A Comment On The Complementary Jurisdiction Of The International Criminal Court: Adding Insult To Injury In Transitional Contexts?, Jennifer J. Llewellyn Oct 2001

A Comment On The Complementary Jurisdiction Of The International Criminal Court: Adding Insult To Injury In Transitional Contexts?, Jennifer J. Llewellyn

Dalhousie Law Journal

The author examines the principle of complementarity on which the jurisdiction of the International Criminal Court (ICC) is based. Unlike its predecessors, the International Criminal Tribunals for the former Yugoslavia and Rwanda, the ICC can only take jurisdiction over a case when a state is unwilling or unable to investigate or prosecute. The Court is thus designed to complement the work of national criminal courts. This article assesses whether this admissibility standard will allow the ICC to complement the work of truth commissions like that of the South African Truth and Reconciliation Commission. It concludes that the prospect of an …

The Legislature, The Executive And The Courts: The Delicate Balance Of Power Or Who Is Running This Country Anyway?, A Wayne Mackay Oct 2001

The Legislature, The Executive And The Courts: The Delicate Balance Of Power Or Who Is Running This Country Anyway?, A Wayne Mackay

Dalhousie Law Journal

The expanding role of Canadian courts since the introduction of the Charter has prompted critics to decry what they see as excessive and "anti-democratic" judicial activism. The author addresses such criticisms, responding, in particular, to the arguments of Ted Morton and Rainer Knopff. The article critiques the basic elements of Morton/Knopf's thesis: that activist courts are anti-democratic, excessively political, and engaging in illegitimate law-making. Rejecting the claim that Canada's judiciary is a less democratic state institution, the author notes the powerful law and policy-making role performed by the federal cabinet-for practical purposes, an unelected body. The author endorses the dialogue …

Brightening The Covenant Chain: Aboriginal Treaty Meanings In Law And History After Marshall, Mark D. Walters Oct 2001

Brightening The Covenant Chain: Aboriginal Treaty Meanings In Law And History After Marshall, Mark D. Walters

Dalhousie Law Journal

The decision of the Supreme Court of Canada in R. v. Marshall raises some difficult questions about the interpretation of Crown-Aboriginal treaties, especially treaties dating from the eighteenth century. The Court acknowledged that the treaty context is important to establishing the meaning of treaty texts, and Aboriginal and non-Aboriginal perspectives must be considered. As a result, judges must have regard to historical analyses of Crown-Aboriginal relations when interpreting these old treaties. In this article, the author explores some of the complex theoretical problems that such legal-historical analyses create, focusing in particular upon the possibility that lawyers and judges may reach …

The Institutional And Substantive Effects Of The Human Rights Act In The United Kingdom, Christopher D. Jenkins Oct 2001

The Institutional And Substantive Effects Of The Human Rights Act In The United Kingdom, Christopher D. Jenkins

Dalhousie Law Journal

This article reviews the institutional and substantive impact that the Human Rights Act has on English law through its incorporation of the European Convention on Human Rights. Under the Act, higher courts can now move beyond a formalistic method of judicial review and substantively evaluate legislation in light of the Convention. The judiciary can accordingly issue declarations that statutes are incompatible with the Convention which, although not invalidating the act in question, will bring considerable political pressure to bear on Parliament to ensure compliance. The Act further directs courts to give special regard to the decisions of the European Court …

The Influence Of Affective State And Social Loafing On Teams Over Time, Amy N. Cunningham Oct 2001

The Influence Of Affective State And Social Loafing On Teams Over Time, Amy N. Cunningham

Psychology Theses & Dissertations

Teams are a growing force in the workplace today. An interesting aspect of team research in recent years involves the maturation of teams over time and the processes teams go through as a novice team to a fully accomplished performing team. One impediment to team maturation and performance is social loafing. There were two goals in the present research and are presented in the following questions. First, do team members' effective states influence social loafing? Second, does team training affect affective state of team members, social loafing, and performance? These variables were investigated, using an interrupted time series design, as …

Determination Of Life Cycle Cost Under Uncertainty, Hamoud R. Al-Otaibi Oct 2001

Determination Of Life Cycle Cost Under Uncertainty, Hamoud R. Al-Otaibi

Mechanical & Aerospace Engineering Theses & Dissertations

The subject of this thesis is a Life Cycle Cost (LCC) model that takes into consideration the uncertainty of equipment failure rate and input data. The outcome of LCC depends on numerous estimates, forecasts, assumptions, and approximations of real-life data. Each of these factors has the potential to introduce error into the results. The study focuses upon the database generated for equipment failure rates data developed from historical database based on Weibull distribution parameters. The model provides a method to simulate real-world project life cycle.

