Also, Too And Moreover In A Novel By Dorothy L. Sayers, Stephen H. Levinsohn Jan 2001

Also, Too And Moreover In A Novel By Dorothy L. Sayers, Stephen H. Levinsohn

Work Papers of the Summer Institute of Linguistics, University of North Dakota Session

When Dorothy Sayers uses also in her novel The Documents in the Case, this indicates that the material that is added is at least as important as that to which it is added. She uses moreover, as Blakemore (1987) has observed, to indicate that the material that is added provides further evidence for a recently stated conclusion. Too is the 'elsewhere' additive. Sayers uses it when the information that is added confirms or contradicts a previous utterance or assumption. She also uses it when the material concerned is of lesser or greater importance than that to which it …

A Review Of The Process Of Accessing Services For Children With Special Health Care Needs In North Dakota, Jana Schmidt Jan 2001

A Review Of The Process Of Accessing Services For Children With Special Health Care Needs In North Dakota, Jana Schmidt

Physical Therapy Scholarly Projects

It has been a concern of the Family Advisory Council of Children's Special Health Services, Bismarck, North Dakota, that many families experienced difficulties when trying to access information for medical, financial, educational, and family services for their children with special health care needs. The family members on this advisory board found the process of accessing services confusing and time consuming, and indicated that families were also unclear as to where to begin the process. An abundance of information provided at the time of their child's diagnosis made it difficult for families to make informed decisions about the most important and …

Are Forensic Locksmiths Really Qualified To Testify As Experts In Cases Of Insurance Fraud: An Examination Of The Admissibility Of Forensic Locksmith Opinions Under Rule 702, Chad A. Hester

Cleveland State Law Review

This Note will argue that while forensic locksmiths may be qualified as experts under Rule 702, they should not necessarily be qualified to testify as to which key started a vehicle last. Part I of this note will discuss the basic history and case law which has established the requirements necessary to qualify an expert to testify under the Rule 702. In addition, Part I will discuss the recently enacted amendments to Rule 702 and how the amended Rule 702 has expanded the admissibility of expert witnesses. Part II of this note will discuss the generally accepted procedures of forensic …

When Indian Law And Tax Law Collide: How Pull-Tab Games Got To The Supreme Court , John Burgess

Cleveland State Law Review

This Note will explore the reasons why two identical cases can turn out with completely different results. To do so, consideration will be given to the statutes involved and the varying interpretations of these statutes. Another important consideration is the policy behind these statutes, especially the IGRA. Part II will describe what the pull-tab games are, the statutes at issue, the conflicting cases, and the statutory interpretation issue. Part III will describe how the tenets of Indian Law can affect the analysis. Part IV will contain an analysis of the statutes and compare it to how the courts analyzed them. …

Environmental Audit Privilege Laws: Stripping The Public's Right To Know, Jennifer Lukas Jackson Jan 2001

Environmental Audit Privilege Laws: Stripping The Public's Right To Know, Jennifer Lukas Jackson

Cleveland State Law Review

This Note argues that because the public places a high premium on its right to know, Congress should enact a federal statute that prohibits a privilege for environmental audits. A federal prohibition on a privilege for environmental audits will make the state statutes unconstitutional under the Supremacy Clause of the United States Constitution. This Note has six parts. Part II provides background on the traditional environmental regulatory regime and the role that the public plays in enforcing environmental statutes. Part III is an analysis of some of the typical state environmental audit privilege laws, including a discussion of the major …

Swimming Up-Stream In The Jean Pool: Developing A Pedagogy Towards Critical Citizenship In Visual Culture, Kevin Tavin Jan 2001

Swimming Up-Stream In The Jean Pool: Developing A Pedagogy Towards Critical Citizenship In Visual Culture, Kevin Tavin

Journal of Social Theory in Art Education

American children and youth live in and through mass media and popular culture. They frequently fashion their sense of history, ideology, and multiple and ever-changing identities through popular visual imagery. These images penetrate and pervade every aspect of our students’ lives in the form of television programs, children’s books, advertisements, movies, comics, toys, cereal boxes, video games, fashion merchandise, sport shoes, fast food paraphernalia, and architectural and public spaces. These images help to shape students’ experiences by capturing their imagination and engaging their desires. These pervasive, immediate, and sometimes ephemeral images often construct students’ consciousness and their sense of citizenship …

A Comparison Of Pre-Post Student Outcomes And Perceptions After An Intervention Of A Secondary Alternative Education Program For Disruptive Students, Lloyd Sain, Jr.

