Guarding The Sacred Fires: Elizabeth E. Farrell's Contributions To The Creation Of Special Education In New York City, Kimberly E. Kode Oct 2001

Guarding The Sacred Fires: Elizabeth E. Farrell's Contributions To The Creation Of Special Education In New York City, Kimberly E. Kode

Dissertations (1934 -)

The department Farrell founded became a model for those that followed, causing a ripple effect in the practice of teaching and the organization of school systems across the United States. Further, Farrell's involvement in professional organizations such as the Council for Exceptional Children and the New York State Psychological Association established the basis for a special education professional network, still in existence---and thriving-- today. Although a few short biographical pieces on Farrell are available, and she is referenced in numerous journal articles in the area of special education history, there has been no detailed account of Farrell's life and accomplishments. …

Can Process Theory Constrain Courts?, Michael C. Dorf, Samuel Issacharoff Oct 2001

Can Process Theory Constrain Courts?, Michael C. Dorf, Samuel Issacharoff

Cornell Law Faculty Publications

The political process theory introduced by the Carolene Products footnote and developed through subsequent scholarship has shaped much of the modern constitutional landscape. Process theory posits that courts may justifiably intervene in the political arena when institutional obstacles impede corrective action by political actors themselves. Judged by this standard, the United States Supreme Court's decision in Bush v. Gore was a failure, because the majority could not explain why its interference was necessary. More broadly, Bush v. Gore points to a central deficiency in process theory: it relies upon the Justices to guard against their own overreaching, but does not …

A Statistical Study Of Transient Event Motion At Geosynchronous Orbit, Jeff Sanny, David Berube, D. G. Sibeck Oct 2001

A Statistical Study Of Transient Event Motion At Geosynchronous Orbit, Jeff Sanny, David Berube, D. G. Sibeck

Physics Faculty Works

The geosynchronous GOES 5 and GOES 6 satellites frequently observe transient events marked by magnetic field strength increases and bipolar magnetic field signatures lasting several minutes. In this study we report a survey of 87 events observed simultaneously by both GOES spacecraft (for a total of 174 individual observations) from August to December 1984. Events detected in the prenoon sector outnumbered those in the postnoon sector by about a 3 to 1 ratio. The distribution of the events versus local time exhibited a significant prenoon peak like the distribution of magnetic impulse events observed in high-latitude ground magnetometers. A cross-correlation …

The Swine Flu Vaccine And Guillain-Barré Syndrome: A Case Study In Relative Risk And Specific Causation, David A. Freedman, Philip B. Stark Oct 2001

The Swine Flu Vaccine And Guillain-Barré Syndrome: A Case Study In Relative Risk And Specific Causation, David A. Freedman, Philip B. Stark

Law and Contemporary Problems

This article discusses the role of epidemiologic evidence in toxic tort cases, focusing on relative risk. Whether specific causation can be inferred if a relative risk is above 2.0 is discussed. The object is to explore the scientific logic behind intuitions of relative risk.

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown Oct 2001

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown

Law and Contemporary Problems

The quality of scientific predictions of risk in the courtroom and policy arena rests in large measure on how the two differences between normal practice and the legal/policy practice of science are reconciled. This article considers a variety of issues that arise in reconciling these differences, and the problems that remain with scientific estimates of risk when these are used in decisions.

Causation And The Law: Preemption, Lawful Sufficiency, And Causal Sufficiency, Richard Fumerton, Ken Kress Oct 2001

Causation And The Law: Preemption, Lawful Sufficiency, And Causal Sufficiency, Richard Fumerton, Ken Kress

Law and Contemporary Problems

This article briefly describes the normative/nonnormative distinction, and how one might invoke this distinction to locate a nonnormative dimension of actual causation. After briefly introducing Richard Wright's concept of a necessary element in a set of conditions for an effect, the article notes ambiguities in the critical concepts of necessity and sufficiency that he deploys. The article suggests the most plausible interpretation of Wright's use of different modal concepts.

Of Cherries, Fudge, And Onions: Science And Its Courtroom Perversion, David W. Peterson, John M. Conley Oct 2001

Of Cherries, Fudge, And Onions: Science And Its Courtroom Perversion, David W. Peterson, John M. Conley

Law and Contemporary Problems

The thesis of this article is that the Supreme Court decision in Daubert v. Merrell Dow Pharmaceuticals, Inc.'s focus on the scientific method, however rigorously applied, invites certain classes of abuses. There are instances in which evidence can be made to look more scientific by a process that in fact and substance makes is utterly unscientific.

