Deconstructing Family: A Critique Of The American Law Institute's "Domestic Partners" Proposal, Lynn D. Wardle Sep 2001

Deconstructing Family: A Critique Of The American Law Institute's "Domestic Partners" Proposal, Lynn D. Wardle

BYU Law Review

In promulgating the Principles of the Law of Family Dissolution: Analysis and Recommendations ("Family Dissolution Principles"), the American Law Institute (ALI) proposes an extensive set of new rules to apply in proceedings relating to family dissolution. One of the major policy changes in family law proposed by the Family Dissolution Principles is the expansion of the scope of relationships that are treated as family relations. Many relationships that in the past have been called "alternative relationships" (alternative to family relationships) are treated in the ALI Principles as equal to and given the same legal protections, benefits, rights, and remedies as …

Functional And Structural Adaptations Of Skeletal Muscle To Microgravity, Robert H. Fitts, Danny R. Riley, Jeffrey J. Widrick Sep 2001

Functional And Structural Adaptations Of Skeletal Muscle To Microgravity, Robert H. Fitts, Danny R. Riley, Jeffrey J. Widrick

Biological Sciences Faculty Research and Publications

Our purpose is to summarize the major effects of space travel on skeletal muscle with particular emphasis on factors that alter function. The primary deleterious changes are muscle atrophy and the associated decline in peak force and power. Studies on both rats and humans demonstrate a rapid loss of cell mass with microgravity. In rats, a reduction in muscle mass of up to 37% was observed within 1 week. For both species, the antigravity soleus muscle showed greater atrophy than the fast-twitch gastrocnemius. However, in the rat, the slow type I fibers atrophied more than the fast type II fibers, …

Citizen Participation In Judicial Decision Making: Juries, Lay Judges And Japan, Richard O. Lempert Sep 2001

Citizen Participation In Judicial Decision Making: Juries, Lay Judges And Japan, Richard O. Lempert

Articles

In the late 1920s and 1930s Japan had a jury system. It was suspended in 1943 as a wartime measure, but it had fallen into desuetude long before that. Arguably it was like the Spanish jury, which has several times risen during periods of relative political liberalism or populism and been suppressed during periods of militarism and autocracy. That is, it may be more than a coincidence that use of the Japanese jury fell precipitously during the 1930s as militarism took hold of the Japanese nation. Now the reinstatement of the Japanese jury is again being seriously considered. Similarly it …

Determining Matric Stress With The Modified Cam Clay Energy Relationship, Richard A. Rohlf, Larry G. Wells Sep 2001

Determining Matric Stress With The Modified Cam Clay Energy Relationship, Richard A. Rohlf, Larry G. Wells

Biosystems and Agricultural Engineering Faculty Publications

The stress generated by matric suction, or matric stress, was determined at points along the stress path with an analytical and experimental procedure based on the modified Cam clay energy relationship. Matric stress was found to be approximately constant at large strain for constant water content triaxial compression tests. Matric stress was included in both shear and volume relationships in a critical–state soil model that employed the modified Cam clay yield function. Shear was modeled with a constant matric stress. Slope of the normal compression and recompression lines was adjusted for matric stress using a state function that expressed matric …