Theses and Dissertations

The purpose of this study was to describe the effect of an alternative education program on the grade point averages, attendance, and suspensions of secondary school students. In order to meet this purpose, the study tested two research questions that focused on the grade point average, attendance, and suspensions of disruptive secondary school students prior to their intervention of an alternative education program and after their return to home school for two consecutive nine weeks. Length of enrollment and its impact on grade point averages, attendance, and suspensions were also examined. The study also investigated to what extent the characteristics …

The Effects Of The Arkansas Leadership Academy's Strategic Leadership Institute For Teams On The Creation Of Learning Communities, Paula Griffith Cummins Jan 2001

The Effects Of The Arkansas Leadership Academy's Strategic Leadership Institute For Teams On The Creation Of Learning Communities, Paula Griffith Cummins

Theses and Dissertations

The problem of this comparative study was to determine whether school districts that participated in the Arkansas Leadership Academy Strategic Leadership Institute for Teams exhibited more characteristics of a learning community, as identified by Hord (1997), than they did prior to participation. A secondary problem was to determine if districts that had significant participation in the Leadership Institute for Teams exhibited greater growth in the learning community characteristics than districts with no participation. The sample was drawn from Arkansas public school districts that had participated in any Leadership Institute for Teams during the identified time, with an equal number of …

An Empirical Investigation Of Four Tests For Interaction In The Context Of Factorial Analysis Of Covariance, Todd C. Headrick, George Vineyard

Publications

The Type I error and power properties of the parametric F test and three nonparametric competitors were compared in terms of a 3x 4 factorial analysis of covariance layout. The focus of the study was on the test for interaction either in the presence and/or absence of main effects. A variety of conditional distributions, sample sizes, levels of variate and covariate correlation and treatment effect sizes were investigated. The Puri and Sen (1969a) test had ultra-conservative Type I error rates and power losses when main effect(s) were present. The adjusted rank transform (Blair & Sawilowsky,1990; Salter & Fawcett; 1993) had …

Cannabinoids And The Immune System, Thomas W. Klein, Catherine A. Newton, Herman Friedman Jan 2001

Cannabinoids And The Immune System, Thomas W. Klein, Catherine A. Newton, Herman Friedman

Molecular Medicine Faculty Publications

The effect of cannabimimetic agents on the function of immune cells such as T and B lymphocytes, natural killer cells and macrophages has been extensively studied over the past several decades using human and animal paradigms involving whole animal models as well as tissue culture systems. From this work, it can be concluded that these drugs have subtle yet complex effects on immune cell function and that some of the drug activity is mediated by cannabinoid receptors expressed on the various immune cell subtypes. However, the overall role of the cannabinoid system of receptors and ligands in human health and …

Too Young To Understand--Extending Equal Access To All Children In Public Schools Regardless Of Age, David Woodcock Jan 2001

Too Young To Understand--Extending Equal Access To All Children In Public Schools Regardless Of Age, David Woodcock

St. Thomas Law Review

Finding the right mix of church and state is not an easy task for our society. This is especially true in our public schools. Everyday, millions of elementary school students meet after school in public school facilities to participate in Girl Scouts, Boy Scouts, Cub Scouts, Brownies, and 4-H Clubs. These organizations share the goals of preparing young boys and girls to grow into men and women of good morals and character. Religious organizations that share these goals, however, are denied access to school facilities simply because they have a religious point of view. School districts have told children that …

Nixon, the 37th President of the United States of America was involved as an appellant/ petitioner. All three cases decided by the United States Supreme Court bore the name of Richard Nixon in the title of the cases. This Article will attempt to discern some of the legal and constitutional issues which have arisen from these "Three Nixon" cases. Some of the issues in these cases would inevitably have arisen out of issues that are peculiar to …

