This Note examines the types of protection given to databases in both the United States and Europe. Part I discusses the reasons for providing databases protection. Part I also provides background information on the EU Database Directive, and examines the history of copyright protection of databases in the United States in light of a landmark Supreme Court decision and then analyzes the approach to database protection arising under the Collections of Information Antipiracy Act, a proposed law in the U.S. Congress. The South Won't Rise Again But It's Time To Study The Defunct Confederacy's Constitution, Ralph Michael Stein

The premise of this essay is not to espouse that the Southern ideological and constitutional theorists were correct. I propose, however, that an understanding of the historical basis of constitutional law, and a recognition of evolving doctrinal issues of Federalism, will enhance law school curriculum. Presentation of these topics dictates the introduction of the Confederate Constitution into the curriculum of required courses and electives. This effort, I propose, would be a prudent step, to be amply repaid in terms of higher understanding and scholarly benefit.

Without a better global effort to prevent and cope with forest fires, the remaining wild forests' resources of the world are at risk. Quite apart from the present loss of commercial timber and species habitat, and the present problems of flooding and erosion in the aftermath of fires, the loss of these wooded lands will reduce the capacity of regions to absorb carbon dioxide through photosynthesis, thereby making the challenge of managing emissions of greenhouse gases all the more problematic. Eutrophication is essentially the nutrient enrichment of waterways leading to algal growth. It must be controlled to maintain sustainable agricultural systems and the main mechanisms of control are stabilising catchment processes and reducing nutrient output.

Eutrophication can be defined as 'the nutrient enrichment of waters which results in the stimulation of an array of symptomatic changes, among which increased production of algae and macrophytes, deterioration of water quality and other symptomatic changes, are found to be undesirable and interfere with water uses' (OECD 1982). Domestic Violence And Us Asylum Law: Eliminating The 'Cultural Hook' For Claims Involving Gender-Related Persecution, Anita Sinha

In this Note, Anita Sinha examines the treatment of asylum claims involving gender-related persecution. Analyzing the three most recent decisions published by the Board of Immigration Appeals, Sinha illustrates that these cases have turned on whether the gender-related violence can be linked to practices attributable to non-Western,'foreign" cultures. Sinha argues that cases involving gender-related persecution can be given full consideration of asylum law only when their adjudication is based on an understanding of the political and institutional character of violence against women, rather than on" cultural" culpability. Globalization is nothing new. Global trade has been going on for millennia—though what constitutes the "globe" has expanded dramatically in that time. And trade is nothing if not cultural exchange, the narrow distinctions between the economic and the cultural having long been rendered obsolete. Moreover, our forbears, like us, were great "miscegenators." If here I gloss the racialized and gendered violence often associated with miscegenation, I do so strategically to note that all recourse to purity, indigeneity, or aboriginality—however useful strategically—should be subject to at least as much scrutiny as the easy romance with hybridity (see Mitchell 1997). Much of the research on the genetic modification of herbaceous plant cell walls has been conducted to improve the utilization of forages by ruminant livestock. The rumen of these animals is basically an anaerobic fermentation vat in which the microflora break down the complex polysaccharides of plant cell walls into simpler compounds that can be further digested and absorbed by the mammalian digestive system. Research on improving the forage digestibility of switchgrass, Panicum virgatum L., and other herbaceous species has demonstrated that genetic improvements can be made in forage quality that can have significant economic value. Decomposition is a critical process that links the above- and below-ground portions of the nutrient cycle. A study was initialed in North Dakota, USA, to evaluate the decomposition rate between three genetically improved grass species monocultures, Agropyron desertorum, Bromus inermis, and Pascopyrum smithii, and two native perennial grass species occurring in area rangelands, Nassella viridula and Bouteloua gracilis. Standing litter of all five species was harvested in October 1996 and placed into litterbags. In the 2000 school year the Louisiana Department of Education commissioned a Distance Learning Task Force Committee to establish State Standards for Distance Education. These Standards supported the core beliefs set forth by the state's educational technology goal: "All educators and learners will have access to technologies that are effective in improving student achievement" (State Standards, p. 1). Streptococcus iniae was first isolated in 1972 from an Amazon River dolphin. It reappeared as a fish pathogen in Japan several years later. Since then it has steadily increased in incidence and host range worldwide, and is a known zoonotic agent. In the United States it is the most significant pathogen affecting growth of tilapia aquaculture. Histopathologic descriptions are incomplete and little is known concerning pathogenesis of the disease or virulence mechanisms of the organism. The dissertation identifies and studies fragmentary structures---structures that give the impression of incompletion or interruption---in the music of Claude Debussy. Although fragments---which play a decisive role in nineteenth- and twentieth-century aethetics---have been discussed extensively in literature and the visual arts, relatively little critical attention was paid to them by musicologists until Daverio and Rosen, in the 1990s, investigated the romantic musical fragment. The dissertation traces the history of the literary fragment from the late middle ages through the nineteenth century. Introduction. Approximately 600 industrial workers reported exposure to sub-lethal levels of sulfur mustard gas and nitrogen mustard gas. A sample of 203 of these workers were administered standardized measures of perceptual, motor, intellectual, academic, attentional, memory, abstract reasoning, and psychological functioning, as well as level of effort during testing. Mean time from exposure to testing was 1.18(SD = .35) years. Males comprised 97.5% of the participants and 79.3% were Caucasian. Mean education was 11.67(SD = 1.73) years and mean age at exposure was 36.74( SD = 10.31) years. Method. Mustard gas exposure severity was defined by the presence of obvious …

The focus of this dissertation is campaign spending in congressional elections. I examine the benefits that candidates receive from campaign expenditures. I think that challengers receive greater benefits from spending than incumbents, but that the extent of these benefits depends on the type of challenger. High-quality challengers are those that have previous experience in an important elective office, while low-quality challengers lack this experience. Because of this experience, high-quality challengers enjoy a higher level of recognition among the electorate than low-quality challengers. A World Of Deference: Paradoxes Of Victorian Paternalism In John Ruskin, Charles Dickens, And John Stuart Mill., Peter Mitchell O'Neill

This study examines the residual paternalist ideology in three canonical Victorian texts: namely, John Ruskin's The Nature of Gothic, Charles Dickens's Hard Times, and John Stuart Mill's Autobiography. In exposing an epistemological tension between paternalist and liberal beliefs---especially a putative concern for the working class---that exists in these texts, this discussion concludes that not only are the cultural forces of benevolent authority insidious in Victorian culture, but that the paradoxes that emerge in these texts may reflect a public ambiguity toward the prevalent structures sustaining Victorian paternalism. In October 1876 Gustave Flaubert was engaged in writing what would become perhaps his most well-known and successful piece of short fiction, "A Simple Heart." This narrative dissects the life of an innocent servant woman, ironically named Felicity, who rransfers her love and spiritual devotion from object to object until she finally settles, afrer life's many disappointments, on a stuffed and tattered parrot as the incarnation of her god of love.
