Over the past fifty years, America has steadily deinstitutionalized its mentally handicapped population, often with mixed results. The primary goal of this process was to place these long-forgotten people back into the so-called mainstream of American life, allowing them access to the same kinds of advantages schools, jobs, housing-that most of us take for granted. This road has not always been easy. In particular, providing safe and accessible housing for the mentally handicapped is an important step toward establishing meaningful self-sufficiency for these individuals. Emerging applications in the field of biotechnology hold great promise for promoting the health and well-being of the global community, especially in developing states. Yet significant concerns have emerged about biotechnology in the transnational sphere, concerns that no doubt will increase in decades to come. The purpose of the article is to assess the strengths and limits of existing international norms and structures designed to address these concerns, and to suggest a means for augmenting current structures to make them more effective. International law develops and regulates transnational behavior in a manner that goes well beyond the development treaty regimes. …

Miranda And Some Puzzles Of 'Prophylactic' Rules, Evan H. Caminker

Constitutional law scholars have long observed that many doctrinal rules established by courts to protect constitutional rights seem to "overprotect" those rights, in the sense that they give greater protection to individuals than those rights, as abstractly understood, seem to require.' Such doctrinal rules are typically called "prophylactic" rules.2 Perhaps the most famous, or infamous, example of such a rule is Miranda v. Arizona,' in which the Supreme Court implemented the Fifth Amendment's privilege against self-incrimination4 with a detailed set of directions for law enforcement officers conducting custodial interrogations, colloquially called the Miranda warnings. 5

In brief, the Henderson, Pearson, and Siliciano casebook includes materials on ethics, problems and other skill-based activities, a diverse set of ideological perspectives presented in a non-preachy way, and addresses numerous real-world issues and concerns. The casebook also lends itself to the variety of teaching and active learning methods I employ in my Torts classes.

Genomic Southern blotting analyses of Bombyx mori and B. mandarina were performed with the 5′-exons or 5′-flanking sequences of two members of genes A/B.L11 and A/B.L12. They represent multigene families encoding chorion proteins that are expressed in the middle period of choriogenesis. Many bands cross-hybridized with the probes in B. mandarina and in different strains and races of B. mori, supporting the idea that the middle chorion multigene families have remained essentially the same in the two species. Both the exon and the 5′-flanking probes exhibited similar patterns within the European stocks of B. mori, indicating that the examined …

Following the Civil War, black Americans began acquiring land in earnest; by 1920 almost one million black families owned farms. Since then, black rural landownership has dropped by more than 98% and continues in rapid decline-there are now fewer than 19,000 black-operated farms left in America. By contrast, white-operated farms dropped only by half, from about 5.5 million to 2.4 million. Commentators have offered as partial explanations the consolidation of inefficient small farms and intense racial discrimination in farm lending. However, even absent these factors, the unintended effects of old-fashioned American property law might have led to the same outcome. …

Developmental Tendril Morphology In Echinocystis Lobata (Michaux) Torrey And Gray (Cucurbitaceae), Theodore Bowen Guthrie

Tendrils are generally defined as coiling organs used as mechanical supports and for climbing. The morphological nature of the tendril and the branching pattern of the axillary bud complex (ABC) in the family Cucurbitaceae have been the subject of investigation for over a hundred years and as of yet there is no unifying interpretation of their morphological values. The tendril in the Cucurbitaceae has been hypothesized to be homologous to a leaf, a flower, a stem, and a combination of stem and leaf.
