Merger Activity In The Pharmaceutical Industry, Dorota Bednarczyk Jan 2001

Merger Activity In The Pharmaceutical Industry, Dorota Bednarczyk

Honors Capstones

Merger activity in the pharmaceutical industry has increased considerably over the last five years. Moreover, current literature suggests that tender offers have higher announcement period returns for bidders and cash mergers have higher returns to the combined firm. Therefore, in this study I examine techniques of successful mergers and their integration process. In particular, I examine 83 mergers from 1995 to 2000 to test the relationship between the announcement period returns and the following variables: method of payment, transaction type, and merger length, over the same period of time. Contrary to prior studies, I find little evidence that these traditional …

The Gap Between Informational Goals And The Duty To Gather Information: Challenging Piecemealed Review Under The Washington State Environmental Policy Act, Keith H. Hirokawa Jan 2001

The Gap Between Informational Goals And The Duty To Gather Information: Challenging Piecemealed Review Under The Washington State Environmental Policy Act, Keith H. Hirokawa

Seattle University Law Review

In 1971, Washington enacted the State Environmental Policy Act (SEPA), which requires agencies to make a threshold determination of whether a project is likely to significantly affect the environment and, where such impacts are likely, to produce an environmental impact statement (EIS). One problem faced in implementing the goals of SEPA is the practice of "piecemealing." Part I of this Article introduces the piecemeal problem by describing three common piecemeal situations. The first situation occurs when a project proposal is divided into such small parts that the environmental impacts from each individual part appear insignificant and the impact from the …

The Canonical Class Of A Symplectic Four Manifold, Ronald Fintushel, Ronald Stern Jan 2001

The Canonical Class Of A Symplectic Four Manifold, Ronald Fintushel, Ronald Stern

Turkish Journal of Mathematics

In this article we present examples of simply connected symplectic 4-manifolds X whose canonical classes are represented by complicated disjoint unions of symplectic submanifolds of X: Theorem. Given finite collections {g_i}, {m_i}, i=1,...,n, of positive integers, there is a minimal symplectic simply connected 4-manifold X whose canonical class is represented by a disjoint union of embedded symplectic surfaces K ~ S_{g_1,1} « ... « S_{g_1,m_1} « ... « S_{g_n,1} «... « S{g_n,m_n} where S_{g_i,j} is a surface of genus g_i. Furthermore, c_1^2(X) = c_h(X) - (2+ b) where b= S{i=1}^n m_i is the total number of connected components of the …

Out Of Africa: Origins Of The Taenia Tapeworms In Humans, Eric P. Hoberg, Nancy L. Alkire, Alan De Queiroz, Arlene Jones Jan 2001

Out Of Africa: Origins Of The Taenia Tapeworms In Humans, Eric P. Hoberg, Nancy L. Alkire, Alan De Queiroz, Arlene Jones

Harold W. Manter Laboratory of Parasitology: Faculty Publications

Phylogenetic and divergence date analyses indicate that the occurrence of Taenia tapeworms in humans pre-dates the development of agriculture, animal husbandry and domestication of cattle (Bos spp.) or swine (Sus scrofa) Taeniid tapeworms in Africa twice independently colonized hominids and the genus Homo prior to the origin of modern humans. Dietary and behavioural shifts, from herbivory to scavenging and carnivory, as early Homo entered the carnivore guild in the Pliocene/Pleistocene, were drivers for host switching by tapeworms to hominids from carnivores including hyaenids and felids. Parasitological data provide a unique means of elucidating the historical ecology, foraging behavior …

Whether, When, And How To Tax The Profits Of Controlled Foreign Corporations, John P. Steines Jr. Jan 2001

Whether, When, And How To Tax The Profits Of Controlled Foreign Corporations, John P. Steines Jr.