Causation, Contribution, And Legal Liability: An Empirical Study, Lawrence M. Solan, John M. Darley Oct 2001

Causation, Contribution, And Legal Liability: An Empirical Study, Lawrence M. Solan, John M. Darley

Law and Contemporary Problems

This article presents empirical evidence of the ways people compare judgments of liability with judgments of causation and contribution. Specifically, the article reports the results of experiments designed to show whether people regard causation and enablement as necessary elements of liability.

Culture And Causality: Non-Western Systems Of Explanation, William M. O'Barr Oct 2001

Culture And Causality: Non-Western Systems Of Explanation, William M. O'Barr

Law and Contemporary Problems

The logic of some other systems of thought, explanation, and prediction are discussed, in order to find what can be learned about the sociocultural contexts and their functions in other cultures. The truths they may represent are about the human quest to understand causes and effects.

The Role Of Lawyers In The World Trade Organization, Peter D. Ehrenhaft Oct 2001

The Role Of Lawyers In The World Trade Organization, Peter D. Ehrenhaft

Vanderbilt Journal of Transnational Law

The World Trade Organization is a marvelously ambitious effort of now 140 countries to bring the rule of law to international trade. The WTO is a logical extension of the inspired ideas of the draftsmen of the General Agreement on Tariffs and Trade (GATT), who recognized at the end of World War II that the seeds of that conflagration were sown, in part, by the chaotic condition of international trade following World War I.

During that inter-war period, the United States adopted its Antidumping Act of 1921 and its Smoot-Hawley Tariff Act of 1930. Both survive to this day. By …

The Costs Of Conflict: The Impact On China Of A Future War, Andrew Scobell Dr. Oct 2001

The Costs Of Conflict: The Impact On China Of A Future War, Andrew Scobell Dr.

Books, Monographs & Collaborative Studies

It is increasingly important for Americans to think carefully about the vast complexities of the U.S.-China relationship, and the calculations that go into forming courses of action. The key question is: will China s so-called first priority of economic development and its resulting influence on domestic social stability curtail China s continuing reliance on military force as a means of exerting its influence? In addition, will economic development enhance China s comprehensive national power and thus contribute to some of China s more unhealthy goals, such as dominating the South China Seas, seizing Taiwan by force, or grabbing the Senkaku …

2001 Presidential Address: Do More With More, Dawn O. Braithwaite Oct 2001

2001 Presidential Address: Do More With More, Dawn O. Braithwaite

Department of Communication Studies: Faculty Publications

As I have listened to, and recently reread the addresses of our WSCA Presidents, I have been moved and challenged by their words and their wisdom. And their speeches are challenging. They have exhorted us to embrace quality discourse, to welcome change, to maintain the centrality of communication in the university of the 21st century, and to avoid becoming out-of-touch whiners. I wondered, what can I add to their words in my own address?

Over this past year, I have thought about my life as a communication professor. How are my times similar and different from those who have come …

Energetics And Cooperativity In Three-Center Hydrogen Bonding Interactions. Ii. Intramolecular Hydrogen Bonding Systems, Ruben D. Parra, Bing Gong, Xiao Cheng Zeng

Xiao Cheng Zeng Publications

High level ab initio calculations have been carried out on a number of intramolecular two- and three-center H-bonding structures containing the amide motif, NHC=O. These structures serve as model systems for probing the stability of intramolecular three-center H bonds of the type A1HA2. Particular attention is given to cooperative effects in the three-center H-bonding structures. A systematic assessment of cooperativity for intramolecular H-bonding systems is presented.

Synchronous Endometrioid Carcinoma Of The Ovary And Endometrium Associated With Ovulation Induction, Samir Ghourab Oct 2001

Synchronous Endometrioid Carcinoma Of The Ovary And Endometrium Associated With Ovulation Induction, Samir Ghourab

Saudi Medical Journal

Over the last 2 decades great concern about the possible association between ovarian cancer and ovulation induction has been raised. Between the first reported case in 1982 and the end of year 2000, there have been 44 cases of ovarian carcinoma reported to occur in women previously treated with ovulation induction drugs. Most of these tumors were of the serous type with low malignant potential. In the present case, the patient had secondary anovulatory infertility and previous left cystoophorectomy for ovarian endometrioma. She was treated with human menopausal gonadotrophin alone or in combination with clomiphene citrate for 13 cycles prior …
