When History Is History: Maxwell Street, "Integrity," And The Failure Of Historic Preservation Law, Mark D. Brookstein

Chicago-Kent Law Review

As part of its $500-million expansion, the University of Illinois, Chicago Campus, is expanding its present campus south over the area that includes historic Maxwell Street, Chicago's entry point for disparate ethnic and racial groups. Interested parties sought to have the area declared a historic district under the National Historic Preservation Act in order to prevent demolition of many buildings in the area. The nomination was subsequently rejected by the keeper of the National Register, after the city of Chicago recommended against nomination due to Maxwell Street's blighted condition. Burning And Burying In Connecticut: Are Regional Solutions To Solid Waste Disposal Equitable?, Timothy Black, John A. Stewart

New England Journal of Public Policy

To comply with federal legislation, states throughout the country are replacing old town dumps with a regional system for municipal solid waste disposal.This system includes trash-to-energy incinerators and ash landfills as well as recycling and reduction facilities. While these new types of facilities are expected to be environmentally safer, they have concentrated the disposal process of waste generated throughout the state in fewer locations. State leaders champion the use of newer, cleaner disposal methods, while local community groups complain that they have become the dumping grounds for the state. This is the first environmental equity study to examine whether these …

Contrary to the bleakest predictions offered by environmental fatalists during the latter half of the 1900s, humanity and much of the plant and animal kingdom survived New Year's Eve 1999. Crossing Myriad Borders: A Dimensional Analysis Of The Migration And Health Experiences Of Indigenous Oaxacan Women, Sharon Mcguire Phd, Op, Msn, Rn-C

Dissertations

The growing feminization of the migration of ethnic indigenous women, such as Mixtecs, Zapotecs and Triquis from the southern Mexican state of Oaxaca, are altering the dynamics and configuration of traditional Mexican migration, making it especially significant for the health professions. Informed by a postcolonial ecofeminist paradigm, this bi-national grounded theory study explored the migration and health experiences of indigenous Oaxacan immigrant/migrant women. Data collection using participant observation and interviewing occurred in Oaxaca, Mexico, along the US-Mexico border, and the interior of California. Dimensional analysis was used as the method of data analysis to generate theoretical understandings of these phenomena. …

Categories used by contemporary environmental philosophers to explore esthetic appreciation for the beauty of the physical world have parallels in reflections by patristic and medieval theologians on the beauty of God's creation, A sampling of the theologians' notions yields a promising foundation for ecological ethics from a theistic perspective, especially when understood from their world view at the time the text was written, reformulated to reflect broad scientific findings about the world today, and worked creatively to identify norms for human behavior.

Economics V. Equity Ii: The European Experience, Stephen M. Johnson

Articles

Lawmakers in the European Union and its member states, like their counterparts in the United States, increasingly are using economic tools to protect the environment while reducing their focus on command and control regulation. The reliance on economic approaches to environmental protection may disproportionately impact low income and minority communities. Although evidence of environmental injustice in Europe is not as strong as in the United States, several recent studies demonstrate that traditional environmental protection measures in Europe have disproportionately funneled pollution to low income communities. Economic-based environmental measures can only exacerbate that trend.

This document constitutes the Record of Decision (ROD) of the Department of the Interior, regarding the preferred alternative for Colorado River Interim Surplus Guidelines (Guidelines). The Secretary of the Interior (Secretary) is vested with the responsibility of managing the mainstream waters of the lower Colorado River pursuant to federal law. This responsibility is carried out consistent with applicable federal law. In proving a case of adverse disparate impact discrimination under Title VI of the 1964 Civil Rights Act, a plaintiff in its prima facie case must show a significant disparity between an affected population and an appropriate comparison population. Both government agencies and commentators have neglected to address the crucial issue of how to elect and define a comparison population. Title VI cases often look to Title VII cases for guidance. Title VII cases require that a comparison population should be similarly situated to the affected population. In 2000, the Environmental Protection Agency ("the EPA" or "the Agency") issued draft …
