Reasons Within Passions: Emotions And Intentions In Property Rights Bargaining, Peter H. Huang

This article discusses the role of emotions (or feelings or affects) in property rights bargaining. Real world people choose bargaining strategies based upon not only rational calculations, but also their gut feelings. This article considers the impact of anger and shame on bargaining over property rights and the Coase theorem. Such emotions may depend on beliefs (expectations or assessments) about whether particular strategic decisions should or will occur. Such beliefs can be viewed as attributions over the intentions of others.

The Conundrum Of Executive Compensation, Mark J. Loewenstein

Much of the scholarship on executive compensation that appears in law reviews assumes that large U.S. corporations overpay their chief executive officers ("CEOs"). This assumption is understandable, as many of these compensation packages are indeed stunning. The question of whether CEOs are overpaid, however, is complicated. Some scholars in other disciplines, principally in economics and management science, have studied the issue but, as this Article demonstrates, this literature does not confirm the assumption. Indeed, some studies suggest that CEO pay is competitive. Moreover, efforts to reduce the level of executive compensation may have the unintended consequence of achieving the opposite …

Web-based online public access catalogs (OPACs) enable catalogers to provide hotlinks to Internet-based resources of interest to their patrons. However, this capability is not without its challenges. Ms. Selden explores the local policy considerations associated with cataloging Internet resources and describes the policy-making process and some Internet cataloging policies used at the University of Colorado Law Library.

A Normative Analysis Of New Financially Engineered Derivatives, Peter H. Huang

This Article analyzes whether the introduction of new derivative assets makes a society better or worse off. Because trading such non-redundant derivatives produces new distributions of income across time and over possible future contingencies, individuals can utilize such financial instruments to hedge risks not possible before the introduction of these assets. Thus, it may seem that new derivatives unambiguously benefit society. In fact, introducing sufficiently many new derivatives completes asset markets. Asset markets are complete if trading on them can attain every possible payoff pattern of wealth across time and over possible future contingencies. The first fundamental theorem of welfare …

Why Students Leave School: A Review Of Literature, Joseph R. Boyle, Tara Anderson

This review of the literature is an analysis of research concerning students who drop out of school. The review will present an overview of the prevalence of the problem, common characteristics of students who are at-risk for dropping out, why students drop out, how students drop out, drop-out prevention programs, and implications of research on future prevention programs.

Approximately five out of every 100 young adults enrolled in high school in 1997 dropped out of school before October 1998 without successfully completing a high school program (National Center for Education Statistics, 1999). Over the past decade, 300 to 500 thousand …

The Justice Department yesterday filed an antitrust suit against members of the majority race, alleging that the group has harmed the public, consumers, and rivals by excluding Black and Latino/a competitors from the law school admissions market.' The Department alleges that a monopoly by whites has restricted competition and stifled innovation in legal education and the broader profession.

The government's central claim focuses on historical misconduct, rather than any contemporary wrongdoing. The complaint alleges that whites at the turn of the century monopolized the benefits of law school admissions for nearly one hundred years, by keeping nonwhites out of law …

Left Over Rights, Daria Roithmayr

This Essay focuses on Duncan Kennedy's argument for a "post-rights" position, in the wake of the earlier critical legal studies critique of rights and the ensuing response by Critical Race Theorists. I argue that, notwithstanding Kennedy's loss of faith in rights discourse, rights talk might still be pragmatically useful for communities of color to operate strategically within the accepted legal framework, or to subvert that framework in order to advance particular political commitments for particular communities of color at particular moments in history.

The Spirit Of 76: Does President Clinton's Roadless Lands Directive Violate The Spirit Of The National Forest Management Act Of 1976?, Jennifer Sullivan

This Article explores the competing resource protection and production interests surrounding President Clinton's proposal to ban new road building in areas of the Tongass National Forest. The Tongass is currently exempted from a temporary moratorium on road building while the Forest Service determines whether to include the Tongass in the roadless ban. This Article analyses the current legislative framework that guides Forest System management of the Tongass and legal challenges to the roadless ban's application to the Tongass. Finally, the Author suggests a potential compromise that balances commercial and production interests.

Religion And Modernity: Ritual Transformations And The Reconstruction Of Space And Time, Chee Kiong Tong, Lily Kong

Research Collection School of Social Sciences

In this paper, we use the case of Chinese religion in Singapore to examine the relationships between religion and modernity, and between social processes, on the one hand, and spatial conceptions, forms and structures and temporal practices, on the other. Specifically, we look at how traditional Chinese rituals are being modified, reinterpreted and invented to fit with modern living. Such ritual transformations entail reconstructed notions of space and time. Through such transformations, modernity does not simply lead to the demise of religious beliefs and practices but allows for a continued role for religion in providing a meaning system for Chinese …
