Remembering Chrystal Macmillan: Women's Equality And Nationality In International Law, Karen Knop, Christine Chinkin Jan 2001

Remembering Chrystal Macmillan: Women's Equality And Nationality In International Law, Karen Knop, Christine Chinkin

Michigan Journal of International Law

This article both continues and returns to the story of Chrystal Macmillan and the International Law Association. Some seventy-five years later, gender discrimination still exists in nationality law. For an American audience, Thailand's offer of nationality to U.S. golfer Tiger Woods, whose mother is Thai, highlighted the inequality of Thailand's laws on nationality. Although Thai women, as well as Thai men, can now pass their nationality to their children, the law continues to discriminate against women in other matters of nationality. Whereas the foreign wives of Thai men are specially entitled to apply for Thai nationality, the foreign husbands of …

Juridical And Jurisdictional Disconnects, Mark A. Drumbl Jan 2001

Juridical And Jurisdictional Disconnects, Mark A. Drumbl

Scholarly Articles

Although extraterritorial trials for human rights abusers certainly achieve some justice, this Article posits -- through a case-study of post-genocide Rwanda -- that the effects of such trials are circumscribed by the fact they may have little meaning among perpetrators and victims in post-conflict societies. This limited meaning particularly attaches to trials conducted extraterritorially through international tribunals as well as trials conducted in foreign national courts through the exercise of what loosely is called "universal jurisdiction." This circumscribed meaning results in these trials' having limited deterrence effects, although they may go some way to satisfying the deontological need to punish …

An Integrative Hierarchical Framework For Environmental Valuation: Value Pluralism, Thresholds, And Deliberation, Randall S. Rosenberger Jan 2001

An Integrative Hierarchical Framework For Environmental Valuation: Value Pluralism, Thresholds, And Deliberation, Randall S. Rosenberger

Regional Research Institute Working Papers

When assessing people’s values for the natural environment, a variety of methodological approaches may be required. This is because value pluralism negates the ability to reduce the various kinds of values to a single conception of value or super-value. Environmental valuation endeavors are defined by the question to be answered. However, for some people, the methodology employed may conflict with their perception of the issue and what values are most important to them, i.e., the methods employed are not globally incentive compatible with all modes of expressing one’s values. Therefore, any single disciplinary approach to environmental valuation may ignore these …

Quality Of Life Satisfaction: A Comparative Survey Analysis Of The Eastern Panhandle And Southern West Virginia Counties, James O. Bukenya, Tesfa Gebremedhin Jan 2001

Quality Of Life Satisfaction: A Comparative Survey Analysis Of The Eastern Panhandle And Southern West Virginia Counties, James O. Bukenya, Tesfa Gebremedhin

Regional Research Institute Working Papers

The main objective of this paper is to analyze and report quality of life survey responses from a random sample of over 1028 individuals from 21 counties in West Virginia. The survey responses are drawn from a quality of life survey conducted in 2000. Perhaps the most interesting observation from the responses was not that differences exist among counties but that, in all counties, the level of satisfaction was remarkably high (over 50%). Only small fractions of individuals were explicitly dissatisfied, surprisingly in counties with the highest growth levels in per capita incomes.

Comparing Three Spatial Cluster Tests From Rare To Common Spatial Events, Ge Lin Jan 2001

Comparing Three Spatial Cluster Tests From Rare To Common Spatial Events, Ge Lin

Regional Research Institute Working Papers

In the past few years, several new tests for spatial clustering have been proposed. With ever increasing capability of GIS and wider availability of spatial statistic functions, spatial analysts are likely to face challenge of properly using these tests. Seemingly gaps also exist between the development of new tests and follow up evaluations against various assumptions. In this research note, I compare three cluster tests along a range of distribution from rare to common spatial events. The results not only revealed sensitive data feature that each test is designed to detect, but also clarified the interpretation based on the nature …

Phylogeny Of The Celastraceae Inferred From Phytochrome B Gene Sequence And Morphology, Mark P. Simmons, Curtis C. Clevinger, Vincent Savolainen, Robert H. Archer, Sarah Mathews, Jeff J. Doyle Jan 2001

Phylogeny Of The Celastraceae Inferred From Phytochrome B Gene Sequence And Morphology, Mark P. Simmons, Curtis C. Clevinger, Vincent Savolainen, Robert H. Archer, Sarah Mathews, Jeff J. Doyle

Faculty Publications

Phylogenetic relationships within Celastraceae were inferred using a simultaneous analysis of 61 morphological characters and 1123 base pairs of phytochrome B exon 1 from the nuclear genome. No gaps were interred, and the gene tree topology suggests that the primers were specific to a single locus that did not duplicate among the lineages sampled. This region of phytochrome B was most useful for examining relationships among closely related genera. Fifty-one species from 38 genera of Celastraceae were sampled. The Celastraceae sensu lato (including Hippocrateaceae) were resolved as a monophyletic group. Loesener's subfamilies and tribes of Celastraceae were not supported. The …

