Survey Of Aquatic Plants In Corps Of Engineers Reservoirs, Kimberly D. Walker, Mark D. Sytsma

A survey of aquatic plants in a selected Corps of Engineers reservoirs in Oregon was conducted. Cottage Grove, Dorena, Fern Ridge, Dexter and Willow Creek Reservoirs contained abundant aquatic plants. Potamogeton pectinatus and Potamogeton epihydrous were the most common native plant species. Myriophyllum aquaticum and Potamogeton crispus were the most widespread nonnative plants. Species richness in the reservoirs was correlated with trophic status and basin morphology. Shallow reservoirs that included extensive areas of nutrient-rich sediments that were historic flood plain soils supported the greatest biomass and number of species. Mesotrophic reservoirs had lower species diversity. Oligotrophic reservoirs with steep basin …

From the list of "problems" with the Limitation Act in the U.S. that are within the federal courts' power to resolve, I have elected to discuss three. Necessarily, the coverage of each problem will be brief. After a short summary of the Limitation Act's principal features, the essay examines the recurring confusion over the relevance of unseaworthiness in limitation actions. Second, it highlights the need to update the courts' choice of law doctrine for limitation issues. Finally, it turns to an issue that is only beginning to emerge, and one which the federal courts may yet save from idiosyncratic precedents …

Federal legislation establishing legal parity between electronic records and signatures and their paper and ink counterparts was signed into law June 30, 2000, and became effective, at least for most purposes, on October 1. The Electronic Signatures in Global and National Commerce Act (E-SIGN or the Act) effectively sweeps away a myriad of anachronistic and inconsistent state and federal requirements for paper and ink documents and signatures. In so doing, E-SIGN eliminates many of the legal uncertainties that have surrounded the use of electronic media in commerce and should enable businesses and consumers alike to more fully realize the cost …

This Article starts with a closer than customary look at the most serious obstacle to the ambitious campaign of environmental restoration that is the focus of this Symposium. That obstacle is the human brain.

The Article contends that human cognitive processes are marvelous designers of serviceable self-deceptions. In the war on nature that we witnessed in the twentieth century the most functional of these is the firm belief in a non-zero sum world. This is the conviction that gains from economic development could be enjoyed without sacrifice of the natural world.

The entry to a work zone is critical for traffic smoothness and safety because of the discontinuation of one or more lanes. The Indiana Lane Merge System (ILMS) was designed to implement dynamic lane change control at work zone entries by encouraging drivers to switch lanes well upstream of the discontinuous lane taper, thereby reducing the number of aggressive lane changes at the taper. At the time of this research, the ILMS had not been implemented on a large scale at rural freeway work zones. The End Of Innocence: Rethinking Noncombatancy In The Post-Kosovo Era, Charles J. Dunlap Jr.

The protection of civilians and their property in war is an accepted norm of international law - even where the putatively "noncombatant" populace openly supports the immoral use of force by its military. NATO's Kosovo operation suggests, however, that the imposition of hardship on the sentient, adult "noncombatant" population through property loss can erode a society's appetite for malevolence. While civilians should not be targeted, a new paradigm for noncombatancy that allows the destruction of certain property currently protected by international law but not absolutely indispensable to civilian survival may well help shorten conflict and effect necessary societal change.

This Article proposes the metaphor of connected contracts for understanding collaborative economic activity. "Connected contracts" refers to the interrelating agreements and relationships among the participants in a business venture. From the perspective offered by this metaphor, there are no firms, no predetermined hierarchies, no organizations with personalities of their own, and no a priori notions of ownership or control; there is no shareholder or managerial primacy and no centralizing "nexus." The view is from the bottom up rather than from the top down. Boundaries and governance are not central issues, nor do they loom in the background. There are no …
