The Grand Jury And Exculpatory Evidence: Should The Prosecutor Be Required To Disclose Exculpatory Evidence To The Grand Jury, Ali Lombardo
Cleveland State Law Review
In 1992, the United States Supreme Court ruled in United States v. Williams that the federal courts do not have the supervisory power to require prosecutors to present exculpatory evidence to the grand jury. This Note argues that the Williams decision is flawed because it diminishes crucial rights of defendants and because it prevents the grand jury from fulfilling its protective function. In Section II, this Note examines the historical background and purpose of the grand jury in England and America. Section III discusses the Williams decision and the rationale behind both the majority and dissenting opinions. It also discusses …

This panel will discuss the prospects and perils of local human rights initiatives. Specifically, I will talk about the nature of these local initiatives and their advantages and disadvantages. Time permitting, I will also talk about our successful effort last year in Toledo, Ohio to pass a human rights ordinance that includes sexual orientation as a protected category, and why it is so crucial that lawyers and law professors become involved in these local campaigns. Part I of this paper provides a brief overview of the development of biotechnology, its regulation and its use, with a particular emphasis on agricultural biotechnology. Part II outlines the United Nations Convention on Biological Diversity, which provides an international legal framework for a biosafety protocol and summarizes the results of recent protocol negotiations, such as those conducted in Cartagena, Colombia in February 1999, which continued in Montreal in January 2000. Part III explains why the proposed protocol embodies a variant of the precautionary principle and why such policies may do more harm than good. This paper concludes with some …

In the post-World War II international economy, with its enormous growth in transnational trade and investment, multinational legal practice has become a functional reality. Within the last two decades, the volume of trans-border legal practice has grown enormously in fields such as trade law, international banking and finance, international arbitration and litigation, international contractual and joint venture arrangements, transborder acquisitions and mergers, international antitrust, inter- national tax planning, and foreign investment counselling. Domestic law firms within the leading commercial nations have not only grown substantially in size, often by merger, they have also increasingly created networks of foreign branch offices, …

In this study, a model was used for the optimization of product mix (the amounts of each product in the mixture) in particleboard industry by using linear programming. A theoretical model was constructed in which operations research methods and linear programming were applied to the maximization of the profit of a particleboard mill (KÖYKOBİR) as the consumer of industrial wood. To this end, 1993-1994-1995-1996 production, sales, stock quantities and costs as well as data related to capacities of the chipping, drying, pressing, sanding and gluing units were processed. This research was conducted at the Adnan Menderes University Agricultural Faculty.The objectives of the study were to investigate the heterotic effects of earliness and agricultural and quality characters under Aegean region conditions, where earliness is extremely important, and to determine correlations among earliness characters and correlations among earliness, yield, ginning output, seed cotton weight per boll and quality characteristics in cotton (Gossypium hirsutum L). Estimation Of Inheritance Of Some Agronomical Characters In Common Wheat By Diallel Cross Analysis, Okan Şener, Mehmet Kilinç, Tacetti̇n Yağbasanlar
Turkish Journal of Agriculture and Forestry
This study was conducted to determine the genetic structure of a population which included six common wheat cultivars or lines and crosses of half diallel cultivars or lines. It was concluded that the epistatic effect was significant for a weight of 1000 grains and yield per plant, while the additive effect was significant for period of maturity, the number of spikelets per head, and the number of kernels per hear. The dominance effect was found in yield per plant. A partial dominance effect was found in other char-acters. It was found that at least 4 pairs of genes were effective …

In this study, eight strains from five different combinations improved for the South Marmara Region and two cultivars of bread wheat were used as the plant materials. The cultivars used in the experiment have been widely grown in this region. Some important agronomic traits of both cultivars and strains were determined in yield experiments lasting four years. Plant height, seed number and seed weight per spike, 1000-seed weight, seed yield and hectoliter weight were examined and compared with the control cultivars and strains of F 6 -F 9 generations. This study was conducted to determine the effects of different media, auxin types and concentrations on callus induction and plant regeneration from young inflorescences of 15 ecotypes of yellow bluestem ( Bothriochloa ischaemum). The young inflorescences were cultured on two different basal media (LS and SH) containing different concentrations (2, 4, 6, and 8 mg/l) of two different auxins (2, 4-D and Dicamba). The results showed that the ecotypes were significantly different from each other in callus induction rate, callus weight per dish and regenerate number per inflorescence segment. Boron tolerance of the following maize cultivars, Furio, Riogrande, Sele, DK 743, Helix, Missouri, Betor and Poker, was investigated. The experiment was carried out under greenhouse conditions. Boron was applied to the soil at 0, 10 and 30 mg kg -1 levels as H 3 BO 3 . Fresh and dry weights and B concentration and B uptake of the plants were determined at the end of the experiment. Boron tolerance of the corn cultivars was determined from the relationships between fresh and dry weights and B concentration and B uptake rates. According to the results, B tolerance of cultivars …

Turkish Journal of Agriculture and Forestry
Agricultural trade policies between Turkey and the European Union are modeled using a political preference function (PPF). The PPF is used to estimate the producer and consumer weights perceived by policy makers. The agricultural effects of Turkey's integration into the European Union (EU) and optimal strategies for Turkey and the EU are analyzed Results show that Turkey' s PPF values will be lower, with respect to agriculture, when it joins the EU; however, EU trade liberalization benefits Turkey.

This study was carried out in Amasya during 1994 and 1995. The aim of this study was to determine the effect of various chemical applications before harvest on epidermal characteristics related with fruit cracking in some sweet cherry cultivars (0900 Ziraat, Lambert and Van). The trees of the cherry cultivars were sprayed with GA 3 (20 ppm), NAA (1 ppm), GA 3 +NAA (20+1 ppm), NAA+Ca(OH) 2 (1 ppm+0.7%), GA 3 +Ca(OH) 2 (20 ppm+0.7%) and GA 3 +NAA+Ca(OH) 2 (20 ppm+1ppm+0.7%) 30-35 days before harvest. The suitability was determined of Kazova Agricultural Farm soils for land utilization types, both those in use and those with a potential for use. Simple Limitation and Şenol Land Evaluation Methods were used. The results from the Simple Limitation Method showed that the Yeşilırmak and Eğertepe series are permanently unsuitable and the Mera series is currently unsuitable for all of the determined land utilization types. While the çaylı and Obalar series are marginally suitable for the land utilization types, the İşletme series is moderately suitable. Ten sample trees obtained from the Düzce region were tested for bending, impact bending, compression, hardness, Cleavage and Shear strength. The relationships between strength and density were investigated. The results obtained were as follows: average density value 0.52 g/cm^3. In contrast to the photolysis of Cr(CO)3(C6H6) in nonhalogenated solvents, in which the products are CrL(CO)2(C6H6) in the presence of a donor L, or Cr(CO)6 and C6H6 if no donor is present, the photo-reaction in chloroform yields CrCl3. No significant portion of the reaction occurs through absorption of 254nm light by CHCl3• The quantum yield is 1.4, consistent with a mechanism in which several radicals are formed upon chlorination of the chromium, which then cause further decomposition of the reactant. …

It has the same topological construction for the cascade stages of the Comega interconnection. As Hispanics become more and more visible in the United States, businesses need to recognize this group of consumers as the valuable asset it is. Hispanics are becoming better educated, which leads to higher paying jobs and more buying power. What companies need to realize, though, is that it takes a sincere effort to reach this unique consumer group. Translating the general advertising campaign into Spanish is not sufficient enough to gain this group's loyalty.
