Schwenk And The Ambiguity In Federal "Sex" Discrimination Jurisprudence: Defining Sex Discrimination Dynamically Under Title Vii, Masako Kanazawa Jan 2001

Schwenk And The Ambiguity In Federal "Sex" Discrimination Jurisprudence: Defining Sex Discrimination Dynamically Under Title Vii, Masako Kanazawa

Seattle University Law Review

This Note examines a new development in federal Title VII sex discrimination jurisprudence specifically in the context of transsexual and homosexual plaintiffs, describing the courts' gradual shift away from formalism towards a more realistic approach in this area. Part II begins by examining the anatomical sex rule established by the three major pre-Schwenk decisions categorically rejecting transsexuals' Title VII claims. This section then considers the two subsequent Supreme Court decisions, Price Waterhouse and Oncale, and the Ninth Circuit's Schwenk opinion. Part II concludes that the Schwenk court correctly read Price Waterhouse and Oncale as mandating a departure from …

The Gap Between Informational Goals And The Duty To Gather Information: Challenging Piecemealed Review Under The Washington State Environmental Policy Act, Keith H. Hirokawa Jan 2001

The Gap Between Informational Goals And The Duty To Gather Information: Challenging Piecemealed Review Under The Washington State Environmental Policy Act, Keith H. Hirokawa

Seattle University Law Review

In 1971, Washington enacted the State Environmental Policy Act (SEPA), which requires agencies to make a threshold determination of whether a project is likely to significantly affect the environment and, where such impacts are likely, to produce an environmental impact statement (EIS). One problem faced in implementing the goals of SEPA is the practice of "piecemealing." Part I of this Article introduces the piecemeal problem by describing three common piecemeal situations. The first situation occurs when a project proposal is divided into such small parts that the environmental impacts from each individual part appear insignificant and the impact from the …

Direct Democracy Is Not Republican Government, Steven William Marlowe

Seattle University Law Review

This Article will initially explain the examples of direct democracy in the states of Washington and Oregon. It will then analyze the United States Constitution's Guarantee Clause. The Dean And The Budget: Not 'Just A Bunch Of Damn Numbers', Steven R. Smith Jan 2001

The Dean And The Budget: Not 'Just A Bunch Of Damn Numbers', Steven R. Smith

Faculty Scholarship

The process of developing and implementing a budget is among the most important and least understood responsibilities of deans. When done properly, the budget will move the school toward its goals and promote its mission. When done improperly, the budget will waste the limited resources of the school.

This essay first considers the First Principle of Budgets for deans, then discusses procedural issues in developing a successful budget, and finally reviews a number of specific budget issues that law schools face.

The Reporting Of Sensitive Behavior Among Adolescents: A Methodological Experiment In Kenya, Barbara Mensch, Paul C. Hewett, Annabel Erulkar Jan 2001

The Reporting Of Sensitive Behavior Among Adolescents: A Methodological Experiment In Kenya, Barbara Mensch, Paul C. Hewett, Annabel Erulkar

Poverty, Gender, and Youth

This paper assesses whether audio computer-assisted self-interviewing (audio-CASI), a technique designed in the United States to collect data on sensitive behaviors, is a feasible method of survey data collection in a developing-country setting and whether it produces more valid reporting of sexual activity and related behaviors than traditional survey methods. The analysis is based on interviews with nearly 4,400 unmarried adolescents aged 15-21 in Nyeri, a rural district of Kenya that was selected because previous research had indicated a wide discrepancy in the reporting of premarital sexual behavior between boys and girls. The study was based on a quasi-experimental design …

The End Of The Fertility Transition In The Developed World, John Bongaarts Jan 2001

The End Of The Fertility Transition In The Developed World, John Bongaarts

Poverty, Gender, and Youth

By the late 1990s fertility in the developed world had declined to 1.6 births per woman, a level substantially lower than projected in the 1980s. This study examines recent trends and patterns in fertility in the developed world with particular emphasis on the effects and implications of changes in the timing of childbearing. The main objective is to demonstrate that while fertility in these countries is indeed low, women’s childbearing levels are not as low as period measures such as the total fertility rate suggest. To obtain a full understanding of the various dimensions of fertility change, several indicators are …