Faculty Articles

Among the choices of how the United States could tax the earnings of controlled foreign corporations (CFCs) are these: (1) exempt the income from tax permanently; (2) accrue the income currently and grant either a credit or deduction for foreign taxes; or, (3) defer taxation until repatriation and allow a credit or deduction for foreign taxes at that time. The present system reflects aspects of all three approaches, but mainly accords deferral with a foreign tax credit upon repatriation, except for income taxed currently (actually or effectively) under anti-deferral regimes such as subpart F and the passive foreign investment company …

Markets And Geography: Designing Marketable Permit Schemes To Control Local And Regional Pollutants, Jonathan Remy Nash, Richard L. Revesz Jan 2001

Markets And Geography: Designing Marketable Permit Schemes To Control Local And Regional Pollutants, Jonathan Remy Nash, Richard L. Revesz

Faculty Articles

In recent years, there has been a steady rise in the use of marketable permits in environmental regulation. They have been employed as tools to control both air and water pollution, and have been implemented on local, regional, and national scales. These trading regimes - based upon a single market in emission permits - do not control the distribution of emissions throughout the trading region or prevent the formation of hot spots of pollution. Over the years, commentators have advocated several alternative design structures to deal with these problems. Each of these alternatives, however, has significant drawbacks, either providing only …

A Study Of Mathematics Course Sequence And Student Performance In Mathematics In A Block Scheduled High School, John Harvell Moody Jan 2001

A Study Of Mathematics Course Sequence And Student Performance In Mathematics In A Block Scheduled High School, John Harvell Moody

Doctoral Dissertations

The 1983 study of the condition of American Education, A Nation at Risk, brought a significant amount of attention to the way in which schools provided students with the skills necessary to be productive citizens. Many of the recommendations contained in A Nation at Risk focused on the perceived poor performance of American students when compared to their counterparts worldwide. The year after publication of A Nation at Risk, the National Commission on Time and Learning published Prisoners of Time, a report that called for the establishment of high academic standards for students and a major restructuring of the school …

War, Reform And State -Building In Brazil And In The United States: Slavery, Emancipation And Decision -Making Processes In The Paraguayan And Civil Wars (1861--1870), Vitor Izecksohn Jan 2001

War, Reform And State -Building In Brazil And In The United States: Slavery, Emancipation And Decision -Making Processes In The Paraguayan And Civil Wars (1861--1870), Vitor Izecksohn

Doctoral Dissertations

The present dissertation undertakes a comparative-historical analysis of the impact of the American Civil War and the Paraguayan War on the American and the Brazilian populations. It investigates how both war's dynamics interfered with the social orders existent in both countries. It underlines the impact of recruitment to show how the pronounced growth of each national state during wartime interfered with the lives and customs of the populations subjected to the draft.

War mobilization is always a dramatic event in any society. Increasing government intervention during wartime normally leads to a temporary invasion of local prerogatives through recruitment and mobilization. …

The Importance Of Early Successional Habitats To Rare, Restricted-Range, And Endangered Birds In The Ecuadorian Andes, Mark R. Welford Jan 2001

The Importance Of Early Successional Habitats To Rare, Restricted-Range, And Endangered Birds In The Ecuadorian Andes, Mark R. Welford

Earth, Environment & Sustainability: Faculty Publications

Since the mid-1980s, exhausted pastures in Ecuador have been increasingly abandoned, allowing forest regeneration. At approximately 2,200 m in the Tandayapa valley I surveyed four abandoned pastures to evaluate their use by birds. Each former pasture represented a different age of vegetation maturity. The number of bird species recorded in each successively older abandoned pasture increased but only half the number of species recorded in the undisturbed forest site was recorded in the most mature pasture. However, at least four restricted-range bird species were recorded in a single pasture. As pastures rapidly convert to secondary forest, more bird species and …

Spatial And Temporal Distribution Of Tsetse Fly Trap Catches At Nguruman, Southwest Kenya, A. Odulaja, J. Baumgärtner, S. Mihok, I. M. Abu-Zinid Jan 2001

Spatial And Temporal Distribution Of Tsetse Fly Trap Catches At Nguruman, Southwest Kenya, A. Odulaja, J. Baumgärtner, S. Mihok, I. M. Abu-Zinid

All Peer-Reviewed Publications

Spatial and temporal dynamics of rapidly growing populations of tsetse flies at Nguruman, southwest Kenya during 1993-1995, were investigated, following six years of intensive population suppression with traps over a c. 100 km2 area. The two tsetse species present were randomly distributed in the short rainy season, but were aggregated in the dry and long rainy seasons. Maximum temperature was the dominant weather factor associated with the degree of aggregation. Trends in catches at 20 fixed sites along an 18 km north-south axis were weakly correlated between locations, possibly representing population sub-structuring. In particular, trends in population change were poorly …

