (realimentation). During the restriction period, pigs were fed to maintain body weight. Results indicated that during the restriction period, gilts had a …

The pig faces significant biological and environmental challenges after weaning. A great deal of information is available on behavior, environment, health, and nutrition of the newly weaned pig; however, newly weaned pigs still suffer a growth lag. The pig’s small intestinal structure and function is altered during the days that follow weaning. As a consequence, the digestive and absorptive capacity of weanling pigs is decreased during this period and this may be partially responsible for the post weaning growth lag. Additionally, health benefits may be associated with an improved small intestinal structure and function. The goal of this article is …

The effects of extruded/expelled soybean meal (ESBM) on growth performance and carcass composition of pigs from weaning to slaughter were investigated. Two experiments were conducted. In the first experiment, weaned pigs were fed a diet containing either conventional solvent-extracted soybean meal or ESBM. Average daily gain and feed efficiency were greater in pigs fed the control diet. The second experiment was designed to determine whether nursery diet influenced performance during the growing-finishing period. In the second experiment, half of the pigs from Experiment 1 were assigned to either a control or ESBM diet and were fed until slaughter. Average daily …

This Essay is an attempt to theorize the relationship of law to culture and culture to law beyond the intuitive, commonplace sense that law partakes of culture - by reflecting it as well as by reacting against it - and that culture refracts law. It proposes a theory of law as culture that, in detailing the mutually constitutive nature of the relationship, distinguishes itself from the way law and culture have been conceived by realist and critical legal scholars, as well as by social norms writers. The Essay concludes by speculating about one possible method by which this theorizing might …

Characteristics Of Effective Employment Services: The Consumers’ Perspective, Jaimie Ciulla Timmons, Jennifer Schuster, Doris Hamner, Jennifer Bose

This monograph reports on a study investigating the characteristics of effective state service systems. Findings are based on the experiences of individuals with disabilities who have used a state agency (Vocational Rehabilitation, Department of Mental Retardation, Department of Mental Health, or One Stop Center) to find employment. Interviews were conducted to examine individuals' experiences with employment services including job search, job entry, strategies that facilitated involvement, supports provided, and barriers experienced. Findings indicated five key components to effective service delivery, including agency culture, consumer-directedness, access to resources, quality personnel, and coordinated services. In recent years, there has been a steady rise in the use of marketable permits in environmental regulation. They have been employed as tools to control both air and water pollution, and have been implemented on local, regional, and national scales. These trading regimes - based upon a single market in emission permits - do not control the distribution of emissions throughout the trading region or prevent the formation of hot spots of pollution. Over the years, commentators have advocated several alternative design structures to deal with these problems. Each of these alternatives, however, has significant drawbacks, either providing only …

The casual observer might be forgiven for thinking that the debate over predispute employment arbitration agreements ended in 1991, when the Supreme Court held in Gilmer v. Interstate/Johnson Lane Corp. that the Federal Arbitration Act of 1925 (FAA) requires enforcement of such agreements, even when they are obtained as a condition of employment, and would preclude employees or former employees from suing in court on their federal (or state) statutory discrimination claims. The plaintiffbar, however, proceeded to launch a decade-long effort to undo Gilmer, meeting with little success everywhere but the Ninth Circuit. One of the premises of their challenge …

My task on this occasion is to talk about law reform in New Zealand, which invites you, the audience, to ask what a nice boy from Brooklyn knows about this subject. But in fact there is a close synergy between my previous work and the topic at hand. During the 1980s I wrote two controversial articles (and one rejoinder) on labor and employment law. Partly in consequence of my free-market message, in 1990, 1995, and 1999, I traveled to New Zealand at the behest of the New Zealand Business Round Table to speak about these subjects among others. Not all statutes are created equal. Appropriations laws perform important public functions, but they are usually short-sighted and have little effect on the law beyond the years for which they apportion public monies. Most substantive statutes adopted by Congress and state legislatures reveal little more ambition: they cover narrow subject areas or represent legislative compromises that are short-term fixes to bigger problems and cannot easily be defended as the best policy result that can be achieved. Some statutes reveal ambition but do not penetrate deeply into American norms or institutional practice. Even fewer statutes successfully penetrate public normative and institutional …

Cases involving scientific uncertainty should be resolved on the basis of the appropriate tort norm for allocating the burden of factual uncertainty. This norm does not require epidemiological proof in the products liability context, because such proof is primarily relevant for damages rather than causation. For damage issues, the tort norm allocates the burden of factual uncertainty to the defendant. In other contexts, epidemiological evidence is primarily relevant for causation, and the requirement of epidemiological proof is consistent with a tort norm of equality. The requirement, however, is limited by various contextual considerations, including the current state of science, and …

This Article explains that all employment discrimination laws not only condemn the subjugation of defined groups, they also impose significant redistributive costs. The Article uses the Americans with Disabilities Act as an example to examine how much redistribution is proper under the rubric of nondiscrimination. The most recent ADA cases, most notably Sutton v. United Air Lines, reveal more starkly than prior employment discrimination case law the tension between the nondiscrimination command and the redistributive side of employment opportunity law. The doctrinal difficulties faced by courts interpreting the ADA stem directly from the inability of the anti-discrimination model to control …

A Woman Decides addresses the need for intellectual versatility among judges and lawyers. The underlying premise of the essay is that excellence in judicial practice requires integration of rule-based and contextual reasoning. Professor Gilligan's work is relied on both to explain the importance of intellectual versatility and to explain why cultures of professional practice fail to encourage it. Professor Davis's work is relied on to explain the importance of an intellectually versatile approach, and the dangers of an intellectually narrow approach, to decisionmaking that relates to three important aspects of substantive due process: the liberty interests in controlling the manner …

An Alert To The Intellectual Property Bar: The Hague Judgments Convention, Rochelle C. Dreyfuss

As communication technology increases at an ever-faster pace, multinational civil litigation becomes increasingly complex, especially in the intellectual property fields. Professor Rochelle Dreyfuss suggests that the current international standards for intellectual property protection in the Berne Convention, the Paris Convention, and the TRIPS Agreement are not able to tackle the problems presented. Because these agreements do not establish a uniform law, they do not prevent conflicting outcomes when litigants bring suits in multiple fora. These agreements leave unanswered questions of claim and issue preclusion as well as choice of law rules; and they do not provide for the consolidation of …
