Explanatory Notes, Shipboard Scientific Party, Amelia E. Shevenell
Marine Science Faculty Publications
This chapter explains the techniques and procedures used during Leg 189 to help document the basis for our preliminary scientific conclusions and to provide the interested investigator with the information needed to select samples for further analysis. This information concerns only shipboard operations and analyses described in the site reports in the Leg 189 Initial Reports volume of the Proceedings of the Ocean Drilling Program. The methods used by various investigators for shore-based analyses of Leg 189 data will be described in the individual scientific contributions published in the Scientific Results volume and in publications in various professional journals.
Experiences Of Relapse In Smoking Cessation, Natalie Kay D'Abrew
Experiences Of Relapse In Smoking Cessation, Natalie Kay D'Abrew
Theses : Honours
Relapse is regarded as a common occurrence, and it is known that smokers make an average of three to four attempts to cease smoking before maintaining smoking cessation. Thus, relapse continues to be a problem for interventions for smoking cessation. This qualitative study explored the experiences of relapse in smoking cessation. Fourteen participants, seven maintainers and seven relapsers aged between 21-80 participated in the study, which was facilitated by a semi-structured interview format. Several themes and sub-themes were generated under the categories of strategies, reasons for relapse, and reasons for cessation. The themes highlighted that there were differences between the …

The 2001 Federal Economic Crime Sentencing Reforms: An Analysis And Legislative History, Frank O. Bowman Iii
The 2001 Federal Economic Crime Sentencing Reforms: An Analysis And Legislative History, Frank O. Bowman Iii
Faculty Publications
This Article has four parts. First, it describes the general structure of the Federal Sentencing Guidelines and the approach to sentencing economic crimes in effect between 1987 and 2001. Second, it outlines the defects in the former economic crime guidelines that led to the call for reform. Third, it describes the process undertaken by the Sentencing Commission that led to the passage of the 2001 economic crime amendments and, in so doing, provides a roadmap to sources of legislative history. Fourth, it explains and analyzes the new guidelines in light of their legislative history, with primary emphasis on the consolidated …
Chinese Mortgage Law: An American Perspective, Dale A. Whitman
Chinese Mortgage Law: An American Perspective, Dale A. Whitman
Faculty Publications
My objective in this paper is to compare and to evaluate some of the features of the American and Chinese systems. I do so without any preconception that the American system provides better answers, but with the recognition that it is far more mature and provides more answers. Hence it provides a reference point from which the Chinese system can be considered. Perhaps each system has something to teach the other.

Morris Berman tells the story of his maternal grandfather, who, when he was five years old in 1883 or 1884, was sent to a Jewish elementary school in Belorussia. On the first day of class, the teacher startled the young boy by taking each child's slate and smearing the first two letters of the Hebrew alphabet—aleph and beys—on it in honey. His grandfather's first lesson consisted of eating the letters off the slate. The symbolism of this act is complex, Berman muses, but central to the ritual is the belief that what is real must be taken into …

Imperfection: The Will-To-Control And The Struggle Of Letting Go, W. Keith Duffy
The Journal of the Assembly for Expanded Perspectives on Learning
As I found myself beginning to appropriate my students' writing more and more, I wondered if this was evidence of a spiritual imbalance—an unwillingness to acknowledge my own imperfection as a teacher and human being.

Remembering Chrystal Macmillan: Women's Equality And Nationality In International Law, Karen Knop, Christine Chinkin
Remembering Chrystal Macmillan: Women's Equality And Nationality In International Law, Karen Knop, Christine Chinkin
Michigan Journal of International Law
This article both continues and returns to the story of Chrystal Macmillan and the International Law Association. Some seventy-five years later, gender discrimination still exists in nationality law. For an American audience, Thailand's offer of nationality to U.S. golfer Tiger Woods, whose mother is Thai, highlighted the inequality of Thailand's laws on nationality. Although Thai women, as well as Thai men, can now pass their nationality to their children, the law continues to discriminate against women in other matters of nationality. Whereas the foreign wives of Thai men are specially entitled to apply for Thai nationality, the foreign husbands of …

The Asbestos Case And Dispute Settlement In The World Trade Organization: The Uneasy Relationship Between Panels And The Appellate Body, Sydney M. Cone Iii
Michigan Journal of International Law
This article deals with the working-level dispute-settlement apparatus of the World Trade Organization ("WTO"). In particular, it discusses the work of the Appellate Body and, functioning below it, panels established by the WTO to conduct proceedings in individual cases. It focuses on the relationship between the Appellate Body and panels, and on the responsibilities of the Appellate Body in the context of that relationship.
How International Is 'International' Law?, Kurt Taylor Gaubatz, Matthew Macarthur
How International Is 'International' Law?, Kurt Taylor Gaubatz, Matthew Macarthur
Michigan Journal of International Law
The international legal community posits universality as a central characteristic of modern international law. But there has been little work to assess the degree to which international legal norms are widely shared and incorporated into the foreign policy-making of states. Previous work in this area has attempted to describe the distribution of legal values across cultures. This work has proven contradictory and inconclusive. The epistemic communities literature suggests looking at the distribution of practitioners as an alternative approach for assessing the diffusion of norms and practices. In fact, the community of litigators who practice before the International Court of Justice …
What's In A Name? Law's Identity Under The Tort Of Appropriation, Jonathan Kahn
What's In A Name? Law's Identity Under The Tort Of Appropriation, Jonathan Kahn
Faculty Scholarship
This article is divided into three parts. In Part I, the article explores the notion that under the tort of appropriation, a person’s name is understood to implicate critical aspects of her identity. This notion is explored in relation to specific historical cases raising the issues of whether a woman who adopts her husband’s name has a property right in that name and whether a person who adopts a professional or stage name has separate rights in that name apart from his legal name. Second, Part II focuses on a person’s right to maintain the integrity of his physical image. …