Outside/In: Crossing Queer And Latino Boundaries, Luis Aponte Pares Jan 2001

Outside/In: Crossing Queer And Latino Boundaries, Luis Aponte Pares

Community Studies Faculty Publication Series

In this essay, I posit that to fully grasp the degree to which Latinos have latinized New York City's landscapes, the role Latino queers play in this process merits examination. Latino queers have begun to challenge queer institutions. They also aim to be coproducers of a queer imaginary and appropriate places of queer culture, thus Latinizing queer culture. They also claim a role in the coproduction of a Latino imaginary. By adding sexual orientation to this identity, queers indeed "queer," mariconear, decenter heteronormative Latino culture, perhaps producing a new "conception of 'identity,' which lives with and through, not despite, difference," …

Ethics As Grammar: Changing The Postmodern Subject, Brad Kallenberg Jan 2001

Ethics As Grammar: Changing The Postmodern Subject, Brad Kallenberg

Theology and Religious Studies Faculty Publications

Wittgenstein, one of the most influential, and yet widely misunderstood, philosophers of our age, confronted his readers with aporias—linguistic puzzles—as a means of countering modern philosophical confusions over the nature of language without replicating the same confusions in his own writings. In Ethics as Grammar, Brad Kallenberg uses the writings of theological ethicist Stanley Hauerwas as a foil for demonstrating how Wittgenstein’s method can become concrete within the Christian tradition. Kallenberg shows that the aesthetic, political, and grammatical strands epitomizing Hauerwas’s thought are the result of his learning to do Christian ethics by thinking through Wittgenstein.

Kallenberg argues that …

Ecology And Management Of Aspen: A Lake States Perspective, D.T. Cleland, L.A. Leefers, D.I. Dickmann, L.G. Eskew Jan 2001

Ecology And Management Of Aspen: A Lake States Perspective, D.T. Cleland, L.A. Leefers, D.I. Dickmann, L.G. Eskew

Aspen Bibliography

Aspen has been an ecologically important, though relatively minor, compo- nent of the Lake States (Michigan, Wisconsin, and Minnesota) forests for millennia. General Land Office records from the 1800s indicate that aspen comprised a small fraction of the region’s eastern forests, but was more extensive on the western edge. Then Euro-American settlement in the 1800s brought land clearing, timber harvesting, and subsequent widespread wildfires that increased aspen-birch acreages consider- ably. Although aspen-birch acreage has declined since the 1930s, it remains the region’s second most prevalent forest type. Aspen management is probably the most contentious issue confronting forest managers in the …

Changes In Landscape Patterns And Associated Forest Succession On The Western Slope Of The Rocky Mountains, Colorado, Daniel James Manier, Richard D. Laven Jan 2001

Changes In Landscape Patterns And Associated Forest Succession On The Western Slope Of The Rocky Mountains, Colorado, Daniel James Manier, Richard D. Laven

Aspen Bibliography

Using repeat photography, we conducted a qualitative and quantitative analysis of changes in forest cover on the western slope of the Rocky Mountains in Colorado. For the quantitative analysis, both images in a pair were classified using remote sensing and geographic information system (GIS) technologies. Comparisons were made using three landscape metrics: total relative cover, mean relative patch size, and number of patches per major vegetation type. We noted several important changes in the pattern of the landscape and the structure of the forests. The relative area covered by interspersed, nonforested rangelands has decreased significantly, and the total forest cover …

Quaking Aspen Reproduce From Seed After Wildfire In The Mountains Of Southeastern Arizona, Ronald D. Quinn, Lin Wu Jan 2001

Quaking Aspen Reproduce From Seed After Wildfire In The Mountains Of Southeastern Arizona, Ronald D. Quinn, Lin Wu

Aspen Bibliography

Quaking aspen regenerated from seed after a stand replacement wildfire in the Chiricahua Mountains of southeastern Arizona. The wildfire had created gaps in the canopy so that aspen were able to establish from seed. Seedlings were found at a mean density of 0.17 m–2, 30 m or more from the nearest potential seed trees. Six clumps of aspen seedlings contained 18–186 trees, occupying areas of 145–500 square meters at densities of 0.09-0.27 m–2. White-tailed deer (Odocoileus virginianus) browsed 14.3% of the seedlings. Occasional sexual reproduction of aspen may be a general trait of the species throughout the western portion of …

Legal Skills For A Transforming Profession, Gary A. Munneke Jan 2001

Legal Skills For A Transforming Profession, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

The legal profession is undergoing dramatic changes that will drive a reformation in legal education. Legal educators must anticipate these changes to effectively prepare students for the practice of law in the twenty-first century. In order to be proficient practitioners, these students will require an expanded set of professional skills. Although the current legal skills paradigm was articulated by the American Bar Association MacCrate Task Force in 1991, it is time to reexamine legal skills with an eye toward preparing students to practice law in the new millennium. In Section II, this article examines trends in modern society and the …