The Diversity Dialogues In Higher Education, John H. Bunzel Jan 2001

The Diversity Dialogues In Higher Education, John H. Bunzel

Fordham Urban Law Journal

It is hard to be an enemy of diversity. Most Americans recognize diversity as one of the nation’s proudest attributes. Beyond that, however, there is confusion over the term’s meaning. No matter how often people say the word, or how strongly they believe in it, they continue to ignore the way diversity has become an all-embracing concept. The term “diversity” has become a code word that fails to define precisely what it allegedly exalts and what exactly is to be accomplished by those who extol its virtues. The elasticity of the term “diversity” has masked many kinds of questionable conduct. …

Introduction To Torture As Tort: From Sudan To Canada To Somalia, Craig M. Scott Jan 2001

Introduction To Torture As Tort: From Sudan To Canada To Somalia, Craig M. Scott

Articles & Book Chapters

The present work is chapter 1 of the edited volume, Torture as Tort: Comparative Perspectives on the Development of Transnational Human Rights Litigation (Hart Publishing, Oxford, 2001). At the time the book was generated, the controversial nature of seeking globalised justice through national courts had become starkly apparent in the wake of the Pinochet case in which the Spanish legal system sought extradition of the former President of Chile from the United Kingdom in order to bring him to account under Spanish criminal law for a variety of alleged violations in Chile of human rights, most notably involving torture. Yet, …

Aboriginal Rights In Transition: Reassessing Aboriginal Title And Governance, Kent Mcneil Jan 2001

Aboriginal Rights In Transition: Reassessing Aboriginal Title And Governance, Kent Mcneil

Articles & Book Chapters

In a series of important decisions, the Court has come to grips with a number of issues that it did its best to avoid in the past, involving the identification and definition of Aboriginal rights, the content of Aboriginal title to land and the requirements for proving it, and the relevance of the law of New France to Aboriginal rights today. This paper will focus on these recent developments in the law, as well as attempting to identify areas where the law of Aboriginal rights is incomplete and so requires further judicial elucidation.

The Internet In Light Of Traditional Public And Private International Law Principles And Rules Applied In Canada, Jean-Gabriel Castel Jan 2001

The Internet In Light Of Traditional Public And Private International Law Principles And Rules Applied In Canada, Jean-Gabriel Castel

Articles & Book Chapters

In general, the jurisdiction of a state to prescribe, to adjudicate, and to enforce' is related to physical location. Yet, physical location is foreign to the Internet, which can be defined as the electronic medium of worldwide computer networks within which online communication takes place. The absence of physical location calls into question the applicability of the traditional public and private international law principles and rules that are based primarily on territoriality, in order to delineate the jurisdiction of states and their courts over the Internet and its users.

The Soul Of A New Political Machine: The Online, The Color Line And Electronic Democracy, Eben Moglen, Pamela S. Karlan Jan 2001

The Soul Of A New Political Machine: The Online, The Color Line And Electronic Democracy, Eben Moglen, Pamela S. Karlan

Faculty Scholarship

In this Essay, we want to suggest two ways in which people's experience with the Internet may affect how they think politics ought to be organized, and to consider the consequences for the political aspirations of minority communities. First, the notion of "virtual communities” – that is, communities that affiliate along nongeographic lines – may provide new support for alternatives to traditional geographic districting practices. As Americans become more comfortable with the idea that people can belong to voluntarily created, overlapping, fluid, nongeographically defined communities, which may be as important as the physical communities in which they live, they may …

A Comparison Of The Health Beliefs Of Florence Nightingale And Ellen G. White And The Incorporation Of Them Into Their Respective Schools Of Nursing, Ruth Duncan Abbott

Dissertations

This study explored the similarities and differences of the health beliefs of Ellen G. White and Florence Nightingale and how these beliefs were incorporated into each of their respective schools of nursing, the Nightingale Training School for Nurses at St. Thomas' Hospital and the Medical Missionary Training School for Nurses at the Battle Creek Sanitarium in Battle Creek, Michigan. The research also examined the contextual factors that shaped each woman's philosophy and influenced the manner in which they carried out their work. Additionally, the research provides information about the historical context surrounding the beginnings of modern nursing, education, health, society, …
