Birthright Citizenship In The United Kingdom And The United States, Michael Robert W. Houston
Vanderbilt Journal of Transnational Law
The common law concept of territorial birthright citizenship is the foundation for the Fourteenth Amendment's Citizenship Clause, which confers citizenship on those born within the United States and "subject" to its "jurisdiction." Likewise territorial underpinnings were the basis for over 375 years of birthright citizenship within the United Kingdom. Contemporary discourse with respect to territorial birthright citizenship, however, has shifted from its common law basis and now focuses on whether citizenship ought to inhere in children born to illegal immigrants. In the United Kingdom, the British Nationality Act of 1981 abandoned territorial birthright citizenship in favor of parentage based citizenship. …

The Legacy Of Geographical Morality And Colonialism: A Historical Assessment Of The Current Crusade Against Corruption, Padideh Ala'i

This Article examines the legacy of the rule of geographical morality--that is, the norm by which a citizen of a country in the North may engage in acts of corruption in any country in the South, including bribery and extortion, without the attachment of any moral condemnation to those acts. Part I of the Article begins by reviewing the impeachment trial of Warren Hastings, who served as the Governor of Bengal from 1772 until 1785, on charges of bribery and corruption. It was during that impeachment proceeding when the words "principle of geographical morality" were used to describe Hastings' defense. …

Industry-wide tort litigation, such as tobacco and gun litigation, poses a new problem for extraterritorial discovery. These suits allege conspiracies on the part of the tobacco and gun industries to conceal the dangers of their products from the public. Much of the evidence needed to prove the industries' knowledge is in their possession. These industries are international with companies located in the United Kingdom. Under U.S. discovery law the evidence is discoverable, but such is not the case under British discovery law. Therefore, the evidence and witnesses located in the United Kingdom are outside the grasp of U.S. plaintiffs. The …

This article looks at the implications of the evolution of health care reform from the perspectives of teaching health law in the United States. U.S. on Congress' adoption of important limits on federal welfare programs, the direct role of government in financing health care, and the practical and theoretical problems in attempting to move forward to a more government controlled health care systems.

Influence Of Corn Phenology On Adult Western Corn Rootworm (Coleoptera: Chrysomelidae) Distribution, Stephanie J. Darnell, Lance J. Meinke, Linda J. Young

Field studies were designed to more clearly determine how adult western corn rootworm, Diabrotica virgifera virgifera LeConte, population distribution patterns are altered over time by changes and contrasts in corn (Zea mays L.) plant phenology using whole-plant beetle counts as the sampling tool. In 1994, studies were conducted in a model system consisting of a late-planted corn strip placed in the middle of an early-planted cornfield. The system was replicated over three fields. Large-scale variation was modeled using trend-surface regression analysis to describe the relationship between beetle counts and distance from the center of the late-planted strip. In each …

Polymorphic Microsatellite Loci From The Lettuce Root Aphid, Pemphigus Bursarius, Nicholas Miller, A. J. Birley, G. M. Tatchell

Pemphigus bursarius is an occasional pest of agriculture with an annual life cycle that alternates between sexual reproduction on black poplars (Populus nigra) and parthenogenetic reproduction on the root systems of various Compositae, including lettuce. In general, aphids exhibit low allozyme variability (e.g. Tomiuk & Wöhrmann 1980), possibly as a consequence of the response of parthenogenetic lineages to natural selection (Hales et al. 1997). Microsatellite loci are typically more variable than allozymes (Tautz 1989) and are likely to provide a more informative system for the study of aphid populations.

Field experiments were conducted in 1997 to compare the efficacy Bt (Bacillus thuringiensis Berliner) maize hybrids and two conventional measures for control of the European corn borer, Ostrinia nubilalis (Hubner). Treatments consisted of transgenic Bt-maize hybrids and their non-Bt isolines, and isolines treated with a formulated Bt or permethrin insecticide. All control measures significantly reduced O. nubilalis damage in terms of tunnels per plant, length of tunneling, and larvae per plant. The following hierarchy in terms of O. nubilalis efficacy was observed: transgenic Bt > permethrin > formulated Bt > control. In most cases, transgenic Bt maize was most effective in preventing …

This study was performed in the Poroma community of the Oropeza Province, in the department of Chuquisaca. The Poroma community is characterized by a high poverty level among its members due to a number of different factors. Some of the major factors include: a restricted market, small farms, an absence of support systems, and a lack of support for agricultural development. This lack of support is seen in areas such as: research, roads, electricity, technical assistance, marketing systems, organization, and institutions that support rural development. Corral de Piedra and Salitron are two communities located in the municipality of San Juan Ermita, which is in the department of Chiquimula, Guatemala. In both communities, the land has very sloped topography with slope grades ranging from 12 to 55%. Agriculture is the main production activity with corn (Zea mays L.) and beans (Phaseolus vulgaris) being the crops of greatest economic importance. These crops are planted through a system of sequential association commonly called relay. First, corn is planted at the beginning of the rainy season (May or June). Three-Dimensional Computer Simulation Of Liquid Drop Evaporation, Mark Korlie

We use molecular dynamics simulation to describe a method that can be used to model liquid drop evaporation. For application, the liquid is taken to be water. Using the properties of the liquid and a Lennard-Jones potential, we derive dynamical equations, which are used to describe the gross dynamical behavior of the liquid-vapor molecular system. 3-D Particle Modeling Of Gas Bubbles In A Liquid, Mark Korlie

We use a molecular aggregate approach and classical, molecular dynamics type formulas to simulate the motion of gas bubbles within a liquid. For application, the liquid is taken to be water while the gas is taken to be carbon dioxide. The resulting dynamical equations are large systems of second-order, nonlinear, ordinary differential equations which are solved by a time-stepping numerical method. The rise of the bubbles and the motion of the water near the bubbles are described and discussed.

People high in rejection sensitivity (RS) anxiously expect rejection and are at risk for interpersonal and personal distress. Two studies examined the role of self-regulation through strategic attention deployment in moderating the link between RS and maladaptive outcomes. Self-regulation was assessed by the delay of gratification (DG) paradigm in childhood. In Study 1, preschoolers from the Stanford University community who participated in the DG paradigm were assessed 20 years later. Study 2 assessed low-income, minority middle school children on comparable measures. The increasing dominance of multimedia communication posed new requirements for the underlying systems. Multimedia data, formally called continuous media, has time constraints that impose real time limitations for their transmission. Certain levels of service, called Quality of Service (QoS), need to be considered when handling continuous media. The present work utilizes QoS concepts for networks that do not have inherent QoS support. The thesis aims at verifying the possibility of having QoS-controlled communication on non-guaranteed networks.