Computational Fluid Dynamic Study Of A Nascar Winston Cup Series Race Car, Terry L. Meek Jr. Oct 2001

Computational Fluid Dynamic Study Of A Nascar Winston Cup Series Race Car, Terry L. Meek Jr.

Mechanical & Aerospace Engineering Theses & Dissertations

Since the goal of NASCAR racing is to win and since drag is a force the vehicle must overcome, a thorough understanding of the drag generating airflow around and through the automobile is greatly desired. The external airflow contributes to most of the drag that a car experiences and most of the downforce the vehicle produces. Therefore, an estimate of the vehicle's performance may be evaluated using a computational aerodynamics model. This thesis presents a computational fluid dynamic (CFD) analysis of a NASCAR Winston Cup series race car to investigate the salient flow characteristics.

Before a computational analysis could be …

Development Of An Electrotransformation Technique For Streptococcus Iniae And Preliminary Characterization Of The Hemolysin Associated With This Bacterium, Kimberly Ann Hahn Oct 2001

Development Of An Electrotransformation Technique For Streptococcus Iniae And Preliminary Characterization Of The Hemolysin Associated With This Bacterium, Kimberly Ann Hahn

Biological Sciences Theses & Dissertations

Streptococcus iniae is a gram-positive organism responsible for causing disease in both freshwater as well as saltwater fish. Every year fisheries lose fish by the tons due to diseases caused by this organism. In 1991, the first reported human case of disease associated with this organism was described. Since this initial case, there have been numerous other reported cases of S. iniae infections. This organism is a catalase negative, facultatively anaerobic organism that produces a capsule and when plated onto blood agar demonstrates β-hemolytic activity.

In this study, the relationship between the hemolysin produced by S. iniae and the lactate …

Map Kinases In Cynomolgus Monkey Sperm Hyperactivation, Emily Nicole Haynes Oct 2001

Map Kinases In Cynomolgus Monkey Sperm Hyperactivation, Emily Nicole Haynes

Biological Sciences Theses & Dissertations

Mammalian sperm exhibit characteristic motility patterns, termed hyperactivated (HA) motility, associated with completion of capacitation. In cynomolgus monkey (Macaca fascicularis) sperm, this HA motility is dependent in vitro upon the addition of exogenous cyclic nucleotide mediators, caffeine and dibutyryl-cyclic adenosine monophosphate (dbcAMP). Previous reports have shown protein tyrosine phosphorylation to be an integral component of this caffeine- and cAMP-stimulated HA motility. This study investigated the involvement of the mitogen-activated protein (MAP) kinase-signaling cascade. Semen specimens were collected in Talp-HEPES medium from proven breeders via electroejaculation. After washing, sperm were incubated in the presence and absence of the MAP …

An Object-Oriented Resource Pool Model In Support Of Discrete Event Simulations, Srinivas Gullapalli Oct 2001

An Object-Oriented Resource Pool Model In Support Of Discrete Event Simulations, Srinivas Gullapalli

Electrical & Computer Engineering Theses & Dissertations

The proper distribution of resources is a key factor in simulation. Resources provide the supporting facilities, equipment, and personnel for carrying out activities. The number of resources has a direct impact on the overall effectiveness of the simulation as it does in real life. If the number is insufficient, it generally takes more time for the process to complete. On the other hand, if the number is too high, the cost incurred on the resources will be unnecessarily large. Therefore, the count should be a compromise between the two extremes.

In this thesis, an attempt is made to generalize the …
