Fair Use And The Digital Distribution Of Music - Recording Industry Association Of America V. Napster, Inc. (A Comparative Analysis Of A Restraint On Copyright In The United States Of America And Trinidad And Tobago), Michelle Lisa Alexander Jan 2001

Fair Use And The Digital Distribution Of Music - Recording Industry Association Of America V. Napster, Inc. (A Comparative Analysis Of A Restraint On Copyright In The United States Of America And Trinidad And Tobago), Michelle Lisa Alexander

LLM Theses and Essays

The purpose of this thesis is to undertake a critical analysis of the Napster judgment and its treatment of the doctrine of fair use, to determine whether the doctrine can retain its integrity in the internet age. It is proposed that as technology advances, U.S. policymakers are moving away from the constitutional objectives of U.S. copyright law and are equating copyright interests with property rights, to the detriment of noncommercial users of copyrighted works. Further, it is suggested that the decision in the Napster litigation is important for the evolving landscape of U.S. copyright law, as it signals the difficulty …

A Trade/Human Rights Linkage By The United States: Is Enforcing Human Rights By Use Of Trade Sanctions Effective?, Blaise Omondi Odhiambo Jan 2001

A Trade/Human Rights Linkage By The United States: Is Enforcing Human Rights By Use Of Trade Sanctions Effective?, Blaise Omondi Odhiambo

LLM Theses and Essays

Universally held basic human rights must remain separate from political rights. Such basic human rights are those that are so universal that all societies, systems, nations, and ideology could, and do espouse them. Conversely, political rights are those that are dependent upon compatibility with the system of government in place and arc therefore far less likely to gamer universal support. An effective multilateral enforcement mechanism can only succeed if there are universal agreement and acceptance of the protected rights. Accordingly, at the outset of such a mechanism, only basic human rights may be enforced through trade sanctions. Once such a …

Evolution Of The Arm's Length Standard In The Us Transfer Pricing Legislation And Russian Arm's Length Perspective, Andrei A. Shutov Jan 2001

Evolution Of The Arm's Length Standard In The Us Transfer Pricing Legislation And Russian Arm's Length Perspective, Andrei A. Shutov

LLM Theses and Essays

This thesis analyzes the evolution of the arm's length standard (ALS) as the key element of the transfer pricing control system in the US. This thesis also addresses some issues on creation of transfer pricing legislation in the Russian Federation and focuses on three sets of problems. First, it provides the general outline of the legislative history of the ALS as well as the history of the ALS' application in the US, including an overview of landmark cases, which revealed some conceptual problems with respect to the ALS. Secondly, the thesis addresses core problems associated with the ALS, such as …

The Purposes Of Privacy: A Response, Jeffrey Rosen Jan 2001

The Purposes Of Privacy: A Response, Jeffrey Rosen

GW Law Faculty Publications & Other Works

In this essay, Jeffrey Rosen responds to eight articles about his recent book, The Unwanted Gaze, published as part of a special symposium issue of the Georgetown Law Journal. The eight contributors to the symposium were Professors Anita Allen, Julie Cohen, Rosa Ehrenreich, Lawrence Lessig, Sanford Levinson, Robert Post, Jed Rubenfeld and Nadine Strossen. Rosen defends his argument that privacy protects against the dangers of being judged out of context, insisting that invasions of privacy can lead to social misinterpretations that constitute an injury distinct from injuries to dignity or autonomy. He expands on his claim that some of the …

Telling A Less Suspicious Story: Notes Toward A Non-Skeptical Approach To Legal/Cultural Analysis, Paul Schiff Berman Jan 2001

Telling A Less Suspicious Story: Notes Toward A Non-Skeptical Approach To Legal/Cultural Analysis, Paul Schiff Berman

GW Law Faculty Publications & Other Works

In the generation of law and society research that emerged with the formation of the Law and Society Association, sociolegal scholars, building on the Legal Realist attack on formalism, told a story primarily about the possibility of social progress through law. Over the past two decades, however, sociolegal scholars have become increasingly disenchanted with the reformist project. These writers, influenced by Michel Foucault and other postmodern theorists, have begun to see law not as an instrument for dispensing justice, but as a constitutive societal force shaping social relations, constructing meaning, and defining categories of behavior. As part of the move …