Social Networks And Contraceptive Dynamics In Southern Ghana, Mark R. Montgomery, Gebre-Egziabher Kiros, Dominic K. Agyeman, John B. Casterline, Peter Aglobitse, Paul C. Hewett Jan 2001

Social Networks And Contraceptive Dynamics In Southern Ghana, Mark R. Montgomery, Gebre-Egziabher Kiros, Dominic K. Agyeman, John B. Casterline, Peter Aglobitse, Paul C. Hewett

Poverty, Gender, and Youth

There is accumulating evidence that social diffusion processes affect the pace of the adoption of modern contraception in societies undergoing fertility transition. In settings where mortality has declined and many other social and economic changes are underway, decisions about contraception are fraught with uncertainty and risk. In such circumstances, couples may rely on other persons for information and guidance. In this paper, we examine the influence of informal social networks on the contraceptive behavior of reproductive-age women, using longitudinal data collected in six communities in southern Ghana. Our results confirm the hypothesis that adoption of modern contraception is strongly affected …

18 U.S.C. § 922(G)(9) And The Lambert Due Process Exception Requiring Actual Knowledge Of The Law: United States V. Hutzell, 217 F.3d 966 (8th Cir. 2000), Brian E. Sobczyk Jan 2001

18 U.S.C. § 922(G)(9) And The Lambert Due Process Exception Requiring Actual Knowledge Of The Law: United States V. Hutzell, 217 F.3d 966 (8th Cir. 2000), Brian E. Sobczyk

Nebraska Law Review

This Note concludes that, although the court in United States v. Hutzell reached the correct holding, the court's analysis is not of sufficient depth and clarity to be truly convincing. In leading up to such a conclusion, this Note begins by detailing the due process exception set forth by the Supreme Court in Lambert v. California. The Note then looks at cases dealing with a similar due process issue regarding 18 U.S.C. § 922(g)(8), which makes possession of firearms unlawful for persons against whom a domestic violence protection order is in effect. Such cases are important because many of them …

The Useful Life Defense: Embracing The Idea That All Products Eventually Grow Old And Die, Charles Cantu Jan 2001

The Useful Life Defense: Embracing The Idea That All Products Eventually Grow Old And Die, Charles Cantu

Nebraska Law Review

The Restatement (Third) of Torts is expected to continue the consumer-oriented trend that began with the recognition of strict products liability under section 402A. Earlier law had required an injured plaintiff either to focus on the defendant's failure to conform to the standard of care as required by the law of negligence or to comply with the Uniform Commercial Code’s complicated law of warranty. Later, the law of strict products liability allowed an injured consumer to prevail simply by establishing that the product in question was defective. Once enacted, section 402A resulted in a greatly increased number of lawsuits in …

Nebraska Law Review

This article examines the current state of termination of parental rights (TPR) law, along with the results of an appellate case review, an exploratory project, and an empirical investigation of decision-making related to these cases. Section I begins with an overview of termination of parental rights law. The focus of this section is recent statutory changes in the area, highlighting some key differences between the former and the current law. In Section II, the focus shifts to a review of the foundations for the empirical study. Section III more specifically addresses the main areas that are explored in the empirical …

The Dynamics Of Daubert: Methodology, Conclusions, And Fit In Statistical And Econometric Studies, David H. Kaye Jan 2001

The Dynamics Of Daubert: Methodology, Conclusions, And Fit In Statistical And Econometric Studies, David H. Kaye

Faculty Scholarship

This paper reviews the development of the law governing the admissibility of statistical studies. It analyzes the leading cases on scientific evidence and suggests that both the "reliability" and the "general acceptance" standards raise two major difficulties - the "boundary problem" of identifying the type of evidence that warrants careful screening and the "usurpation problem" of keeping the trial judge from closing the gate on evidence that should be left for the jury to assess.

The paper proposes partial solutions to these problems, and it applies them to statistical and econometric proof, particularly in the context of a recent antitrust …
