Reasons To Eschew Federal Lawmaking And Embrace Common Law Approaches To Genetic Discrimination, S. Candice Hoke Jan 2001

Reasons To Eschew Federal Lawmaking And Embrace Common Law Approaches To Genetic Discrimination, S. Candice Hoke

Journal of Law and Health

Professor Hoffman and I agree: there ought to be some laws, but I want to talk to you a little bit about two possible, two real goals here. One is to ask you to critically evaluate whether a federal statute is the right remedial response at this point in time, and secondly, to ask you to start thinking about the possibility of drafting into service what we in law refer to as traditional state common-law approaches that actually might give us more and better ways to remedy what's going on than simply turning to Congress.

Job Reference Immunity Statutes: Prevalent But Irrelevant, Markita D. Cooper Jan 2001

Job Reference Immunity Statutes: Prevalent But Irrelevant, Markita D. Cooper

Journal Publications

This Article posits that current reference immunity statutes are of little use in encouraging employers to provide references. Although legislation ostensibly protects employers in most states, "name, rank and serial number," "no-comment," and neutral reference policies continue to prevail as standard practice regarding job references. Generally, the existing statutes leave the common law in place, so that reference claims may be adjudicated under statutory standards and common law standards. This Article proposes that the field would be clarified if the statutes were the exclusive law governing liability for job reference claims under state law.

An Ounce Of Prevention Is A Poor Substitute For A Pound Of Cure: Confronting The Developing Jurisprudence Of Education And Prevention In Employment Discrimination Law, Susan Bisom-Rapp Jan 2001

An Ounce Of Prevention Is A Poor Substitute For A Pound Of Cure: Confronting The Developing Jurisprudence Of Education And Prevention In Employment Discrimination Law, Susan Bisom-Rapp

Faculty Scholarship

This article challenges a widely shared conviction that has had a tremendous impact on employer practices and, most recently, on employment discrimination jurisprudence. More specifically, the piece interrogates the belief that employee education can prevent, or at least greatly curb, invidious employment discrimination prohibited by Title VII of the Civil Rights Act and other civil rights statutes. This premise, broadly held and rarely questioned, has spawned a multi-billion dollar sexual harassment and diversity training industry staffed by consultants, attorneys, and human resource professionals, who offer programs aimed at litigation prevention. Yet, there is absolutely no empirical support for the premise …

Technology Assisted Life Stories, Gary R. Harlow Jan 2001

Technology Assisted Life Stories, Gary R. Harlow

Open Access Master's Theses

A pilot project was undertaken to test an emerging technology with a view to examine the feasibility of assisting older participants in the telling of their life stories. With the use of a digital recorder and voice-to text software, ten older persons were freed from the labor of creating a formal record of their life stories, either through typing ,writing, or manual transcription of audio tape. Extemporaneously, on a hand-held recorder, and in a one-on-one interview format, each participant's voice was converted to digital form as the narration proceeded. This digital recording was then transcribed electronically into a computer, which …

Cultural Predictors Of Asian/Pacific Islander Women’S Hiv/Aids Protective Behaviors, Jennifer C. Huang Jan 2001

Cultural Predictors Of Asian/Pacific Islander Women’S Hiv/Aids Protective Behaviors, Jennifer C. Huang

Open Access Master's Theses

Understanding the HIV/AIDS risk behaviors among heterosexual Asian/Pacific Islander (API) women requires an examination of the circumstances which place heterosexual women at risk of AIDS, as well as the cultural factors which affect API sexuality. Research has been conducted on samples of women, one of the fastest growing populations to be infected with HIV/AIDS, as well as API populations, who are susceptible to HIV infection as any other ethnic group. There is, however, a paucity of research concerning the sexuality of API women. Previous research regarding HIV/AIDS risk factors for women may not be culturally sensitive. Additionally, research pertaining to …

Identification Of Florida Largemouth Bass Alleles In Arkansas Public And Private Aquaculture Ponds, Ronald L. Johnson, Randall Staley Jan 2001

Identification Of Florida Largemouth Bass Alleles In Arkansas Public And Private Aquaculture Ponds, Ronald L. Johnson, Randall Staley

Journal of the Arkansas Academy of Science

The Florida subspecies of the largemouth bass (LMB) has often been introduced into waters outside of its range, with escape of individuals into associated waterways common. Sustaining pure lines within controlled hatchery settings is also difficult. The present study investigated LMB populations by way of allozyme analysis of three diagnostic loci of 115 LMB in three public and seven private aquaculture ponds within Arkansas. The goal was to determine the success of hatcheries in maintaining pure subspecies. None of the pond populations studied were fixed for all alleles. Private ponds had northern LMB allele frequencies of up to 0.40 in …

Journal of the Arkansas Academy of Science

During the past 20 years (1982-2001) we have studied the biology, occurrence and distribution of LeConte's (Brazilian) free-tailed bat, Tadarida brasiliensis cynocephala, in Arkansas. Colonies and individuals were reported from man made structures only. Four new county records have been documented since 1988, extending the range from the central part of the state to Arkansas's northern-most tier of counties. Numerous nuisance maternity colonies were investigated during exclusion activities and one, year-round colony provided the majority of reproductive data. A total of 152 free-tailed bats was submitted to the Arkansas Department of Health Rabies Laboratory (1982-2001); most during February through April, …

Investigation Of Amnestic Effects Of Microinjections Of Nmda Receptor Antagonist Ap5 Directly To The Goldfish Telencephalon, Jennifer Bazner Jan 2001

Investigation Of Amnestic Effects Of Microinjections Of Nmda Receptor Antagonist Ap5 Directly To The Goldfish Telencephalon, Jennifer Bazner

McNair Scholars Journal

N-Methyl-D-asparate (NMDA) receptor antagonists have been shown to block long-term potentiation (LTP), an increased effectiveness in communication among neurons and a physiological correlate of learning and memory, and also impair certain learning in mammals. Previous studies in our lab have shown that NMDA receptor antagonists injected into the cranial space in goldfish impair active avoidance conditioning. In mammals, NMDA receptor antagonists block LTP in the hippocampus, which may result in learning impairment in mammals. Although neuroanatomists are not yet in agreement with which part of the goldfish telecephalon s homologous to the hippocampus in mammals, studies have shown that telecephalon …
