This Article looks at how EPA is managing the fairness issue in a discrete but highly charged context: permit issuances that affect heavily impacted communities. This Article first provides a discussion of how fairness-oriented reform might evolve within the permit process. This section also examines permit issuances that were appealed to the U.S. Environmental Appeals Board (EAB) on environmental justice grounds. Proceeding one step beyond environmental law, the Article looks at how EPA is responding to claims of disparate impact under Title VI of the Civil Rights Act. In an effort to address the well-documented and serious problem of environmental justice in the United States, President William J. Clinton issued Executive Order (EO) No. 128981 on February 11, 1994. The EO represented the culmination of a century of rapid changes in society's attitudes toward the placement of hazardous facilities in poor, disadvantaged, and minority communities, as well as the denial of services to these communities. This survey examines the impact of the EO on federal agencies. Environmental justice is not a problem unique to the late 20th century. Majoritarian societies have historically discriminated against minority groups.3 For example, …

Introduction:
The first world conference on breast cancer, held in Kingston, Ontario, in July 1997, provided a unique opportunity for activists, concerned about the possible links between breast cancer and the environment, to share their concerns in an international forum, with oncologists, radiologists, epidemiologists, survivors and alternative therapists. It also clearly exposed the fracture lines between competing discourses of risk and responsibility, between groups charged with a duty to protect and to care - health professionals, epidemiologists, statutory bodies, and those taking on those duties - generally activists, from environmental, feminist and survivor groups. The existence of thriving and numerous small businesses is instrumental to generating wealth within a community. They provide a diverse employment base for local residents, leading to greater economic stability. Small businesses create opportunities for keeping dollars circulating within the community, multiplying the benefits of those dollars. Creating such internal-multipliers within the economy of a community is a strategy for strengthening the community as a whole. This benefit extends to communities of color, immigrant communities, ethnic minority communities, and sexual minority communities.

Public participation is an important aspect of brownfields redevelopment. Because brownfields are a localized issue, those most affected by a site should have a say in its redevelopment. Both the process of redevelopment and the final outcome must measure the success of a brownfields project.
Perth Amboy, New Jersey, in conjunction with the Middlesex County Vocational School System, is in the process of preparing former brownfields land into a new vocational -technical high school. Congested roadways and declining air quality standards are major concerns for many communities faced with the challenges of suburban growth and city decay. How each community chooses to fight the problems created by urban sprawl depends greatly on individualized characteristics of the community. Analyzing and understanding unique values of each community provides a sound foundation for measures designed to promote sustainable growth initiatives. Peace, Justice and, Earth Week, an annual series of student sponsored events intended to raise awareness about peace action, human rights and environmental issues around the world, takes place at the college. College officials and community leaders host a town meeting to discuss measures to prevent alcohol-related violence on campus. In protest of President Bush's proposed spending of $160 billion on a Defense Missile Shield, students display a 50 foot inflatable missile outside Lowry Center. This research paper outlines methods for American Indians’ and military land managers’ collaborative work of accomplishing resource stewardship aimed at achieving both the Indians’ “One Earth” and military “Mission Preparedness” postures. The research goal is to benefit military facility managers’ by providing tools to establish interaction programs with Indian Tribes and organizations. The paper provides a process framework, gleaned from on-going programs, directives, and policies identified by reviewing books, journals, and reports. A comparison of the process-streams from several programs was conducted determining steps recurring in the programs. These repeated steps form key processes for use by installation managers in …

Rescuing Paha Sapa: Achieving Environmental Justice By Restoring The Great Grasslands And Returning The Sacred Black Hills To The Great Sioux Nation, John P. Lavelle

Looking at a unique proposal of the Conservation Alliance of the Great Plains for establishing a "Greater Black Hills Wildlife Protected Area" in the Northern Plains region. Especially in light of the proposal's potential impacts on the continuing efforts of the Sioux tribes of this region to secure the return of the sacred Black Hills to sovereign tribal ownership.