On Genetic Engineering And The Idea Of The Sacred: A Secular Argument, Gregory E. Kaebnick Jan 2001

On Genetic Engineering And The Idea Of The Sacred: A Secular Argument, Gregory E. Kaebnick

St. Thomas Law Review

In short, we need to be able to argue about the sacred. The next section contains a few brief remarks about the general idea of the sacred and whether we can and how we can argue about the sacred. In the remainder of the paper, consideration is given to the more specific appeal to the sacred made in discussions about genetic engineering, and some defenses of that notion.

End-Of-Life Care In Florida: Should The Law Follow The Lobbyists Or The People's Wishes, Alison Cossetti Jan 2001

End-Of-Life Care In Florida: Should The Law Follow The Lobbyists Or The People's Wishes, Alison Cossetti

St. Thomas Law Review

One of the hottest topics on the minds and lips of many Floridians is end-of-life care. This is understandable since the state of Florida contains the largest percentage of elderly individuals, the third highest amount of people afflicted with the AIDS virus, and the fourth largest number of deaths per year from chronic obstructive pulmonary disease and heart disease in the nation. The Florida Legislature realizes that the state is extremely diverse in the areas of ethnicity, race, cultural customs, and religious beliefs, and believes that a person's experience with death, the process of dying, and their choices pertaining to …

The Recognition Of Indigenous Peoples' And Community Traditional Knowledge In International Law, Rosemary J. Coombe Jan 2001

The Recognition Of Indigenous Peoples' And Community Traditional Knowledge In International Law, Rosemary J. Coombe

St. Thomas Law Review

Today I want to explore some of the international law-making efforts with respect to indigenous and traditional environmental knowledge. My work over the past three years has involved the study of the ongoing efforts underway to implement state obligations under the Convention on Biological Diversity ("CBD"), and the related efforts of the World Intellectual Property Organization (WIPO), to recognize, protect, and compensate for the contributions of indigenous and traditional communities' knowledge, innovations, and practices to the preservation and maintenance of biological diversity. This is a fascinating process of international lawmaking and an increasingly important field of global politics, which may …

Exercising Self-Determination Without Jeopardising The Rights Of The Others: The Catalan Model, Puig I. Scotoni Jan 2001

Exercising Self-Determination Without Jeopardising The Rights Of The Others: The Catalan Model, Puig I. Scotoni

St. Thomas Law Review

I have entitled my remarks "Exercising self-determination without jeopardising the rights of the others: the Catalan model."' This is because present day Catalan nationalism strives to make the interests of Catalonia compatible with those of Spain and the European Union. In my opinion, such political restraint and flexibility is one of the most remarkable aspects of the Catalan model.

Indigenous Autonomy And Its Problems: A Vision From The Russian Far East, Petra Rethmann Jan 2001

Indigenous Autonomy And Its Problems: A Vision From The Russian Far East, Petra Rethmann

St. Thomas Law Review

This essay discusses one vision of self-determination among Luoravetlan women and men in the Chukotka peninsula in the Russian Far East. Self-determination can have many meanings, but the one this essay emphasizes is based on tradition: on the intricate connections between humans, animals, and land, with shared premises, close kin groups, and local production relations. Contemporary Luoravetlan women and men argue that self-determination is bound to fail if it does not take serious the complex interrelations between people and the land in which their social understandings are rooted, and through which their core institutions and values are ensured. This essay …

Using Manipulatives In Undergraduate Mathematics Courses, D. Moore Jan 2001

Using Manipulatives In Undergraduate Mathematics Courses, D. Moore

Journal of Mathematics and Science: Collaborative Explorations

Students in undergraduate mathematics classes not only benefit from the use of manipulatives in the classroom, but also enjoy them. This paper specifically outlines one successful activity that used manipulatives in a large section of a precalculus course and then explores possibilities in other courses. It also addresses the use of mathematics manipulatives as a platform to introduce both active and cooperative learning in a large lecture setting.
