In The Face Of Adversity: The Response Of The Vincentian And Charity Families To 9/11, Regina Bechtle S.C.

Vincentian Studies

The response of the Vincentian and Charity Families to the attacks of 9/11 is chronicled, using people’s own words wherever possible. On the day itself and during the aftermath, Sisters of Charity and Vincentians prayed with and counseled grieving people, first responders, and rescue workers. Personnel from Saint Vincent’s Hospital and Medical Center were among the earliest to arrive at Ground Zero, and the Saint Vincent Catholic Medical Centers treated over one thousand victims. Among other things, Sisters of Charity served as New York Police Department chaplains, answered calls to hospital information lines, and worked at a DNA collection site …

Product-Related Risk And Cognitive Biases: The Shortcomings Of Enterprise Liability, James A. Henderson Jr., Jeffrey J. Rachlinski

Products liability law has witnessed a long debate over whether manufacturers should be held strictly liable for the injuries that products cause. Recently, some have argued that psychological research on human judgment supports adopting a regime of strict enterprise liability for injuries caused by product design. These new proponents of enterprise liability argue that the current system, in which manufacturer liability for product design turns on the manufacturer's negligence, allows manufacturers to induce consumers into undertaking inefficiently dangerous levels or types of consumption. Rethinking Patent Law In The Administrative State, Orin S. Kerr

William & Mary Law Review

This Article challenges the Supreme Court's recent holding that administrative law doctrines should apply to the patent system. The Article contends that the dynamics ofpatent law derive not from public law regulation, but rather from the private law doctrines of contract, property, and tort. Based on this insight, the Article argues that administrative law doctrines such as Chevron and the Administrative Procedure Act should not apply within patent law, and that such doctrines in fact pose a serious threat to the proper functioning of the patent system.

Law and Contemporary Problems

What has occurred in the United Kingdom is a move toward the development of a body of legal doctrine closer to the concept of public service enshrined in other European legal systems. Prosser asserts that it has been largely due to the creation of regulators independent of government and enterprise, thus making some legal framework to structure relations inevitable.
