Lawyers have garnered a reputation for being unreasonable and excessively contentious. This popular sentiment is embedded in our culture. If lawyers cannot change that perception, a second-best outcome (from the perspective of lawyers) would be the formation of an understanding that there is a reason why they appear to act unreasonably, that it can be desirable for lawyers to act in a way that initially appears to be unreasonable. This Article attempts to build a basis for that understanding in the context of lawyers participating in large commercial transactions.

The purpose of this study was to investigate the learning process of teachers as they begin to implement an innovation. The research problem was based on the need to understand better the processes by which teachers come to integrate technology into their instructional practices. The Concerns-Based Adoption Model (Hall, Wallace, & Dossett, 1973) provided the conceptual framework for facilitating change in teachers' use of technology to support instructional practices. New Beef Zone - The Potential For Beef And Cattle Industry Expansion In The Western Australian Wheatbelt, Alan Peggs, Andrew Quinn, Jason Kelly

Animal production and livestock published reports

Agriculture Western Australia (WA) recently completed a comprehensive analysis of the Western Australian beef and cattle industry entitled, “Rising Above the Herd” (Quin and Manners 1999). A key finding was the need to determine areas where store cattle could be produced competitively in the future. This was in the light of beef production in existing areas such as the South West and western South Coast being “squeezed” out by competition from alternative enterprises. This analysis has been prepared at the request of Agriculture WA to determine the potential for the Wheatbelt to produce store cattle competitively.

Electron Beam And Optical Depth Profiling Of Quasibulk Gan, L. Chernyak, A. Osinsky, G. Nootz, A. Schulte, J. Jasinski, M. Benamara, Z. Liliental-Weber, David C. Look, Richard J. Molnar

Electron beam and optical depth profiling of thick (5.5–64 μm) quasibulk n-type GaN samples, grown by hydride vapor-phase epitaxy, were carried out using electron beam induced current (EBIC), microphotoluminescence (PL), and transmission electron microscopy (TEM). The minority carrier diffusion length, L, was found to increase linearly from 0.25 μm, at a distance of about 5 μm from the GaN/sapphire interface, to 0.63 μm at the GaN surface, for a 36-μm-thick sample. The increase in L was accompanied by a corresponding increase in PL band-to-band radiative transition intensity as a function of distance from the GaN/sapphire interface. We attribute …

Identification Of The Gamma(5) And Gamma(6) Free Excitons In Gan, D. C. Reynolds, David C. Look, B. Jogai, A. W. Saxler, Seong-Ju S. Park, J. Y. Hahn

The Γ5 and Γ6 free excitons have been identified in GaN from emission measurements. Another emission peak is also observed which we believe to be the longitudinal free exciton. These measurements along with electrical measurements, which show the sample to have very high peak mobility, attest to the high quality of the sample.

For seventy years, the Hawai'i Temple (now called the La'ie Hawai'i Temple) has stood like a timeless vision of paradise, white and gleaming between emerald mountains and a sapphire sea. Some visitors have seen in its noble form and lush gardens a resemblance to the Taj Mahal or some wonder of the ancient world. However, my own reaction upon approaching the temple for the first time was surprise. New Photographs Of Joseph F. Smith's Centennial Memorial Trip To Vermont, 1905, Richard Neitzel Holzapfel, Paul H. Peterson

President Joseph F. Smith and a group of other Latter-day Saint Church leaders, accompanied by family and friends, left Salt Lake City on December 15, 1905, for Vermont to dedicate a memorial honoring the Prophet Joseph Smith, on the hundredth anniversary of his birth. During their trip, they visited Church historical sites in Ohio, New York, and Vermont and Smith family sites in Massachusetts, Vermont, and New York. Photographs were taken during most of the trip, preserving a view of the places considered sacred to the ever growing number of members of the Church.

A few years ago, in “A Form Letter to the Dean,” I offered the Journal's readers a template form letter which law school faculty could use to communicate with their deans. "A Well Regulated Militia": The Second Amendment In Historical Perspective, Paul Finkelman

In this Article, Finkelman argues that the purpose of the Second Amendment was to protect the right of the states to maintain militias and arm them if the national government refused to do so. This Article, based on the debates over ratification and over the Bill of Rights, shows that some extreme Antifederalists wanted the national government to guarantee a personal right to own weapons. But, as the evolution of the Amendment and the final text of the Amendment make clear, Madison and the other Federalists who totally dominated Congress at the time thoroughly rejected these demands for the protection …

The Second Amendment In Context: The Case Of The Vanishing Predicate, H. Richard Uviller, William G. Merkel

Uviller and Merkel argue that the Second Amendment right to keep and bear arms was intended by the framers (and, perhaps more importantly, understood by the ratifiers) to be intimately bound up in the ideal of service in the lawfully established militia-for many eighteenth-century Americans, the preferred alternative to that "bane of liberty," the standing army. But as Uviller and Merkel set out to show, the historic common militia celebrated in the republican ideology of eighteenth-century Whigs was already on the road to obsolescence when the Second Amendment became law. Fundamental Protection Of A Fundamental Right: Full Recovery Of Child-Rearing Damages For Wrongful Pregnancy, Patricia Baugher

The U. S. Constitution and Washington statutes protect the right to choose not to have a child as a fundamental right. When a healthy child is born after contraceptive methods fail due to physician negligence, parents can sue on a "wrongful pregnancy" cause of action. In all jurisdictions recognizing wrongful pregnancy, parents may recover damages for medical expenses associated with pregnancy and childbirth. A controversy exists, however, concerning whether parents may recover the ordinary expenses of child rearing. State V. Parker: Searching The Belongings Of Nonarrested Vehicle Passengers During A Search Incident To Arrest, H. Matthew Munson

The Fourth Amendment to the U.S. Constitution and Article I, Section 7 of the Washington Constitution generally require a warrant supported by probable cause to conduct a search or seizure. One exception to these requirements is a search incident to arrest, which permits the police to search arrested persons and the area within the arrestee's reach for weapons and evidence. Prior to State v. Parker, when police arrested an occupant of an automobile in Washington, they could search the entire passenger compartment of the vehicle with the exception of locked containers.
