Review Of Medicare Reimbursement Disputes Under 42 U.S.C. § 1395oo: Delineating A Unified Theory Of The Provider Reimbursement Review Board's Jurisdiction And Scope Of Review, David W. Thomas Jan 2001

Review Of Medicare Reimbursement Disputes Under 42 U.S.C. § 1395oo: Delineating A Unified Theory Of The Provider Reimbursement Review Board's Jurisdiction And Scope Of Review, David W. Thomas

Duquesne Law Review

Under the Medicare health insurance program, medical care providers, such as hospitals, submit claims for reimbursement of medical expenses to fiscal intermediaries. The fiscal intermediaries, usually private insurance companies operating as links between providers and the Department of Health and Human Services, then determine whether the claims warrant reimbursement with Medicare funds. As a consequence of this process, disputes often arise between providers and fiscal intermediaries. These disputes must be presented to the Provider Reimbursement Review Board. The continuing confusion surrounding the Board's jurisdiction over certain claims and the Board's scope of review prompted the author to explain the genesis …

Standards Of Review And Scopes Of Review In Pennsylvania - Primer And Proposal, Jeffrey P. Bauman Jan 2001

Standards Of Review And Scopes Of Review In Pennsylvania - Primer And Proposal, Jeffrey P. Bauman

Duquesne Law Review

Despite the importance of standards and scopes of review to the appellate process, legal practitioners continue to confuse these terms in their appellate briefs and in their oral arguments, resulting in the addition of unnecessary confusion to already complicated controversies. After explaining "standard of review" and "scope of review," the author describes how each of these principles are applied in Pennsylvania's appellate courts. The author concludes by analyzing various commonly used standards and scopes of review and by providing the context in which each is used in the Commonwealth of Pennsylvania.

A Content Neutral Public Nudity Ordinance That Satisfies The O'Brien Test May Require Erotic Dancers To Wear G-Strings And Pasties Without Violating Their First Amendment Right Of Freedom Of Expression: City Of Erie V. Pap's A.M., James S. Malloy Jan 2001

Malloy

Duquesne Law Review

The Supreme Court of the United States held that a content-neutral ordinance, aimed at combating the negative secondary effects of public nudity, satisfied the O'Brien standard for restrictions on symbolic speech and was, therefore, a constitutionally permissible restriction on freedom of expression.

"So Extraordinary, So Unprecedented An Authority": A Conceptual Reconsideration Of The Singular Doctrine Of Judicial Review, Anthony V. Baker Jan 2001

"So Extraordinary, So Unprecedented An Authority": A Conceptual Reconsideration Of The Singular Doctrine Of Judicial Review, Anthony V. Baker

Duquesne Law Review

Because the Constitution is the foundation of American government, the political body that interprets and applies that venerable document possesses an extremely potent tool for shaping the American landscape. This tool, known as "judicial review," allows the United States Supreme Court to pass judgment not only upon the actions of individual citizens but also upon the actions of the other branches of federal and state government. This authority inevitably leads to criticism of the way the Court implements this power. The author, after delivering a trenchant analysis of the way in which a judicial reviewing power was viewed in America …

Born Again: A Review Of Harry Jaffa's A New Birth Of Freedom And Crisis Of The House Divided, Ken Masugi

Duquesne Law Review

Through the publication of Crisis of the House Divided, Harry Jaffa made a critical contribution to the understanding of Abraham Lincoln, the Civil War, and the transcendent principles of the American regime. In his long-awaited A New Birth of Freedom, Jaffa builds upon his earlier work by expanding the scope of his study beyond the time period immediately preceding the Civil War to include the entire antebellum period in American history. This expansion leads to a thorough analysis of not only Abraham Lincoln but also of such important figures as Thomas Jefferson and John C. Calhoun. The author …

The Privatization Of The Civil Commitment Process And The State Action Doctrine: Have The Mentally Ill Been Systematically Stripped Of Their Fourteenth Amendment Rights?, William Brooks Jan 2001

The Privatization Of The Civil Commitment Process And The State Action Doctrine: Have The Mentally Ill Been Systematically Stripped Of Their Fourteenth Amendment Rights?, William Brooks

Duquesne Law Review

The Supreme Court has recognized that civil commitment constitutes a significant deprivation of liberty that requires due process protection. A state's ability to commit the mentally ill is subject to the due process limitations of the Fourteenth Amendment. However, the circuit courts have held that civil commitment by private physicians to private hospitals does not constitute state action for Fourteenth Amendment purposes. The author proposes that the "state action" doctrine extend to civil commitment by private physicians, and criticizes federal decisions that have held otherwise.

When Seeking Reinstatement Of Workers' Compensation Benefits After Layoff From Modified Duty Work, A Claimant Must Prove That The Original Disability Has Continued And Is Once Again Causing Decreased Earning Power - Bethlehem Steel Corp. V. W.C.A.B. (Laubach), Anita A. Reno

Duquesne Law Review

The Pennsylvania Supreme Court held that an injured worker seeking reinstatement of benefits, after being laid off from modified duty work, need only demonstrate that the disability from his original work injury has continued and that it is once again causing him to suffer decreased earning power through no fault of his own.

