The Sound Of One Form Battling: Comments On Daniel Keating's 'Exploring The Battle Of The Forms In Action', Richard Craswell

Daniel Keating has provided a thoughtful and useful study of the way that businesses form contracts. In particular, he has given us a good deal of data concerning the problem known as the "battle of the forms." Commercial lawyers have, of course, been wrangling over this problem for decades, so it is no small accomplishment to be able to offer a useful contribution. In Part I below, I describe more precisely just what Keating's data does and does not illuminate. Informality As A Bilateral Assurance Mechanism: Comments On Ronald Mann's 'The Role Of Letters Of Credit In Payment Transactions', Avery Wiener Katz

Ronald Mann's study of documentary defects in the presentation of commercial letters of credit is a valuable contribution to the commercial law literature in at least three respects. First, it offers a detailed and thorough empirical survey of an important though specialized aspect of commercial practice. Mann collected and coded a data sample of 500 randomly selected letter-of-credit transactions, personally evaluating each transaction to determine whether the documentary presentation by the beneficiary of the letter of credit (i.e., the seller) complied with the letter's formal terms. The present study examined the interaction of traditional and electronic contact methods with the stages of change model in a brief intervention. The sample consisted of a total of 220 high school (n = 106) and college athletes (n = 114), including 115 in the Electronic Group (E group) and 105 in the Traditional Group (T group). Overall, 14 teams participated in a sport psychology workshop including seven women's teams (n = 124) and seven men's teams (n = 96). Political participation in the United States can take several distinct forms, reflecting numerous socioeconomic and demographic factors that determine patterns of civic engagement. Within West Virginia, the presence of a high proportion of aged citizens has led to interesting levels of involvement. Differing patterns of engagement between age groups can be explained with regard to the influence of life-cycle, generational and period (historical) effects. Bay anchovy (Anchoa mitchilli) form a fundamental link in US Atlantic Coast estuaries converting zooplankton biomass to edible fish protein for recreationally and commercially important fish species such as striped bass (Morone saxatilis), bluefish (Pomatomus saltarix), and weakfish (Cynoscion regalis) and are often consumed by many species of seabirds. Bay anchovy numerically dominate the Hudson River ichthyofauna composition from May through November and are considered an important link in the Hudson River Estuary food chain. Endothelin-1 Gene Expression In The Porcine Ovary: Follicular Development., Hope Marie Sasway

Endothelin-1 (ET-1) is known to inhibit steroidogenesis in granulosa and luteal cells. This study investigates ET-1 gene expression to localize the source of synthesis. Previous studies showed the presence of ET-1 in porcine ovarian granulosa cell cultures. The present study provides the first evidence that gene expression of ET-1 occurs in the porcine ovary exclusively within the granulosa cells of antral follicles. ET-1 immunoreactivity was observed in 65.7% of the large antral follicles, particularly in more differentiated granulosa cells. An autocrine role for ET-1 is suggested because ET-1 binding sites were previously detected here. ET-1 expression and atresia (one aspect …

This research introduces the social world of gaming and looks at how one achieves the identity of gamer. The methods are a form of triangulation in order to strengthen the research, consisting of participant observation, written questionnaire, and one-to-one interviews, with an emphasis on the personal narrative. The main venues for the research were the two largest US gaming conventions, Origins and GenCon. From the data collected, elements of the world of gaming and becoming a gamer were learned and are presented. Essentially, the identity of gamer comes from the individual but is reinforced through the world of gaming.

This thesis analyses current spatial trends in the U.S. prison system, with a focus on the process of prison privatization. This study reviews the literature on trends in the US prison system, and maps the spatial distribution of public prisons, private prisons, and the trend to prison privatization. In addition, a case study of prison privatization in Texas is conducted. U.S. penal policy makers explain the need for privately run correctional facilities as a response to the “crisis” of the prison system, in particular the impact of overcrowding. Droplet formation is a common phenomenon that occurs in liquid-liquid or liquid-gas two-phase flows where turbulent mixing is present. This study considers only liquid-liquid systems and presents the theoretical background and validation of a droplet formation and entrainment (DFE) model with application to stratified shear layer flows of diesel fuel and water. A parallel experimental study by Wu and Katz (1999) of the same flow is used as a guide in our analysis. The best technique to prevent these harmful particles from reaching the respiratory tract is physical interception. This study utilized six subjects from the West Virginia University Motor pool, whose exposure to whole-body vibrations were measured and reported as root mean squared (r.m.s.) values in accordance with ISO standard 2631. Each subject completed a questionnaire regarding their general health, and specifically whether they experienced low back pain, and if so, the extent and severity of this pain. It was expected that the individuals subjected to the highest vibration levels would tend to report LBP, with severity of pain increasing with the intensity of exposure. Ecology Of Bald Eagles During The Postfledging Period At Rural And Suburban Nest Sites In Southwest Florida., Dorothy Edna Tinkler

In this study, I examined aspects of fledgling and adult behavior at the nest site. Approximately 90% of the observations placed the fledgling bald eagles within the 456m secondary buffer zone. The fledglings centered their activity in the lowest disturbance levels possible. Fledglings were observed most frequently in the nest, on the ground, or perched in a pine tree. For 92% of the intensively observed individuals, 100% of the 50% core use area occurred within the primary buffer zone. Percent overlap of the 95% core use area with the secondary buffer zone was significantly different between suburban and rural fledglings …

This study investigated the success of the National Association of Stock Car Automobile Racing (NASCAR). An examination and analysis of history as related to success provided a framework to understand the sport. Content experts in the motor sport field (identified through leadership identification) validated previously established NASCAR categories through a review process. Critical incident interviews were conducted to identify and prioritize the most important identified elements within these categories with the results of the interviews being compiled in a typology format.
