When tort judgments exceed the assets of tortfeasors and the tort victim has first-party insurance for a portion of the loss suffered, the question arises as to how the recovery from the tortfeasor should be divided between' the tort victim on the one hand and the insurer via its rights of subrogation on the other. A common view among the courts and legal commentators is that the insured should be made whole before the insurer recovers subrogation. This paper employs simple models of optimal insurance contracts to show that the opposite rule will often be optimal. Accordingly, there is little …

"A Mere Feigned Case": Rethinking The Fletcher V. Peck Conspiracy And Early Republican Legal Culture, Lindsay G. Robertson

Frederic Maitland, the great English legal historian, once wrote that "[t]he only direct utility of legal history... lies in the lesson that each generation has an enormous power of shaping its own law."1 As I read this, Maitland makes two points. The first is that the value of history to law lies in its capacity to empower by illuminating the human element in the process by which law is made. The second is that each generation does in fact shape its own law; i.e., that the law of a given time is the product of contemporaneous human agents. The law …

Professor Robert D. Putnam's work is, in many respects, the contemporary companion to Democracy in America.' It comprehensively surveys and tests common presumptions held about our democracy with apparently very reliable quantitative data. Until recently, a work of this depth and breadth has been unavailable. Putnam sets forth a well supported thesis suggesting that even though American financial capital may be at a high, its "social capital" has perhaps reached a record low, or at least a level similar to the social, economic, and legal bottleneck of a century ago.' With the reform movement in Indonesia, the FRONTIERS project recognized the new opportunities for influencing public debate and informing public opinion on reproductive health issues and undertook a project for disseminating the results of contemporary research on reproductive health. The project had three main objectives: 1) to increase print media coverage of critical reproductive health issues by enhancing journalists’ role as responsible communication agents; 2) to contribute to public debate on emerging reproductive health issues in order to influence policy development and guide program management; and 3) to increase public awareness of key health issues, with a particular focus on …

Power In Sexual Relationships: An Opening Dialogue Among Reproductive Health Professionals, Population Council, Interagency Gender Working Group (Igwg)

The discussions summarized in this report indicate that gender-based power inequalities hinder communication between partners, limit the ability of individuals and couples to talk about or achieve desired child spacing and family-size goals, limit effective use of reproductive health services, undercut men’s and women’s attainment of sexual health and pleasure, and increase substantially their vulnerabiliy to HIV/AIDS and other sexually transmitted infections. This report summarizes the proceedings of a meeting, co-sponsored by the Population Council and USAID’s Men and Reproductive Health Subcommittee, that responded to an increasing groundswell of interest in opening a dialogue on power in sexual relationships. Divorce In The Family: How Does It Affect Personality And Views Of Love And Marriage?, Kymberley K. Bennett

Modern Psychological Studies

This study was conducted to investigate the impact of parental divorce on such personality variables as global optimism and self-esteem, and attitudes toward love and marriage. Eighty-seven women and 48 men enrolled in a small, private university participated in this study. A questionnaire was developed specifically for this study which included Sheier and Carver's (1985) Life Orientation Test, Rosenberg's (1965) Self-Esteem Scale, and several other established measures. In addition, participants read five scenarios depicting couples on the verge of divorce and were asked to rate each impending divorce for its likelihood and its acceptability. Over the past 30 years there has been an increasing interest in curriculum innovation in medical schools in North America, the United Kingdom, Netherlands, and Australia. Since the introduction of problem-based learning at McMaster University in Canada in 1969, several medical schools throughout the world have adopted problem-based learning as the educational and philosophical basis of their curricula.