Mdmx Binding To Arf Affects Mdm2 Protein Stability And P53 Transactivation, Mark W. Jackson, Mikael S. Lindström, Steven J. Berberich Jan 2001

Mdmx Binding To Arf Affects Mdm2 Protein Stability And P53 Transactivation, Mark W. Jackson, Mikael S. Lindström, Steven J. Berberich

Educator Preparation & Leadership Faculty Works

Regulation of p53 involves a complex network of protein interactions. The primary regulator of p53 protein stability is the Mdm2 protein. ARF and MdmX are two proteins that have recently been shown to inhibit Mdm2-mediated degradation of p53 via distinct associations with Mdm2. We demonstrate here that ARF is capable of interacting with MdmX and in a manner similar to its association with Mdm2, sequestering MdmX within the nucleolus. The sequestration of MdmX by ARF results in an increase in p53 transactivation. In addition, the redistribution of MdmX by ARF requires that a nucleolar localization signal be present …

Shaping The Thin Blue Line: American Police Reform From The London Model To Community Policing, Philip Rosenbloom Jan 2001

Shaping The Thin Blue Line: American Police Reform From The London Model To Community Policing, Philip Rosenbloom

Honors Papers

American interpretations of the police officer's role in our society span the distance between two distinct and opposite poles. On the one hand, many Americans, especially those living in middle or upper class, non-urban, predominantly white areas, believe that a police officer is a hero, "a courageous public servant [and] a defender of life and property." If they are victimized in some way, they believe they can call the police, and that the police will come to their aid. There is however, a considerable segment of our society, often those living in poor, urban, non-white areas, that understands police officers …

Opposing Systems, Erin Stone Jan 2001

Opposing Systems, Erin Stone

Inquiry: The University of Arkansas Undergraduate Research Journal

Costa Rica and Nicaragua, although situated close together in geography, historically and politically are worlds apart. Costa Rica has maintained a stable democracy since 1948, while Nicaragua, rocked by authoritarian rule and then revolution in 1979, is still in an unstable growth period. Each country represents an opposing government system that would have varying effects on the emphasis and influence placed on different social situations in each country. Through studying one social aspect, the women's movement, one is able to examine the positive and negative aspects of each system and prospects for future success of countries under each type of …

When A Tree Falls In Fayetteville Does It Make A Sound: The Impact Of Issue Voting On Local Nonpartisan Elections, Jon Taylor Jan 2001

When A Tree Falls In Fayetteville Does It Make A Sound: The Impact Of Issue Voting On Local Nonpartisan Elections, Jon Taylor

Inquiry: The University of Arkansas Undergraduate Research Journal

This research provides an explanation of the impact that high-profile issues can have on local nonpartisan elections. The tree ordinance in Fayetteville sparked a controversy that ignited the community's interest in the race for Mayor. This controversy provides a unique opportunity to measure how issue voting effects elections that have limited information available. The research regarding behavior in local nonpartisan elections is incomplete, because of the challenges this subject provides for political scientist. It is difficult to gauge a voter's choice when the voter's process limited knowledge of the candidates and party affiliation is removed. Generally political scientist view issue …

Problems Of The Comprehensive System For The Rorschach In Forensic Settings: Recent Developments, James Wood, M. Nezworski, William Stejskal, R. Mckinzey

Departmental Papers (Psych)

The Comprehensive System for the Rorschach is currently the subject of heated controversy among psychologists. Much "common knowledge" about the test is either incorrect or in dispute. Psychologists who use the Rorschach in forensic settings can often be successfully challenged by well-informed attorneys and may risk becoming the subject of ethics complaints. This article identifies seven issues that are particularly relevant to use of the Comprehensive System for the Rorschach in forensic psychology.

Why Dosen't She Leave - The Collision Of First Amendment Rights And Effective Court Remedies For Victims Of Domestic Violence, Laurie S. Kohn Jan 2001

Why Dosen't She Leave - The Collision Of First Amendment Rights And Effective Court Remedies For Victims Of Domestic Violence, Laurie S. Kohn

UC Law Constitutional Quarterly

Why doesn't she leave? This is a commonly asked question by people confounded by the phenomenon of women who stay in battering relationships despite the abuse they endure. Social scientists have offered many explanations to elucidate this seemingly paradoxical behavior. This article, however, focuses on a pervasive and previously unexamined explanation: the victim's fear that the batterer will publicize truthful confidential information about her. Typically, the batterer will threaten that if the victim leaves him, he will disseminate information such as the victim's HIV status, sexual orientation, or immigration status. The stakes are high. The victim will fear, often rationally, …

Responsive Regulation Of Internet Pharmacy Practice, David B. Brushwood

Annals of Health Law and Life Sciences

Professor Brushwood discusses the effectiveness of the Internet as a medium for carrying out pharmaceutical care. A proponent of Internet pharmacy, Professor Brushwood argues that pharmacy regulators could best protect and promote public health through responsive Internet regulation. Wary of state paternalism, the article advocates the Verified Internet Pharmacy Practice Site program of the National Association of Boards of Pharmacy as a model method for regulating pharmacy practices over the Internet.
