Confirmatory Factor Analysis Of The Coping Style Inventory In A College Sample, Christopher Garth Bellah Jan 2001

Confirmatory Factor Analysis Of The Coping Style Inventory In A College Sample, Christopher Garth Bellah

Doctoral Dissertations

The present study conducted a confirmatory factor analysis of the Coping Style Inventory (CSI). A comprehensive review of the history of stress and coping research was provided, along with a presentation of suggestions for future research that have indicated a need for a melding of both theory-driven and empirically-driven methodology in coping assessment. Pursuant to this need, a pilot study was conducted to explore the factor structure and psychometric properties of the CSI (N = 560). Results of pilot work using a principle components extraction and a parallel analysis criterion for factor retention indicated that six primary factors were …

Does Vanity Describe Other Cultures?: A Cross Cultural Examination Of The Vanity Scale, Srinivas Durvasula, Steven Lysonski, John Watson Jan 2001

Does Vanity Describe Other Cultures?: A Cross Cultural Examination Of The Vanity Scale, Srinivas Durvasula, Steven Lysonski, John Watson

Marketing Faculty Research and Publications

Vanity is a psychological construct that describes a person's excessive concern with physical appearance or achievement. A scale, recently developed to measure this construct, has been psychometrically validated using data from U.S. respondents. The goal of this paper is to determine if this scale can be used cross-culturally. If the scale has cross-cultural applicability, it can be used as a counseling device to guide and alert individuals to certain tendencies. The scale also can be used to track foreign cultures as they adopt a consumerism ethos more aligned to Western consumer culture. Based on data from 475 young adults in …

The South Carolina Secession Statement Of 1860 And The One Florida Initiative: The Limits Of A Historical Analogy And The Possibility Of Racial Reconciliation, Martina D. Carcieri Jan 2001

The South Carolina Secession Statement Of 1860 And The One Florida Initiative: The Limits Of A Historical Analogy And The Possibility Of Racial Reconciliation, Martina D. Carcieri

St. Thomas Law Review

In Part II, we shall examine the Secession Statement in order to understand more fully the case it makes against the northern states and national government. Only then shall we be able to appreciate why this legally compelling document is ultimately not convincing. With that foundation, Part III examines One Florida opponents' arguments for preferences by government and the weaknesses of those arguments. With this background, we shall see in Part IV how One Florida opponents' position actually resembles that of South Carolina more than that of the Northerners, and ultimately embraces not civil society, but instead a state of …

Alternatives In Fighting Street Gangs: Criminal Anti-Gang Ordinances V. Public Nuisance Laws, Silvia Perez Jan 2001

Alternatives In Fighting Street Gangs: Criminal Anti-Gang Ordinances V. Public Nuisance Laws, Silvia Perez

St. Thomas Law Review

Gang violence continues to be a problem in today's society. Gangs have spread beyond our inner cities into this nation's rural areas, parks and streets. The United States spends $20 billion a year treating the victims of gunshot wounds. "Gang violence is not only tearing at our moral culture and killing our children, it's also picking our pockets." Gangs exist in 94% of major American cities. Former President Clinton found the 1998 statistics released by the Bureau of Justice Statistics and the National Centre for Education Statistics unacceptable and urged Congress to "fight the trend by approving anti-gang and youth …

This Time For Sure--A Political And Legal History Of Water Control Projects In Lake Okeechobee And The Everglades, David G. Guest Jan 2001

This Time For Sure--A Political And Legal History Of Water Control Projects In Lake Okeechobee And The Everglades, David G. Guest

St. Thomas Law Review

For more than a century, efforts have been under way to control water in the Lake Okeechobee/Everglades ecosystem. After years of scheming dating back to the 1840s, drainage projects began in earnest in the 1880s. Although each project was intended to make up for the shortcomings of the last, each was progressively more damaging to the environment, and thus necessitated another more expensive project. Thus, each project had unintended consequences. Throughout this progression of projects, opposing interests repeatedly found themselves in the Florida Legislature and the Florida Supreme Court. In those forums, the zeal for Everglades drainage produced an enlarged …

Good Science Or Myopia: Will The 1991 Everglades Settlement Lead To An Optimal Restoration Or Will Phosporus Reductions Be Taken Too Far, William H. Green, Gary V. Perko Jan 2001

Good Science Or Myopia: Will The 1991 Everglades Settlement Lead To An Optimal Restoration Or Will Phosporus Reductions Be Taken Too Far, William H. Green, Gary V. Perko

St. Thomas Law Review

Everglades water quality restoration: What does it mean? How will it be achieved? How much will it cost? Will it promote re-establishment of historical wildlife populations? Despite years of scientific research, these questions remain answered for the control of phosphorus inputs under Florida's landmark Everglades Forever Act. A one-dimensional approach continues to drive Everglades restoration efforts along a narrow path of extreme phosphorus reductions despite mounting scientific evidence that this could harm wildlife and be unduly costly to society However, moderation of that goal may enhance Everglades wildlife habitat by restoring lost ecosystem functionality, and preserving areas where wildlife mercury …

The Human Genome In The Public View: Genetics, Geneticists, And Eugenics, Mary Kay Pelias, Nathan J. Markward

St. Thomas Law Review

Recent advances in the technologies of molecular genetics have generated a plethora of questions about how these technologies should be used and what, if any, constraints should be imposed on their use. Commentators on the use of the new genetic technologies have, on the one hand, emphasized the benefits to be realized from genetics research in terms of human health and welfare. On the other hand, a handful of critics have focused on the possible misuses of the new technologies and have urged surveillance of genetics and geneticists, lest we again fall into the morass of coercive, or forcible, eugenics. …