Regularity And Symmetry As A Base For Efficient Realization Of Reversible Logic Circuits, Marek Perkowski, Pawel Kerntopf, Andrzej Buller, Malgorzata Chrzanowska-Jeske, Alan Mishchenko, Xiaoyu Song, Anas Al-Rabadi, Lech Jozwiak, Alan Coppola Jan 2001

Regularity And Symmetry As A Base For Efficient Realization Of Reversible Logic Circuits, Marek Perkowski, Pawel Kerntopf, Andrzej Buller, Malgorzata Chrzanowska-Jeske, Alan Mishchenko, Xiaoyu Song, Anas Al-Rabadi, Lech Jozwiak, Alan Coppola

Electrical and Computer Engineering Faculty Publications and Presentations

We introduce a Reversible Programmable Gate Array (RPGA) based on regular structure to realize binary functions in reversible logic. This structure, called a 2 * 2 Net Structure, allows for more efficient realization of symmetric functions than the methods shown by previous authors. In addition, it realizes many non-symmetric functions even without variable repetition. Our synthesis method to RPGAs allows to realize arbitrary symmetric function in a completely regular structure of reversible gates with smaller “garbage” than the previously presented papers. Because every Boolean function is symmetrizable by repeating input variables, our method is applicable to arbitrary multi-input, multi-output Boolean …

Teaching Torts By Integrating Ethical, Skills, Policy And Real-World Issues, And Using Varied Pedagogical Techniques: Reflections On Using The Henderson, Pearson And Siliciano Casebook, Lynn M. Daggett

Seattle University Law Review

In brief, the Henderson, Pearson, and Siliciano casebook includes materials on ethics, problems and other skill-based activities, a diverse set of ideological perspectives presented in a non-preachy way, and addresses numerous real-world issues and concerns. The casebook also lends itself to the variety of teaching and active learning methods I employ in my Torts classes.

Epsteinian Torts: Richard A. Epstein, Cases And Materials On Torts, Allison H. Eid Jan 2001

Epsteinian Torts: Richard A. Epstein, Cases And Materials On Torts, Allison H. Eid

Seattle University Law Review

A fascinating aspect of Epstein's scholarly work is his exploration of the apparent tension between libertarian principles and utilitarian thought—an exploration that comes alive in his casebook. To Epstein, these two competing principles often coalesce to yield a single "correct" answer to a problem. In other words, the answer that arises from a desire to protect a pre-determined set of individual rights-for example, private property rights, or the right of personal autonomy often produces an outcome that is also beneficial to the overall common good. Some scholars have critiqued Epstein's work by suggesting that there is more disharmony than harmony …

Employers Beware: The Ninth Circuit's Rejection Of The "Direct Threat To Self" Disability Discrimination Defense In Echazabal V. Chevron, Sheehan Sullivan Jan 2001

Employers Beware: The Ninth Circuit's Rejection Of The "Direct Threat To Self" Disability Discrimination Defense In Echazabal V. Chevron, Sheehan Sullivan

Seattle University Law Review

This Note will address whether the Ninth Circuit should have upheld the "direct threat to self" defense in Echazabal v. Chevron. First, the Note will introduce the "direct threat to self" debate in the context of the ADA's language, the EEOC-outlined regulatory provisions, and the case law surrounding the direct threat question. Specifically, the Note will address (1) the relationship between the ADA and the EEOC, (2) the compatiblity of the ADA with the Rehabilitation Act of 1973, and (3) the case law applying the EEOC regulations, the ADA provisions, and the Rehabilitation Act provisions. Next, the Note will …

The Banquet Type-Scene In The Parables Of Jesus, Fazadudin Hosein Jan 2001

The Banquet Type-Scene In The Parables Of Jesus, Fazadudin Hosein

Dissertations

Biblical narratives abound in ancient literary and oral conventions. One such convention is the type-scene. The study of the type-scene originated in 1933 with Walter Arend who studied compositional recurrent patterns and variations in the epics of Homer. Later, the study was developed by Robert Alter inhis treatment of biblical narratives. The type-scene was a narratorial device used by ancient orators and writers in which traditional elements of repetitive compositional patterns were told and retold ininnovative ways to an audience, raising their expectation and sometimes causing surprise. Conventional elements that make up the type-scene were catchwords, motifs, characters, and themes. …
