A Response On Cardozo To Professors Kaufman And Schwarz, Richard H. Weisberg Jan 2001

A Response On Cardozo To Professors Kaufman And Schwarz, Richard H. Weisberg

Articles

The article responds to critiques of Benjamin Cardozo's jurisprudence by emphasizing his belief in the dual role of judicial subjectivity and adherence to legal precedent. Cardozo advocated for a balanced approach where judges use their "trained intuition" to seek justice, even when it requires departing from formal rules. The author argues that Cardozo's method is evident in numerous cases and stresses the importance of judicial craftsmanship and language in legal decisions.

Renal Function In Suckling And Fasting Pups Of The Northern Elephant Seal, Dorian S. Houser, Daniel E E. Crocker, Paul M. Webb, Daniel P. Costa

Arts & Sciences Faculty Publications

Elephant seals fast for prolonged periods without access to water. This is made possible, in part, by reductions in urine production. However, the mechanisms involved in reducing urine production are not understood. In this study, glomerular filtration rate (GFR) was measured in five northern elephant seal pups (Mirounga angustirostris) via the inulin clearance technique. Measurements were made during day 9 and day 18–22 of nursing and the second and eighth week of the postweaning fast. Plasma aldosterone and cortisol concentrations, quantified by radioimmunoassay, were measured in eight other weanlings during the second and eighth week of the fast. …

The Muddy Boundaries Between Res Judicata And Full Faith And Credit, Stewart E. Sterk Jan 2001

The Muddy Boundaries Between Res Judicata And Full Faith And Credit, Stewart E. Sterk

Articles

The Full Faith and Credit Clause of the U.S. Constitution requires states to respect and recognize the legal decisions of other states, but its application is limited when it comes to judgments that attempt to control future behavior or infringe on a state's sovereignty. The article argues that while the clause ensures finality and uniformity, it does not obligate states to enforce sister-state injunctions or orders that dictate conduct beyond their borders. This distinction is particularly evident in cases involving family law, where states retain flexibility to modify or ignore prior judgments based on evolving circumstances, such as the best …

Abraham S. Fischler College of Education ETD Archive

Moody Bible Institute (MBI) is an 115-year-old institution located in Chicago, Illinois. In addition to its fully accredited vocational ministry focused educational programs, MBI has extensive broadcasting and publishing enterprises. MBI is heavily dependent on donations for its continued existence and expansion. The problem was that with a finite amount of financial resources, competition arises between the demands for funding existing core programs and the allocation of funds for visionary initiatives related to the expansion of education, broadcasting, and publishing. The purpose of this study was the development of a five-year plan that will synchronize the funding of existing programs …

Databases And Portals For Knowledge Management, Soraya Abad-Mota

University Libraries & Learning Sciences Faculty and Staff Publications

The current availability, quantity and variability of Information Technology (IT) is overwhelming. Internet and the powerful set of tools loosely called "the web" dramatically changed the way people use this technology. We can take advantage of these new ways to try to capture an organization\'s knowledge and manage it effectively. Two key elements of IT that serve this purpose are databases and portals. In this chapter we explore the database and portal technologies, their interaction, and their potential for knowledge management. We also discuss briefly how databases and portals provide a good development opportunity for Latin America.

A Dynamic Programming-Based Approach To Microarray Image Comparison And Registration, Sunil Bosco Rodrigues Jan 2001

A Dynamic Programming-Based Approach To Microarray Image Comparison And Registration, Sunil Bosco Rodrigues

Masters Theses

"Microarray technology is increasingly used as a means of high throughput analysis of human, non-human and plant genomes. Manual methods of array production have inherent imperfections and variations of the quality of output data derived from these arrays. A dynamic programming-based approach is presented to validate the quality of such data prior to insertion into evolving databases in order to assign reliably, genetic aberrations to bio-medical functions. Dynamic programming is used for comparing normal and tumor microarray image pairs and a cost function is developed which gives a value representing the difference between the images. Quality of the image pairs …

Gravitational Descendants And The Moduli Space Of Higher Spin Curves, Tyler J. Jarvis, Takashi Kimura, Arkady Vaintrob Jan 2001

Gravitational Descendants And The Moduli Space Of Higher Spin Curves, Tyler J. Jarvis, Takashi Kimura, Arkady Vaintrob

Faculty Publications

The purpose of this note is introduce a new axiom (called the Descent Axiom) in the theory of r-spin cohomological field theories. This axiom explains the origin of gravitational descendants in this theory. Furthermore, the Descent Axiom immediately implies the Vanishing Axiom, explicating the latter (which has no a priori analog in the theory of Gromov-Witten invariants), in terms of the multiplicativity of the virtual class. We prove that the Descent Axiom holds in the convex case, and consequently in genus zero.

The "Risky Business" Of Binge Drinking Among College Students: Using Risk Models For Psas And Anti-Drinking Campaigns, Joyce M. Wolburg

College of Communication Faculty Research and Publications

To assist creators of public service announcements and anti-drinking campaigns, this study provides an in-depth examination of the risks of binge drinking from the perspective of college students. Using current risk models for guidance, key elements from the qualitative data in the study are addressed, including perceived risks and their severity, vulnerability to risks, self-efficacy, response efficacy, benefits from ritual functions, and other costs or benefits based on students' attitudes and beliefs. An integrated risk perception model is introduced. Student participants enumerated extensive risks; however, they generally felt invulnerable to the consequences. Most adopted a management style of “taking chances” …

A Case Of The Phillips Curve In The Formation Of A Monetary Union, Yuet Wen Wan '01 Jan 2001

A Case Of The Phillips Curve In The Formation Of A Monetary Union, Yuet Wen Wan '01

Honors Projects

The European Monetary Union was established in 1992 as part of an effort to bring economic integration to new levels by creating a common currency area for Europe -a monetary union that would abolish transaction costs of converting one European currency to another, and eliminating exchange rate variability and uncertainty among traders and investors. Since the formation of the European Monetary System in 1979, lowering inflation had become the main monetary policy priority. My research centers on the Phillips Curve, which implies that decreasing inflation rates would always be coupled with increasing unemployment rates. This study uses the trends of …

The National Invasive Species Act Of 1996: An Assessment Of Current Statutes And Potential Changes And Improvements For Future Legislation Regarding Ballast Water Discharge And Prevention Of Invasion By Non-Indigenous Species, Alison P. Armstrong

Open Access Master's Theses

Ninety-five percent of consumer goods used in the United States reach the markets by way of vessel transport. Each of these vessels carries ballast water, and with it, exotic organisms from ports around the world that can threaten native ecosystems.

A survey (n=10) conducted to gather perceptions on existing ballast water legislation shows that those state and federal agencies who are involved agree on certain aspects of the issue, but there are broad areas of dissent regarding other aspects. Policy actors do feel that this issue must be regulated, however, an agreement on how to reach the goals of ballast …