Genetic Breakthroughs And The Limits Of Medicine: Short Stature, Growth Hormone, And The Idea Of Dysfunction, Peter H. Schwartz Jan 2001

Genetic Breakthroughs And The Limits Of Medicine: Short Stature, Growth Hormone, And The Idea Of Dysfunction, Peter H. Schwartz

St. Thomas Law Review

This article reviews arguments that have been presented for the use of growth hormone in some children without growth hormone deficiency. Some of these arguments, this article will claim, utilize confused ideas of dysfunction, and this has led to weak arguments that rely on poor data. Clarifying the concept of dysfunction produces clearer arguments that do not depend on such questionable empirical claims. This analysis aims to serve as a case study of how the careful definition and application of ideas can aid in evaluating the proper purview of medicine. The discussion of future genetic breakthroughs and the powers they …

Science, Philosophy, And The Courts, Jason Borenstein Jan 2001

Science, Philosophy, And The Courts, Jason Borenstein

St. Thomas Law Review

The purpose of this article is to explore the legal system's philosophical assumptions about science and examine whether scientific evidence has been handled adequately by the federal courts. This article does not intend to offer a comprehensive philosophy of science. Rather, it discusses specific issues that have been raised by courts when they have tried to evaluate scientific expert testimony. Scientific testimony tends to pose an especially difficult challenge for the court system, because it can be deeply inaccessible to lay judges and juries. To complicate matters further, the courts have raised several issues they probably are unable to resolve, …

Are Medical Ethics Different From Legal Ethics?, Mervin H. Needell Jan 2001

Are Medical Ethics Different From Legal Ethics?, Mervin H. Needell

St. Thomas Law Review

In this paper I shall compare and contrast some relevant ethical positions of legal and medical precepts and practices which seem to suggest or predispose to a professional bias. I derive these conclusions from official positions contained in institutional accounts, such as case law or treatises. Even if such comparisons do not make a convincing case for professional bias, they should still provide some insight into the ways in which the thought processes of lawyers and doctors do or do not differ. Although the words "moral" and "ethical" are often used interchangeably, if a distinction must be made here, I …

"Extraordinary Or Specialized Training"--As A "Legitimate Business Interest"--In Restrictive Covenant Employment Law: Florida And National Perspectives, Frank J. Cavico Jan 2001

"Extraordinary Or Specialized Training"--As A "Legitimate Business Interest"--In Restrictive Covenant Employment Law: Florida And National Perspectives, Frank J. Cavico

St. Thomas Law Review

The purpose of this article is to examine Florida statutory law and case law, as well as the law from other jurisdictions, that govern restrictive covenants which arise in the employment relationship. The analysis will center on the critical legal element essential to uphold and enforce a covenant not to compete - the "legitimate business interest" requirement. In particular, this article will focus on one important, yet perplexing, aspect thereto - the level and extent of training and/or education necessary to achieve such a protected "interest." The relevant part of the Florida restrictive covenant statute and all Florida court decisions …

The Nexus Between Intellectual Property Piracy, International Law, The Internet, And Cultural Values, David J. Stephenson Jr. Jan 2001

The Nexus Between Intellectual Property Piracy, International Law, The Internet, And Cultural Values, David J. Stephenson Jr.

St. Thomas Law Review

In a way similar to the dramatic transformation of mass into energy at the speed of light, intellectual property piracy disputes have compellingly special characteristics when multicultural values clash over the Internet. The sudden explosion of Internet use outside of Western Europe and North America, especially in Asia, is most apparent in Singapore, which has the highest per capita use of the Internet anywhere in the world. This rapid global expansion of Internet use has been accompanied by related claims of intellectual property piracy that frequently resemble disputes that have recently arisen in United States and European courts. For example, …

The Evolving Right Of Self-Determination Of Indigenous Peoples, Paul J. Magnarella Jan 2001

The Evolving Right Of Self-Determination Of Indigenous Peoples, Paul J. Magnarella

St. Thomas Law Review

The destruction of indigenous societies represents a major threat to the contemporary world's rich inventory of cultures. Throughout the centuries, indigenous peoples have been forcibly removed from their lands, dispossessed of their natural resources, discriminated against or simply decimated.! Most of the world's estimated 300 million indigenous peoples are less well off than are members of the dominant societies. Many live in extreme poverty. Indigenous peoples wish to maintain their own unique cultures and ethnic identities and to control their traditional lands of occupation or at least some portions of them. Indigenous peoples need protected enclaves if they are to …

Graduate Record 2001: Centennial Edition, Southwestern Oklahoma State University Jan 2001

Graduate Record 2001: Centennial Edition, Southwestern Oklahoma State University

SWOSU Yearbooks

It was called Southwestern Normal School. Its yearbook was The Oracle. The year was 1901. Oklahoma wasn't even a state when Weatherford started up the small teacher's school. There was no campus. Instead, the town borrowed office space from a beer company. Finally, a building was set up on a hill north of town. In a grand ceremony one morning, the students, faculty and staff marched from downtown Weatherford to their new home.

On a chilly, rainy March 8, 2001, Southwestern re-created the scene, ending with a campus-wide picture. The event was a 100 years in the making, just as …

Faculty Publications

In Saccharomyces cerevisiae, Golgi elements are present in the bud very early in the cell cycle. We have analyzed this Golgi inheritance process using fluorescence microscopy and genetics. In rapidly growing cells, late Golgi elements show an actin-dependent concentration at sites of polarized growth. Late Golgi elements are apparently transported into the bud along actin cables and are also retained in the bud by a mechanism that may involve actin. A visual screen for mutants defective in the inheritance of late Golgi elements yielded multiple alleles of CDC1. Mutations in CDC1 severely depolarize the actin cytoskeleton, and these …
